Law Assignment: Case Analysis Of AB Migration

Task: Question:Scenario: You are a junior RMA at AB Migration. AB Migration is owned by Ali Behood, a registered agent. Paul Moreno, a client of the firm who you assisted in the past, was granted a subclass 190 visa on 1 August 2019. He was sponsored by the Queensland Government. Included in his application was his spouse, Katrina Moreno. You undertook all the work, and were the RMA identified in the state nomination application and the visa application. At the time of grant, you notified him, closed the file, and returned the 2 original AFP checks and 2 original IELTS reports you had on file to the residential address that was listed on the visa application. No other address is recorded in the file. Questions 1. On 1 September 2020 you receive a letter from the Manager of Business and Skilled Migration Qld (BSMQ) addressed to Ali Behood of AB Migration, requesting the current residential address of Paul Moreno. The letter notes that he signed an undertaking as part of the subclass 190 state sponsorship process, including an obligation to update BSMQ of any changes of address. Write a file note for Ali explaining the following, and referencing all relevant legislation:

a. Who owes client obligations to Paul under the code – Ali, AB Migration, or you, b. What client obligations are relevant to this request, and c. How should Ali respond to BSMQ, and d. What communication do you recommend with Paul.

Question 2. On 2 September 2020 you receive a notice from the Minister under Section 18 of the Migration Act 1958 (Cth) requiring that you provide the residential address of Katrina Moreno who the Minister has reason to believe is an unlawful non-citizen. The notice is addressed to you. Write a file note for Ali explaining:

a) the obligations related to responding to the notice under the Act, and b) b your obligations to the client under the Code of Conduct.

Question 3. Ali responds to your file note suggesting that there are no obligations owed to Katrina Moreno as ‘She was not our client, and even if she was, she no longer is.’. He notes that Paul Moreno signed the client agreement, paid all fees and all communication was through him. Write a response to Ali in the form of a file note. Refer to the relevant legislation.

Question 4. On 3 September 2020 you receive an email from Katrina Moreno. She requests that you provide her with Paul Moreno’s contact details. Write a response, in email form, including explaining the relevant obligations under the Code of Conduct.

Question 5. On 4 September 2020 Paul emails you saying that he has been reviewing the accounts from his application, and he believes that he has overpaid you $100 when he deposited the fees and disbursements into your client account. He requests a refund of this money, and any interest that has accrued on the funds. You review his accounting and find that he is correct, and that the $100 has been retained in the client account and overlooked. You also note that the client account does accrue interest at the rate of 1% per annum. Write a file note for Ali explaining the obligations related to this request, identify any obligations under the Code of Conduct, and make recommendations for any changes to accounting and/or banking procedures in the future.

Question 6. Paul also requests a return of all documents, noting that 2 original AFP checks and 2 original IELTS reports were sent to you and not returned. Respond to Paul setting out the office processes for receiving and returning original documents, which were followed in this case. Include an explanation of how your office procedures comply with the Code of Conduct.

Question 7. While you are reviewing Paul’s file you notice something odd about the IELTS test report that was submitted to the Department. Some of the characters are not straight, and they appear to be in a different font to the rest of the document. Write a file note for Ali explaining your observations, and make recommendations for action for this particular case. Identify any relevant Code of Conduct obligations, and any MARA advice on this issue. Suggest any changes to document procedures in the future. Question 8. Paul is not satisfied by your responses, and asks you to explain what his options are to complain. Respond to Paul explaining MARA complaints processes. Refer to whatever material you have already provided him on this process.

Question 1 Issues The issue involved in the case of Paul is that he has failed to present his current residential address during the form fill-up of his visa. It has been identified by the manager of Business and Skilled Migration Qld. It is necessary to ensure that there exists the current address of the client because he signed the subclass 190 state sponsorship that included an obligation to update the organization of BSMQ about any changes in his address.

Rules According to the code of conduct of Australian Migration Law, it is the responsibility of the migration agent to communicate with the client about the migration, the charges and fees for migration and keeping the record for the agency along with the financial management . The responsibility of the migration agent to the agent of BSMQ, the employees worked with the agent and some requirement values that are used to respond whether a complaint is conducted against the agent.

Application As stated by the code of conduct of Australian migration law, it is the responsibility of Ali to contact Paul for collecting the existing address of him and handle it to the agent of BSMQ. The obligation is legally obliged to Ali to take all the responsibility in his own hand and contact Paul for the current address of him . Therefore, if any information goes missing it will be held by Ali.

Conclusion The code of conduct instructed the migration agent, in this case, Ali for collecting all the information by communicating with Paul, the client. Therefore, Ali needs to communicate with Paul by e-mail where he is required to ask Paul about his existing address, who is obliged by the BSMQ and as the rule, it has to be handed over by the migration agent, not the person who migrated through the agency.

Question 2 Issues The issue involved in the case is that the agency received another notice which instructs them to provide the residential address of Katrina Moreno, who actually is not obliged by the AB migration as well as Ali. The minister of BSMQ under section 18 of the Migration Act 1958 stated that it is required to collect the existing address of Katrina, the spouse of Paul, and to know the BSMQ that the obligation of Ali.

Rules According to Section 18 of the Migration Act 1958 of Australian federation, it legally obliges the agency to provide information to the minster of every individual who is assumed to be an unlawful non-citizen . According to the code of conduct of migration law, the migration agency is obliged to provide information about the client only, who is Paul and not any other individual who has been registered along with the client.

Application Since the minster of BSMQ instructed the migration agent about the information of Katrina so they have the obligation to inform the client. But, the obligation of the client under the code of conduct of the Australian Migration Act stated that Ali required to inform Paul that it has been instructed to hand over the residential address of Katrina to the minster of BSMQ . Therefore, Katrina needs to be the client of AB migration so that Ali can submit her address as well.

Conclusion The Migration Act 1958 under section 18 is has been stated that the agency has to give every information about the client who assumed to be an unlawful non-citizen. But in this case, Paul is the only client of AB migration and the minister of BSMQ instructed to collect the residential address of Katrina who is not the client of AB migration and under the code of conduct, there is no obligation to the person who is not a client of migration agency.

Question 3 Issues The issues recognized in this particular case is that Ali claimed that Katrina is not a client of his agency. Paul, the client of AB migration has signed as the agent of Katrina and the overall responsibility of Katrina in fulfilled by Paul. Therefore, according to Ali, if the minister of BSMQ instructed to give the residential address of Katrina it is the responsibility of Paul to hand over the information and there is no obligation about Ali.

Rules According to the code of conduct of the Australian Migration Act 1958, the overall responsibility of a client is over to the agent and if there is any mistake or the visa get expired then the government of the country can deport that person . Therefore, the agency or the agent needs to submit a query for any kind of information and any instruction given by the BSMQ minister. By communicating over the mail it can be discussed.

Application Though the client has been registered his spouse name in the application form and as stated by the code of conduct of the Australian Migration Act 1958 that, it is the responsibility of the agent to collect every information of the client with his own hand . Therefore, Ali needs to collect the residential address of Katrina as Paul mentioned her name in the application form and submitted to the minister of BSMQ.

Conclusion According to the code of conduct of the Australian Migration Act, it is required to communicate with the client for any information and the overall responsibility of the client is over the agency and the agent. In this case, where BSMQ instructed to submit the residential address of Katrina, it is the responsibility of Ali to collect it by communicating over email and submit it to the minister of BSMQ within the guidance of AB migration.

Question 5 Issues The issue acknowledged in this particular case is improper verification of financial accounts which resulted in retaining $100 from the client account and it was overlooked. Also, the client account has accrued interest at the rate of 1% per annum. Therefore, it is the responsibility of Ali to refund the amount within interest and verify its financial accounts carefully. This type of mistake can make negative feedback and it will be a great loss for the agency.

Rules According to part 7 of the code of conduct of the Australian Migration Act 1958, it is the responsibility of the agent to maintain the operation of expenses and inform about the fees and disbursement . It is also the responsibility of the client to prevent any of the financial issues faced by the client. The agency must have to be liable if any financial mistakes ever happened then the agency needs to rectify it as soon as possible

Application According to part 7 of the code of conduct of the Australian Migration Act 1958, it is the responsibility of the AB migration agency to inform Paul about the financial mistake and refund the amount within the interest of 1% per annum. The agency required to be careful about that type of mistake and for the next time, check every transaction account minutely whether any of the mistakes happened .

Conclusion As stated by the legal rules and regulations to refund every extra amount by the client and inform clearly about the fees and disbursement structure. It is the liability for the AB migration agency to Paul as a client, he will get the refund amount and the interest also. The relationship between the client and agency will be intact and any kind of negative feedback will be verified properly for the next time. The financial mistake will be rectified for the very next time.

Question 7 Issue The issue observed while removing the file of Paul includes some odd aspects in the IELTS test report which was submitted to the department. It was observed that some characters but not straight and appeared to be of the different font from the rest of the document. The difference in the different fonts throughout the document can generate issues for Paul during visa verification. The identified issues included lack of information provided to Paul which must be rectified at earliest.

Rules According to the code of conduct implemented on migration agencies under the migration law 1958 by the Australian government, it is a responsibility of the migration agency to inform and interact with the client regarding issues in the documents and avoid financial loss to a client . It is the responsibility of the migration agent to understand the issues faced by the clients and inform them about the changes which can be made in the document procedures in future.

Application According to the code of conduct of migration law of Australia, Ali must understand his obligations towards his customers and inform Paul about the different fonts and characters throughout the document . Ali can recommend changing the document process from offline mode using pen and pencil to the online mode which reduces the risk of legal implications regarding the variation of the font in the documents. Informing Paul about the change possible in the documenting process would allow him to ensure that he can change the documents submitted for the visa in future.

Conclusion The code of conduct and migration act the migration agents to verify the documents submitted by the client and store them for 7 years to ensure that their client faces no issues after filing an application for Visa. The documentation process can be shifted from offline to online more to ensure that issues regarding the difference in characters and phones can be avoided and help the clients to deal with legal complications in future.

This condition is important in the case of an entire student visa as per the” “Migration Act 1958”. There should be the maintenance of satisfactory attendance by the student in the course that has been pursued. In this case, Stan cannot be able to travel as the current visa status has been dependent upon the “Form-I 765 “. An Opposition MP aims to introduce in the Commonwealth Parliament the Migration Bill 2014 .   S 180 of the Bill provides that an officer must detain a person if he or she knows or reasonably suspects that the person is an unlawful non-citizen in or outside the migration zone.

Under s 181 of the Bill, an officer must remove an unlawful non-citizen 'as soon as reasonably practicable' if the person is not immigration-cleared. Otherwise, detention is to continue until the Refugee Review Commission (RRC) determines that detention is unlawful. The procedure provides that, within 3 weeks upon application by the detained person, the RRC 'determines' the lawfulness of the detention. The RRC's determination is subsequently conveyed to the Registry of the Federal Court within 2 weeks of the 'determination' being made. Initially, s 180 provided that a determination by the RRC would not become enforceable without the institution of separate proceedings before the Federal Court . However, in the drafting process this mechanism was revised, so that, finally, RRC's determinations become effective after transmission to the Registry of the Federal Court , in the absence of an application for review by any interested party within 2 weeks from the time of transmission.

The question of immigration and constitutionality

Among the first cases that related immigration with the constitution was the case of Murray V Parkes   which discussed the concepts of citizenship, nationality and domicile . While illegal immigrants may not themselves be allowed to practice and carry out work in the country legally, their children cannot be denied the right to education. This was what was held out in the United States case of Plyler v. Doe.

There are a number of concerns that need to be addressed, in this given scenario. Here are some of the problems that can crop up.1.      Following due process of law

Every statutory Act and legislation needs to have a due process and procedure. In the absence of a due process or procedure, the Act can be stated to be constitutionally void. The Bill here this needs to have a proper procedure and guidelines and follow the principles of natural justice.

2.      Giving the opportunity to be heard

The main problem with the Migration Bill 2014 rests with Section 180 of the Bill. It is stated that  the officer has to remove the unlawful citizen 'as soon as possible'. It's stated that the person needs to apply to the Refugee Review Commission (RRC) for it to be verified if his detention has been illegal. Otherwise, the officer can remove him. On the other hand, the RRC can decide on its own within three weeks and reach its own determination, which it will only notify to the Government and not carry out a separate Federal suit as was required before. What this essentially means is that the victim will not have the right to be heard at either of the stages. The victim thus does not have any chance for him to be heard in front of the proper authority. The principles of natural justice requires that the person should be heard properly which seems to be missing and the remedy for that is not available…….

Rules requiring visa-free foreign workers employed in housing and utilities, retail and everyday consumer services to prove they are able to speak basic Russian have been in effect in the Russian Federation for almost six months. Proof of such ability takes the form of a state test certificate or an educational qualification (of no lower than school level) showing the study of Russian. Educational qualifications from other countries are also acceptable if they show that the holder has taken Russian language courses.

So far, according to information on the migration service's web site, the new rules have not caused too much of a reaction among migrant workers: in the first month after the rules took effect, only a few dozen future housing, utilities, retail and everyday consumer service workers applied for state test certificates in Moscow. Another 190 submitted educational qualifications showing at least basic knowledge of Russian. However, in the foreseeable future the number of foreign workers to be affected by the Russian language requirements may be considerably higher.

At present the State Duma is considering a new draft law that significantly broadens Russian language requirements for migrant workers, who will be required to take examinations in Russian history and law in addition to the current Russian language requirement in order to obtain the certification. The certificate will be required in order to obtain work permits, work visas, worker patents, and permanent residency in Russia.

The draft law in the form currently before the State Duma affects practically all categories of foreign employees (visa or non-visa) working in Russia, irrespective of whether they are migrants from the former Soviet Union working as street cleaners, or skilled drilling engineers from elsewhere. The amendments will also apply to foreign workers working on the basis of a patent (nannies, housekeepers, etc.), and foreigners obtaining permanent residence permits.

The form and procedure for the examinations on Russian language, history and laws, as well as the minimum requirements to pass the exam, will be developed by the Education and Science Ministry , which will be provided with the respective authority. The certificates are expected to be issued by authorized organizations in Russia and abroad. Certificates will be valid for five years.

If the law is passed, the amendments will take effect from Jan. 1, 2015.

The amendments will not affect highly-qualified specialists (foreign employees earning more than 2 million rubles a year who hold an applicable work permit), members of their families, or foreign citizens working at the Skolkovo innovation center. It is likely that further exemptions will be made while the draft law is being considered. These exemptions may apply, for example, to directors, athletes, and artists.

Legislators believe the changes will be an important step toward the adaptation and integration of foreign citizens in accordance with the State Migration Policy of the Russian Federation Concept for the period to 2025 adopted last year. Moreover, the amendments will help deal with problems such as reducing the risk of social tension, create conditions for the effective protection of the rights and lawful interests of migrant workers, ensure their safety, promote the hiring of foreign workers who know Russian, and further encourage the popularization of Russian outside of Russia, particularly in the CIS, which is where most migrant labor comes from.

The Russian language, history and law examination will be paid for by the foreign citizens taking it. The charge for the state service of holding the examinations and issuing the respective certificates is expected to be up to 5,000 rubles.

The procedure for receiving the work visa for foreign citizens

Obtaining a work visa for the foreign citizen is a multistage and long process. For example, it will take on the average 100 days and 15900 ₽ (only to pay the state fee) for the Company-employer registered in Moscow to hire a foreign worker. Since a work permit is valid maximum for 1 year, it is necessary to start processing a new work visa 6 months after receiving the current work visa.

Citizens of the CIS do not need a visa to enter Russia, and Work permit is issued for them in the simplified order for 10 working days and 4000 ₽ approximately.

  • Annual electronic application for foreign manpower need submitted to the Migration quotas automated information system.
  • Placement of vacancy in the administration of Civil service of the employment of population.
  • Permission to involve the foreign labor force in the Migration police.
  • Work permit for foreigner (Plastic Card) in the Migration police.
  • Accreditation at the local department of the Migration police.
  • Work visa Invitation for foreigner.
  • Receiving a single-entry work visa for 90 days at the Russian Consulate.
  • Visa registration with the local department of the Migration police.
  • Notification of the beginning of work of a foreigner submitted to the Migration Police.
  • Re-issue of a single-entry work visa into a multiple-entry visa with the extension of its validity period.

Detailed description of stages for the Company registered in Moscow and hiring foreign citizen to work in Moscow:

  • Every year a Company is obliged to submit the application for foreign manpower need for the next year, so that the needs of the concrete company would be taken into account while the formation of quotas for the Russian Federation subjects and of all-Russian quota. Application includes a compulsory registration with the quick information center “Migration quota” at www.migrakvota.gov.ru . This rule does not apply to non-quota positions which list is renewed every year.

Required documents:

  • Application form (PDF file, 48 KB) about the assignment to the employer of the state service of assistance in the selection of the required workers (1 copy);
  • Information about the need of workers (PDF file, 50 KB), the presence of the unfilled vacancies (2 copies);
  • Certificate from the Russian Federal Tax Service of “State registration of legal entities” and the introduction of record into the United state list of legal entities (1 notarized copy);
  • Certificate from the Russian Federal Tax Service of “Registration of the legal entity with the Tax Authorities” (1 notarized copy);
  • Codes of statistics (1 notarized copy);
  • License to carry out activities (if needed) (1 notarized copy);
  • Power of attorney (PDF file, 52 KB) to the authorized representative to submit and obtain statements of the Administration of civil service of the employment of population (UGSZN) of Moscow (1 copy).
  • Conclusion of the Administration of civil service of the employment of population (UGSZN) of Moscow (copy with the assignment of the original);
  • Request to the Administration of civil service of the employment of population (UGSZN) (PDF file, 73 KB) (2 copies);
  • Application (PDF file, 44 KB) to the Migration police of Russia (3 copies);
  • Application form of the organization (PDF file, 37 KB) (1 copy);
  • Application (PDF file, 42 KB) to the Russian Migration police of Moscow (2 copies);
  • Project of a labour contract or other documents confirming the preliminary agreement with foreign citizens or foreign partners about intention and conditions of employment of foreign workers (1 copy, signed and stamped by the employer);
  • Certificate from the Russian Federal Tax Service of “The introduction of a record into the United state list of legal entities on the state registration of changes into the constitutive documents of a legal entity” (if changes were occurred) (2 notarized copies);
  • Certificate from the Russian Federal Tax Service of “The introduction of a record into the United state list of legal entities on the state registration of changes which are not connected with constitutive documents of legal entity” (if changes were occurred) (2 notarized copies);
  • Original of a billing document (stamped by bank) proving the payment of the state fee of 10000 ₽ for giving the company a “Permit to involve foreign labour force” for each foreign worker (properties).
  • Copy of a “Permit to involve foreign labour force” (with the presentation of the original);
  • Application (file PDF, 42 KB) to the Russian Migration police of Moscow (2 copies);
  • Warrant to the authorized representative (file PDF, 52 KB) for the right to supply and obtain a work permit (plastic card) (2 copies);
  • Application (file PDF, 102 KB) about issuing to foreign citizen or person without citizenship of work permit (1 copy);
  • Letter of guarantee (file PDF, 55 KB) for the return of foreign worker (1 copy);
  • Examination certificate for knowledge of Russian language;
  • Form A30 – about absence of disease of Hansen (leprosy);
  • Form A15-A19 – about absence of tuberculosis;
  • Form A50-A53.9, A55, A57 – about absence of sexually transmitted infections (syphilis, lymphogranuloma (venereal), chancre);
  • Form 086 – for the workers connected with physical labor;
  • about absence of addiction;
  • Notarized translation of passport of foreign citizen (1 copy);
  • Colored photo of foreign citizen on the mat paper – 2 pieces;
  • Copy of document with apostille about the vocational education with the translation into Russian (1 notarized copy); or a certificate of equivalency of such document to the Russian school certificate or diploma of professional education;
  • Original of billing document (stamped by bank) about the payment of the state duty of 3500 ₽ for obtaining a “work permit for a foreign citizen or a person without citizenship” (properties).

  • Extract from the “United state list of legal entities” (remoteness of an extract should not exceed one month; 1 notarized copy);
  • If the head (Director-General) is not Russian citizen, copies of Permit to involve foreign labour force and Work permit for foreign citizen (both notarized copies) are also required;
  • Non-residential Lease Agreement (in case of sublease, copies of sublease agreement and non-residential lease agreement should be presented; 1 notarized copy);
  • Certificate of “State registration of the property rights” of the non-residential premises (at owner of premises) occupied by organization (1 notarized copy);
  • Letter of guarantee (file PDF, 41 КB).
  • Organization Registration card in the Russian Migration police of Moscow;
  • Application letter for invitation (file PDF, 116 KB) for Russian visa (1 copy);
  • Letter of guarantee (file PDF, 45 KB) from organization (1 copy);
  • Copy of “permit to employ foreign workers” (Permission) (1 copy);
  • Copy of both sides of “Work permit of foreign citizen” (Plastic card) with the presentation of original;
  • Copy of the page of passport of foreign citizen, which contains photo and specifications (1 copy);
  • Copy of labor contract;
  • Receipt for state fee payment.
  • Application of foreign citizen to the Russian consulate with purpose of obtaining single work visa for 90 days.
  • Notification of the beginning of work of the foreign national in the organization. After obtaining a work permit and a work visa, signing a labor contract with a foreign worker (or extending the existing labor contract for the new period), the Company- employer is obligated to send the notification of conclusion of the employment agreement with a foreign worker to the Migration police of Moscow in 3 days. Similar notification should be sent in case of cancellation of an employment agreement with a foreign worker.
  • Registration of the work visa with the local department of the Migration police.
  • Notification of arrival (Visa registration) (file XLSX, 130 KB) of foreign citizen to the place of stay (1 copy);
  • Letter of guarantee (file PDF, 52 KB) from the inviting organization with the request to obtain a multiple entree work visa for foreign citizen (1 copy);
  • Application with request to obtain a multiple entree work visa (file PDF, 55 KB) from a foreign citizen (1 copy);
  • Passport copies of foreign citizen with the visa and migratory card, with the presentation of originals;
  • Two photos (colored, mat paper, size of 3×4);
  • Copy of “permit to employ foreign workers” (permission), with presentation of original;
  • Copy of “work permit of foreign citizen” (Plastic card), with presentation of original.
