National Journal of Cyber Security Law publishes original research and review articles in the interdisciplinary cyber domain. It is a research Journal on various Cyber Security challenges. Scholarly contributions in this discipline are welcome to cover the various aspects of cybersecurity. National Journal of Cyber Security Law provides a hub around which the interdisciplinary Cyber Security community can form a robust knowledge base. The internet, like life, is a blend of good and bad. Cyberspace, with all of its benefits, still has a dark side. Trespassing into a computer system to cause sabotage of the systems and records, as well as theft of the stored data, are common criminal activities associated with this crime. These crimes know no bounds and have an effect on countries all over the world. These crimes are described as unlawful, unauthorised human behaviour involving the automatic processing and transmission of data through computer systems and networks. It is the most difficult task for the police, judges, and legislators. Various legal measures exist in our legal system to regulate and deter cybercrime. The author of this article will discuss every element of the legislative mechanisms in place to regulate and deter cybercrime.

The Emergence of International Cyberspace Law and The Consequences Pertaining to Individuals

Abstract: According to official statistics, more than 4.5 billion people use the Internet today, while social media users have exceeded the threshold of 3.8 billion. Almost 60% of the world’s population is already online, and the latest trends suggest that more than half of the world’s total population will use social media by mid-year (Kemp, 2020). The average Internet user now spends 6 hours and 43 minutes online every day which is equivalent to more than 100 days of connected time per Internet user per year. However, in the Digital Age, in order to reach a Smart Society, some important challenges remain and more work needs to be done to ensure that everyone has fair and secure access to life-changing digital connectivity. Heightened digital connectivity and increasingly sophisticated cyber threats have promoted the need for smart cyber security as a logical response to risk management. Despite obvious challenges, there are promises based on a multitude of evolving cognitive technologies that can help improve cybersecurity and enable navigation in the increasingly malicious and disruptive landscape of cyber threats. The main focus of this article is to analyze the emergence of a new body of law, namely international cyberspace law and the normative consequences it poses from an individual’s perspective. We will also highlight the key elements and tools that can guarantee an effective approach to national challenges and that can contribute to the development of coherent international relations in the field of cyber security: forecasting, education, detection and response capabilities, ethics and resilience. World has witnessed a new technological revolution in the form of internet especially in the latter half of the last century. Internet is a worldwide system of interconnected computers used for communication purposes. It has enabled millions of people throughout the world to communicate and interact with one another without regard to space and time limitations. Internet, as such, has removed constraints of space, time and distance. It has transcended conventional tangible boundaries. Internet can be said to be a information superhighway, a virtual library, a river or a global village. Internet has always posed a great challenge to law making and law enforcing authorities. Many areas of law, including, intellectual property, constitutional, commercial and criminal law have been particularly affected in varying degrees by the internet. The main problem relating to internet is that there is no central law governing the internet because there’s no central policy-making body that enforces internet decisions. This creates problems on such issues as jurisdiction, criminal law, evidence, privacy and even human rights. However, the most important aspect from public law standpoint has been the efforts at the international level to construct an international regime for global internet governance. Many of the governments whose citizens are connected to internet have expressed concern about the problems the internet has created. They have attempted to take action against the Internet’s intrusion upon the moral and cultural sensibilities of their citizens. However, individual attempts at regulating a worldwide system seem futile. Most attempts to define new rules rely on the disintegrating concept of territory while ignoring the new network and technological borders that transcend national boundaries. Currently, due to lack of national boundaries on the Internet, the only adequate way for countries to assert any control over the internet seems to involve withdrawing or restricting access. In this backdrop, it is being widely felt that a new international agreement must be concluded which recognizes the complexity of networks and allows expansion of the information revolution while avoiding the problems present in the existing legal framework. A possible solution to some of the problems resulting from internet use would be the creation of an international convention for governing this new medium of communication. This paper discusses some of the problems inherent to the Internet and analyses current international legal norms that apply to the internet. It enumerates certain set of principles and norms that could provide the foundation for the new Internet governance regime. It also opines that best way forward would be to conclude a framework convention as an appropriate institutional mechanism for advancing such a regime in the initial stage of its formation.

3L Annabelle Lincoln Presents Pioneering Paper at SportsLand Summit
Third-year law student Annabelle Lincoln recently presented her research at the inaugural SportsLand Summit, held at the Cleveland Browns Stadium. The summit gathered prominent figures in sports, healthcare, technology and human performance.
Lincoln's presentation focused on a research paper she co-authored with fellow CWRU Law students Nathaniel Arnholt and Trey Quillin. The research began in the fall of 2023, with the students exploring varying sports law topics. Ultimately, Lincoln, Arnholt and Quillin were encouraged to further explore their research in the spring semester, culminating in a research paper that was finalized over the summer.
Their paper explores the critical issue of collegiate athletes’ control over their personal data within college athletics. With rapid advancements in wearable technology, the ability to collect vast amounts of data on athletes both on and off the field has grown exponentially. This data is increasingly valuable to organizations, raising important questions about ownership of that information.
The legal frameworks governing athlete data rights are complex and vary depending on the athlete's status—whether professional, collegiate or amateur. While the research of Lincoln and her team primarily focused on collegiate athletes, they believe their findings may have broader implications for athletes at all levels. Reflecting on her experience, Lincoln expressed her gratitude for the opportunity to speak at such a prestigious event, which featured influential leaders such as David Jenkins, COO of the Cleveland Browns, and the CEO of the Rock Entertainment Group, Nic Barlage, along with top team physicians and HealthTech experts. She also thanked Sports Data Labs founders Stan Mimoto and Mark Gorski, and commended Professor Craig Nard for his guidance throughout her research journey.
Lincoln concluded by emphasizing the importance of their research, stating, "Nathan, Trey and I researched this topic extensively and hope our paper will be helpful to players and industry leaders moving forward."

Protest in gb over ‘misuse’ of ata, cybercrime laws.
GILGIT: The Gilgit-Baltistan Awami Action Committee on Monday organised a protest rally against the misuse of Anti-Terrorism Act and cybercrime laws, saying these laws are being used by the government to silence the voice of people against injustices in the area and to curb freedom of expression.
The rally was led by GB Awami Action Committee chairman Advocate Ehsan Ali, Baltistan division president Najaf Ali and senior leaders Baba Jan and Mumtaz Nagri.
The participants of the rally marched on the River View road and assembled at the Central Press Club of Gilgit where the committee leaders addressed the participants of the rally.
Speaking on the occasion, the committee leaders said that Anti-Terrorism Act and cybercrime laws are being misused by the government in the region.
They said that fake cases have been registered against political workers and GB Awami Action Committee office-bearers under the Anti-Terrorism Act and cybercrime laws to silence their voices which are being raised for the rights of the people.
They said that coercive actions against political workers would not be accepted and they would continue to use their right of freedom of speech.
The GB government recently included the name of the Awami Action Committee chairman and others in the Fourth Schedule.

Najaf Ali, the president of the Awami Action Committee, Baltistan division, said they have been demanding the basic rights of the local people, uninterrupted provision of electricity and the local people’s right to have ownership of local lands.
He said that instead resolving public issues, the Federal Investigation Agency has started registering fake cases against the local people.
The speakers said that local bodies elections have not been held in the area for the last two decades and “land grabbing and issuance of licences for mineral exploration to non-locals continue in the area”.
The protesters unanimously passed a resolution demanding the withdrawal of cybercrime notices issued to political workers. The resolution also demanded the government to dismiss illegal cases registered against the GB Awami Action Committee office-bearers.

Topics Inherently Ripe for Law Review
As a practical matter, choosing an initial topic that is inherently ripe for a law review article is an option and a good place to start because they focus on an unresolved legal issue.
1. Circuit Splits - A circuit split is "[t]he existence of conflicting decisions between two or more of the United States courts of appeals, usu[ally] on a question of law. Circuit Split, Black's Law Dictionary (12th ed. 2024). A circuit spilt is a ripe topic for law review because it allows for the author to make a number of normative statements about the law at issue. U.S. Law Week , which can be accessed by Bloomberg, is a great resource for circuit splits. Watch the below video on how to use LexisNexis to find circuit splits.
2. Cases of First Impression - A case of first impression is "a case for the determination of which no precedent can be found." Case primae impressionis , Ballentine's Law Dictionary (3d ed. 1969). Like a circuit spilt, a case of first impression is a ripe topic for law review because it allows for the author to make a number of normative statements about the law at issue as it is an unresolved legal issue.
Search "first impression", "case of first impression" or "matter of first impression" when researching in case law, legal news, blogs, or you can use Lexis+AI (please note that you should always check the results of AI).
3. Comparative State Surveys - Comparative state surveys will allow you to compare law across states as you search for unresolved legal issues.

The article examines the influence of structural, institutional, and spatial factors on business performance in Novosibirsk oblast, Russia, based on information about enterprises in the region for 2019–2020 available in the SPARK-Interfax database. An empirical analysis was carried out using regression models; an approach based on an extended production function was used, within which, along with assets and wages, the impact on the revenue and profit of enterprises for such factors as industry, age of company, form of ownership, and distance to regional capital was assessed. Assessments found higher productivity and profitability among private enterprises and young businesses, which argues for support of entrepreneurship and new firms in the region. Higher productivity and profitability of businesses in industry and services compared to agriculture indicate the advisability of assistance to the agricultural sector. The results of the analysis showed the significant contribution of agglomeration effects to the results of the operation of firms in Novosibirsk oblast, which is comparable to the average Russian estimates, and this speaks to the request for implementation of transport and infrastructure projects that reduce the costs of business interaction.
