“We employed a case study of 60 liver transplant patients around the US aged 20-50 years to assess how waiting list volume affects the outcomes of liver transplantation in patients; results indicate a positive correlation between increased waiting list volume and negative prognosis after the transplant procedure.”

The sentence above is clearly much too long for a research paper title. This is why you will trim and polish your title in the next two steps.

Step 4: Create a working research paper title

To create a working title, remove elements that make it a complete “sentence” but keep everything that is important to what the study is about. Delete all unnecessary and redundant words that are not central to the study or that researchers would most likely not use in a database search.

“ We employed a case study of 60 liver transplant patients around the US aged 20-50 years to assess how the waiting list volume affects the outcome of liver transplantation in patients ; results indicate a positive correlation between increased waiting list volume and a negative prognosis after transplant procedure ”

Now shift some words around for proper syntax and rephrase it a bit to shorten the length and make it leaner and more natural. What you are left with is:

“A case study of 60 liver transplant patients around the US aged 20-50 years assessing the impact of waiting list volume on outcome of transplantation and showing a positive correlation between increased waiting list volume and a negative prognosis” (Word Count: 38)

This text is getting closer to what we want in a research title, which is just the most important information. But note that the word count for this working title is still 38 words, whereas the average length of published journal article titles is 16 words or fewer. Therefore, we should eliminate some words and phrases that are not essential to this title.

Step 5: Remove any nonessential words and phrases from your title

Because the number of patients studied and the exact outcome are not the most essential parts of this paper, remove these elements first:

 “A case study of 60 liver transplant patients around the US aged 20-50 years assessing the impact of waiting list volume on outcomes of transplantation and showing a positive correlation between increased waiting list volume and a negative prognosis” (Word Count: 19)

In addition, the methods used in a study are not usually the most searched-for keywords in databases and represent additional details that you may want to remove to make your title leaner. So what is left is:

“Assessing the impact of waiting list volume on outcome and prognosis in liver transplantation patients” (Word Count: 15)

In this final version of the title, one can immediately recognize the subject and what objectives the study aims to achieve. Note that the most important terms appear at the beginning and end of the title: “Assessing,” which is the main action of the study, is placed at the beginning; and “liver transplantation patients,” the specific subject of the study, is placed at the end.

This will aid significantly in your research paper title being found in search engines and database queries, which means that a lot more researchers will be able to locate your article once it is published. In fact, a 2014 review of more than 150,000 papers submitted to the UK’s Research Excellence Framework (REF) database found the style of a paper’s title impacted the number of citations it would typically receive. In most disciplines, articles with shorter, more concise titles yielded more citations.

Adding a Research Paper Subtitle

If your title might require a subtitle to provide more immediate details about your methodology or sample, you can do this by adding this information after a colon:

“ : a case study of US adult patients ages 20-25”

If we abide strictly by our word count rule this may not be necessary or recommended. But every journal has its own standard formatting and style guidelines for research paper titles, so it is a good idea to be aware of the specific journal author instructions , not just when you write the manuscript but also to decide how to create a good title for it.

Research Paper Title Examples

The title examples in the following table illustrate how a title can be interesting but incomplete, complete by uninteresting, complete and interesting but too informal in tone, or some other combination of these. A good research paper title should meet all the requirements in the four columns below.

Tips on Formulating a Good Research Paper Title

In addition to the steps given above, there are a few other important things you want to keep in mind when it comes to how to write a research paper title, regarding formatting, word count, and content:

  • Write the title after you’ve written your paper and abstract
  • Include all of the essential terms in your paper
  • Keep it short and to the point (~16 words or fewer)
  • Avoid unnecessary jargon and abbreviations
  • Use keywords that capture the content of your paper
  • Never include a period at the end—your title is NOT a sentence

The title summarizes the main idea or ideas of your study. A good title contains the fewest possible words needed to adequately describe the content and/or purpose of your research paper.

Importance of Choosing a Good Title

The title is the part of a paper that is read the most, and it is usually read first . It is, therefore, the most important element that defines the research study. With this in mind, avoid the following when creating a title:

  • If the title is too long, this usually indicates there are too many unnecessary words. Avoid language, such as, "A Study to Investigate the...," or "An Examination of the...." These phrases are obvious and generally superfluous unless they are necessary to covey the scope, intent, or type of a study.
  • On the other hand, a title which is too short often uses words which are too broad and, thus, does not tell the reader what is being studied. For example, a paper with the title, "African Politics" is so non-specific the title could be the title of a book and so ambiguous that it could refer to anything associated with politics in Africa. A good title should provide information about the focus and/or scope of your research study.
  • In academic writing, catchy phrases or non-specific language may be used, but only if it's within the context of the study [e.g., "Fair and Impartial Jury--Catch as Catch Can"]. However, in most cases, you should avoid including words or phrases that do not help the reader understand the purpose of your paper.
  • Academic writing is a serious and deliberate endeavor. Avoid using humorous or clever journalistic styles of phrasing when creating the title to your paper. Journalistic headlines often use emotional adjectives [e.g., incredible, amazing, effortless] to highlight a problem experienced by the reader or use "trigger words" or interrogative words like how, what, when, or why to persuade people to read the article or click on a link. These approaches are viewed as counter-productive in academic writing. A reader does not need clever or humorous titles to catch their attention because the act of reading research is assumed to be deliberate based on a desire to learn and improve understanding of the problem. In addition, a humorous title can merely detract from the seriousness and authority of your research. 
  • Unlike everywhere else in a college-level social sciences research paper [except when using direct quotes in the text], titles do not have to adhere to rigid grammatical or stylistic standards. For example, it could be appropriate to begin a title with a coordinating conjunction [i.e., and, but, or, nor, for, so, yet] if it makes sense to do so and does not detract from the purpose of the study [e.g., "Yet Another Look at Mutual Fund Tournaments"] or beginning the title with an inflected form of a verb such as those ending in -ing [e.g., "Assessing the Political Landscape: Structure, Cognition, and Power in Organizations"].

Structure and Writing Style

The following parameters can be used to help you formulate a suitable research paper title:

  • The purpose of the research
  • The scope of the research
  • The narrative tone of the paper [typically defined by the type of the research]
  • The methods used to study the problem

The initial aim of a title is to capture the reader’s attention and to highlight the research problem under investigation.

Create a Working Title Typically, the final title you submit to your professor is created after the research is complete so that the title accurately captures what has been done . The working title should be developed early in the research process because it can help anchor the focus of the study in much the same way the research problem does. Referring back to the working title can help you reorient yourself back to the main purpose of the study if you find yourself drifting off on a tangent while writing. The Final Title Effective titles in research papers have several characteristics that reflect general principles of academic writing.

  • Indicate accurately the subject and scope of the study,
  • Rarely use abbreviations or acronyms unless they are commonly known,
  • Use words that create a positive impression and stimulate reader interest,
  • Use current nomenclature from the field of study,
  • Identify key variables, both dependent and independent,
  • Reveal how the paper will be organized,
  • Suggest a relationship between variables which supports the major hypothesis,
  • Is limited to 5 to 15 substantive words,
  • Does not include redundant phrasing, such as, "A Study of," "An Analysis of" or similar constructions,
  • Takes the form of a question or declarative statement,
  • If you use a quote as part of the title, the source of the quote is cited [usually using an asterisk and footnote],
  • Use correct grammar and capitalization with all first words and last words capitalized, including the first word of a subtitle. All nouns, pronouns, verbs, adjectives, and adverbs that appear between the first and last words of the title are also capitalized, and
  • Rarely uses an exclamation mark at the end of the title.

The Subtitle Subtitles are frequently used in social sciences research papers because it helps the reader understand the scope of the study in relation to how it was designed to address the research problem. Think about what type of subtitle listed below reflects the overall approach to your study and whether you believe a subtitle is needed to emphasize the investigative parameters of your research.

1.  Explains or provides additional context , e.g., "Linguistic Ethnography and the Study of Welfare Institutions as a Flow of Social Practices: The Case of Residential Child Care Institutions as Paradoxical Institutions." [Palomares, Manuel and David Poveda.  Text & Talk: An Interdisciplinary Journal of Language, Discourse and Communication Studies 30 (January 2010): 193-212]

2.  Adds substance to a literary, provocative, or imaginative title or quote , e.g., "Listen to What I Say, Not How I Vote": Congressional Support for the President in Washington and at Home." [Grose, Christian R. and Keesha M. Middlemass. Social Science Quarterly 91 (March 2010): 143-167]

3.  Qualifies the geographic scope of the research , e.g., "The Geopolitics of the Eastern Border of the European Union: The Case of Romania-Moldova-Ukraine." [Marcu, Silvia. Geopolitics 14 (August 2009): 409-432]

4.  Qualifies the temporal scope of the research , e.g., "A Comparison of the Progressive Era and the Depression Years: Societal Influences on Predictions of the Future of the Library, 1895-1940." [Grossman, Hal B. Libraries & the Cultural Record 46 (2011): 102-128]

5.  Focuses on investigating the ideas, theories, or work of a particular individual , e.g., "A Deliberative Conception of Politics: How Francesco Saverio Merlino Related Anarchy and Democracy." [La Torre, Massimo. Sociologia del Diritto 28 (January 2001): 75 - 98]

6.  Identifies the methodology used , e.g. "Student Activism of the 1960s Revisited: A Multivariate Analysis Research Note." [Aron, William S. Social Forces 52 (March 1974): 408-414]

7.  Defines the overarching technique for analyzing the research problem , e.g., "Explaining Territorial Change in Federal Democracies: A Comparative Historical Institutionalist Approach." [ Tillin, Louise. Political Studies 63 (August 2015): 626-641.

With these examples in mind, think about what type of subtitle reflects the overall approach to your study. This will help the reader understand the scope of the study in relation to how it was designed to address the research problem.

6 Important Tips on Writing a Research Paper Title

When you are searching for a research study on a particular topic, you probably notice that articles with interesting, descriptive research titles draw you in. By contrast, research paper titles that are not descriptive are usually passed over, even though you may write a good research paper with interesting contents. This shows the importance of coming up with a good title for your research paper when drafting your own manuscript.

The research title plays a crucial role in the research process, and its importance can be summarized as follows:

Why do Research Titles Matter?

Before we look at how to title a research paper, let’s look at a research title example that illustrates why a good research paper should have a strong title.

Imagine that you are researching meditation and nursing, and you want to find out if any studies have shown that meditation makes nurses better communicators.  You conduct a keyword search using the keywords “nursing”, “communication”, and “meditation.” You come up with results that have the following titles:

  • Benefits of Meditation for the Nursing Profession: A Quantitative Investigation
  • Why Mindful Nurses Make the Best Communicators
  • Meditation Gurus
  • Nurses on the Move: A Quantitative Report on How Meditation Can Improve Nurse Performance

All four of these research paper titles may describe very similar studies—they could even be titles for the same study! As you can see, they give very different impressions.

  • Title 1 describes the topic and the method of the study but is not particularly catchy.
  • Title 2 partly describes the topic, but does not give any information about the method of the study—it could simply be a theoretical or opinion piece.
  • Title 3 is somewhat catchier but gives almost no information at all about the article.
  • Title 4 begins with a catchy main title and is followed by a subtitle that gives information about the content and method of the study.

As we will see, Title 4 has all the characteristics of a good research title.

Characteristics of a Good Research Title

According to rhetoric scholars Hairston and Keene, making a good title for a paper involves ensuring that the title of the research accomplishes four goals as mentioned below:

  • It should predict the content of the research paper .
  • It should be interesting to the reader .
  • It should reflect the tone of the writing .
  • It should contain important keywords that will make it easier to be located during a keyword search.

Let’s return to the examples in the previous section to see how to make a research title.

As you can see in the table above, only one of the four example titles fulfills all of the criteria of a suitable research paper title.

Tips for Writing an Effective Research Paper Title

When writing a research title, you can use the four criteria listed above as a guide. Here are a few other tips you can use to make sure your title will be part of the recipe for an effective research paper :

  • Make sure your research title describes (a) the topic, (b) the method, (c) the sample, and (d) the results of your study. You can use the following formula:
[ Result ]: A [ method ] study of [ topic ] among [ sample ] Example : Meditation makes nurses perform better: a qualitative study of mindfulness meditation among German nursing students
  • Avoid unnecessary words and jargons. Keep the title statement as concise as possible. You want a title that will be comprehensible even to people who are not experts in your field. Check our article for a detailed list of things to avoid when writing an effective research title .
  • Make sure your title is between 5 and 15 words in length.
  • If you are writing a title for a university assignment or for a particular academic journal, verify that your title conforms to the standards and requirements for that outlet. For example, many journals require that titles fall under a character limit, including spaces. Many universities require that titles take a very specific form, limiting your creativity.
  • Use a descriptive phrase to convey the purpose of your research efficiently.
  • Most importantly, use critical keywords in the title to increase the discoverability of your article.

The introductory paragraph in a research paper should give an overview of what the reader can expect from the rest of the paper.

It should also establish a context for readers who are new to this topic. More importantly, when writing a research paper introduction, it’s best to focus on two key points: the problem being addressed and how this particular study (or studies) addresses it.

If those two points are clear then readers should be able to follow along as they read more into your paper.

In the following sections, we’ll provide you with examples of different types of research paper introductions to help you get started.

Types of Research Paper Introductions

General introductions.

A general introduction is suitable when you’re discussing a range of different topics or subjects within one paper. It provides the reader with an idea of where you stand in regard to the topic at hand and can be followed up with a sentence or two explaining your specific angle.

Topic: The Effect of Social Media on Mental Health

Social media has become an integral part of our daily lives, and its impact on mental health has become a subject of increasing concern in recent years. While social media platforms have provided a new means of communication and access to information, they have also been linked to negative mental health outcomes such as depression, anxiety, and low self-esteem. This research paper aims to explore the relationship between social media use and mental health outcomes. Specifically, we will investigate how social media affects individuals’ perceptions of themselves and their social relationships, as well as the potential impact on their emotional well-being. With that said, remember that every quote you include needs to add something significant and/or novel which hasn’t been covered before – otherwise it won’t be worth including in your paper!

In this case, it’s critical that you provide the necessary background information and then follow up with a statement about why the rest of the research is interesting and/or relevant.

For example, you might say that the paper discusses a recent study on mindfulness and meditation.

In order to fully grasp the research and the claims being made, it’s necessary to first understand what mindfulness is and why it’s relevant. The following paragraphs would therefore serve as an introduction to both topics.

Topic: Mindfulness

Mindfulness is a mental state achieved by focusing one’s awareness on the present moment, while calmly acknowledging and accepting one’s feelings, thoughts, and bodily sensations. Title, Abstract and Keywords

The importance of titles.

The title of your manuscript is usually the first introduction readers (and reviewers) have to your work. Therefore, you must select a title that grabs attention, accurately describes the contents of your manuscript, and makes people want to read further.

An effective title should:

  • Convey the  main topics  of the study
  • Highlight the  importance  of the research
  • Be  concise
  • Attract  readers

Writing a good title for your manuscript can be challenging. First, list the topics covered by the manuscript. Try to put all of the topics together in the title using as few words as possible. A title that is too long will seem clumsy, annoy readers, and probably not meet journal requirements.

Does Vaccinating Children and Adolescents with Inactivated Influenza Virus Inhibit the Spread of Influenza in Unimmunized Residents of Rural Communities?

This title has too many unnecessary words.

Influenza Vaccination of Children: A Randomized Trial

This title doesn’t give enough information about what makes the manuscript interesting.

Effect of Child Influenza Vaccination on Infection Rates in Rural Communities: A Randomized Trial This is an effective title. It is short, easy to understand, and conveys the important aspects of the research.

Think about why your research will be of interest to other scientists. This should be related to the reason you decided to study the topic. If your title makes this clear, it will likely attract more readers to your manuscript. TIP: Write down a few possible titles, and then select the best to refine further. Ask your colleagues their opinion. Spending the time needed to do this will result in a better title.

Abstract and Keywords

The Abstract is:

  • A  summary  of the content of the journal manuscript
  • A time-saving  shortcut  for busy researchers
  • A guide to the most important parts of your manuscript’s written content

Many readers will only read the Abstract of your manuscript. Therefore, it has to be able to  stand alone . In most cases the abstract is the only part of your article that appears in indexing databases such as Web of Science or PubMed and so will be the most accessed part of your article; making a good impression will encourage researchers to read your full paper.

A well written abstract can also help speed up the peer-review process. During peer review, referees are usually only sent the abstract when invited to review the paper. Therefore, the abstract needs to contain enough information about the paper to allow referees to make a judgement as to whether they have enough expertise to review the paper and be engaging enough for them to want to review it.

Your Abstract should answer these questions about your manuscript:

  • What was done?
  • Why did you do it?
  • What did you find?
  • Why are these findings useful and important?

Answering these questions lets readers know the most important points about your study, and helps them decide whether they want to read the rest of the paper. Make sure you follow the proper journal manuscript formatting guidelines when preparing your abstract.

TIP: Journals often set a maximum word count for Abstracts, often 250 words, and no citations. This is to ensure that the full Abstract appears in indexing services.

Keywords  are a tool to help indexers and search engines find relevant papers. If database search engines can find your journal manuscript, readers will be able to find it too. This will increase the number of people reading your manuscript, and likely lead to more citations.

However, to be effective, Keywords must be chosen carefully. They should:

  • Represent  the content of your manuscript
  • Be  specific  to your field or sub-field

Poor keywords:  molecule, optics, lasers, energy lifetime

Better keywords:  single-molecule interaction, Kerr effect, carbon nanotubes, energy level structure

Titles, Introductions, and Conclusions

Titles should be specific and clear, and the quickest path to this is composing a title that states your exact subject. If you can also hint at your thesis in the title, it becomes that much more effective. Examples:

  • The Extinction of Bees
  • Peer Review in Writing Classes
  • Why We Need Fantasy Literature
  • Video Games and Art
  • Video Games Can Never Be Art

In academic writing, it is also common to have a two-part title that consists of (1) a vivid or curious glimpse of some aspect of the subject and (2) a straightforward statement of the subject. This is generally used for longer essays, such as those comprising more than 2,000 words.  Examples:

  • Hashtag I’m Fired: Employment in the Era of Social Media
  • Sanity in the Eye of the Beholder: The Dynamics of the Unreliable Narrator in “The Tell-Tale Heart”

Remember that titles are an opportunity to control interpretation of your essay. Consider how the titles of films do this: What is the film Forrest Gump about? Most would agree it’s about the life of Forrest Gump. But what would the common answers be if the title had been Me and Jenny ? It would probably be called a love story, which it kind of is given that title. Or what if it had been titled Me and Lieutenant Dan ? Then it would probably be a buddy picture about friendship, which it would be given that title. Use this quality of titles to guide your readers’ interpretations.

Introductions

Audiences want a clear idea of what they’re about to get into, what to expect, and what is so interesting about it, so use the introduction to give all of this to them. Brief introductions are typically the best, which means the first paragraph will often be the shortest in the essay.

The most common strategy in an introduction is to move from the general context to a specific point. This often feels natural for writers and readers, so much so that we even see this kind of strategy in movies and shows: visuals of the whole city first, then of the one building, then of the specific room with the focal characters. In an essay, this works by first stating general facts or ideas about the subject. Then, as you move deeper into your introduction, you gradually narrow the focus, moving closer to your thesis. Moving smoothly and logically from your introductory remarks to your thesis statement can be visualized as a funnel-like structure, as illustrated in the diagram below:

Watch closely for the excellent use of this strategy in this example:

J. R. R. Tolkien’s  The Lord of the Rings  has sold around 150 million copies worldwide, which makes it one of the bestselling fiction novels of all time. Some even claim it is the greatest book of the twentieth century. While Tolkien’s Middle-earth novels continue to grow in popularity, many scholars still refuse to take them seriously. Most critics not only disregard, but despise them with a fiery passion. Critics of the younger generation focus on the supposed social problems in Middle-earth, such as racism or sexism. But the most astounding criticisms come mostly from the older generation of literary critics, who claim that Tolkien’s writing is just awful. Edmund Wilson argues in “Oo, Those Awful Orcs” that  The Lord of the Rings  is nothing but “juvenile trash.” In the introduction to  Bloom’s Critical Modern Interpretations: J. R. R. Tolkien’s The Lord of the Rings,  Harold Bloom claims that Tolkien’s writing style is “stiff, false archaic, and overwrought.” Bloom is “not able to understand how a skilled and mature reader can absorb about fifteen hundred pages of this quaint stuff.” These criticisms are as absurd are they are comical. If anything,  The Lord of the Rings  is anti-racist and anti-sexist and beautifully written. Of course, the merit of any work is, in essence, subjective and tastes differ. But what is the cause of both the contemptuous criticisms and unwarranted indifference toward  The Lord of the Rings ?

Notice that the first sentence isn’t about Stengel’s point directly but is instead a way to generally contextualize what she is about to say. Then each sentence gets more and more specific until we are left with an exact notion of what her position is and what she plans to explore about it.

Another strategy is to add something of specific and immediate interest right before this general context. This is done by employing the Classical advice of beginning i n medias res , which means to start in the middle of things. Immediately offer a glimpse at a specific idea, example, or scenario that delves deep into a fascinating aspect of your subject, even if the meaning of it is not yet clear. In choosing this glimpse, consider that which is surprising, counter-intuitive, or vivid. This is often called “the attention grabber,” but that phrase is often misunderstood, for multitudes of student writers have written statements and questions that they find extremely boring yet have told themselves they are doing so for the benefit of readers in order to “grab their attention.” The problem stems from assuming that readers are boring. They aren’t; they’re interesting, and they want to read interesting ideas. So bring up the ideas that are actually interesting. Don’t use false questions, such as those about the reader’s personal experience, those that have obvious answers, and those for which you won’t attempt specific or compelling answers.

Bad Example:

This brings up a point that demands more explanation, which means it demands the continued interest of the audience. Most audiences would like to hear what is not in the Bible that they had thought was in there. And the follow-up sentence offers some clear expectations of points to come.

After that beginning (whether or not you added the glimpse of beginning in medias res  before your general context), s tate the main claim of your entire essay in a single sentence, which is also called your thesis . Your claim should take a position or make a point about the subject, often by confirming or denying a proposition. Remember not to use a question or a fragment as a thesis, for those do not state points. Also make sure to state your exact position on the subject, which is what a claim or thesis is, rather than simply stating the subject. See the section Thesis for more information.

After you have made your claim or thesis clear, offer an essay map . This is the strategy of briefly naming the main points of the paragraphs to come, stating them in the same order that they will use in the body of the essay. Avoid referencing your own essay or your own assignment, as with phrases such as, “in this essay,” or, “for my assignment,” or, “I will discuss.” Instead, state your main points by discussing the subject itself rather than by discussing yourself writing it or the essay that contains it. Remember not to get detailed here either; save the details for the body paragraphs.

Conclusions

Conclusions can be just as vital as any other part of an essay, and often the most vital part, so avoid the natural temptations to short-cut at the end. Two common short-cuts to avoid are mere stopping, and merely repeating. The conclusion that simply stops discussing the ideas at some point has failed to conclude them, as has the conclusion that simply re-states what has already been said in the essay.

The best way to conclude is through emphasis : find a new way to encapsulate the most important ideas that have been conveyed in the essay. This does not mean introducing new ideas, which would add confusion, but instead to help readers see what is most important in all that has been discussed, or what is the most important way to understand it all.

One good strategy for this is to use a brief and poignant phrase or quotation. Another good strategy is to use a metaphor: description of an interesting image that stands for an important idea.

As you work through your conclusion, note that this is the best place for humility . Be honest in admitting short-comings in your ideas, explanations, or comprehensiveness. This approach in an introduction can leave the impression of an unsure or unfocused writer, but after a succession of clear ideas throughout an essay, humility in the conclusion shows a writer who is honest and thoughtful. This is not to be confused with contradiction, false humility, self-deprecation, or un-rebutted opposition. Instead, the humility of honesty is the aim here.

Finally, try using the tone of elevation: hint at higher, nobler possibilities relating to your subject. Some of the greatest writers and speakers in history have used this strategy in their conclusions, as can be seen in many of the readings in this textbook and beyond. Common errors in conclusions include the following:

  • Ending on a minor point or detail
  • Introducing new material
  • Contradicting your thesis
  • Changing your thesis
  • Issuing commands, getting aggressive, or sounding exclamatory

Ending on a minor point or detail drives the entire essay off-topic because it suggests something other than the main idea as the most important. Move minor points and details to the appropriate body paragraph.

Introducing new material in your conclusion has an unsettling effect on your reader. When you raise new points, you make your reader want more information, which you could not possibly provide in the limited space of your final paragraph.

Contradicting or changing your thesis statement causes your readers to think that you do not actually have a conviction about your subject. After all, you have spent several paragraphs adhering to a singular point of view. When you change sides or open up your point of view in the conclusion, your reader becomes less inclined to believe your original argument.

Issuing commands, getting aggressive, or sounding exclamatory works against the aims and expectations of academic argument, for it shows the writer’s failure to trust the points and support the essay has offered, as well as the failure to trust in the capability of the audience to use their own minds appropriately.

Researching the Federal Securities Laws Through the SEC Website

Introduction.

This guide provides an overview of how to research the securities law through the SEC website and is provided as a service to investors and members of the public. It is neither a legal interpretation nor a statement of SEC policy. If you have questions concerning the meaning or application of a particular law or rule you should consult with an attorney who specializes in securities law. This guide does not address primary and secondary sources available in print or through other websites, other than those to which the SEC website links. The guide is organized by providing suggestions for the research of:

  • Statutes (the Securities Laws)
  • SEC Rules and Regulations;

SEC Concept Releases

Sec interpretive releases, sec staff interpretations.

In general, you should conduct your research on the federal securities laws in the order prescribed above. This is because while the federal statutes and the SEC rules and regulations have the force of law, other SEC-issued documents vary in the degree to which they carry the force of law. SEC Staff documents have no legal force or effect: they do not alter or amend applicable law, and they create no new or additional obligations for any person.

Major pieces of legislation, such as the Securities Act of 1933, the Securities Exchange Act of 1934, and the Investment Company Act of 1940, provide the framework for the SEC's oversight of the securities markets. These statutes are broadly drafted, establishing basic principles and objectives. The laws that govern the securities industry include:

  • Investment Company Act of 1940
  • Investment Advisers Act of 1940
  • Securities Investor Protection Act of 1970

TIP: The SEC website links to the text of the federal securities laws provided by the House Committee on Financial Services. The texts include references to the  United States Code  (U.S.C). U.S.C. citations are the official citations for federal laws. You can find the securities laws in Title 15 of the U.S.C. For example, the Securities Act of 1933 is 15 U.S.C. § 77a et seq.; the Securities Act of 1934 is 15 U.S.C. § 78a et seq.; the Investment Company Act of 1940 is 15 U.S.C. § 80-1 et seq.; and the Investment Adviser Act is 15 U.S.C. §80b-1 et seq.

Legislative History

Legislative history is the official record of the passage of a statute. It is useful if you are looking for Congressional intent at the time Congress passed a particular statute. Although our website does not link to the legislative history of the securities laws, we provide a link to the Library of Congress’  Congress.gov online database. Congress.gov is the official website for U.S. federal legislative information. The site provides access to accurate, timely, and complete legislative information for Members of Congress, legislative agencies, and the public. 

SEC Rules and Rulemaking

Rulemaking  is the process by which federal agencies implement legislation passed by Congress and signed into law by the President. The SEC engages in rulemaking to maintain fair and orderly markets and to protect investors by altering regulations or creating new ones. There are both official and unofficial sources of SEC rules and regulations.

NOTE: If you are researching administrative regulations, including SEC rules, you always should check whether they are current. You also should check the coverage and status of all sources.

The Federal Register is the official daily publication where the SEC and other federal agencies first publish proposed regulations for comment, adopted final regulations, explanations of actions taken, and announcements of significant interpretations of the law. Tip:  Individuals often refer to SEC rules and regulations by the number only, without reference to the entire CFR citation. However, you need the full CFR citation to find a specific rule. For example if you are looking for Rule 10b-5 of the Securities Exchange Act of 1934, the citation is 17 CFR 240.10b-5. An idiosyncrasy of the federal securities laws is that the term “regulation” often refers to a collection of rules for example, Regulation S-K and  Regulation SHO .

The  SEC's website  provides access to regulations codified in the CFR. In addition, the SEC’s website includes selected rules and regulations on the  Forms  web page.

CFR Titles are updated annually. Therefore if you are researching recent rulemaking, you should check GPO’s website for the monthly “ List of CFR Sections Affected .” (LSA). As noted on GPO’s web page, the LSA “lists proposed, new, and amended Federal regulations that have been published in the Federal Register since the most recent revision date of a CFR title. Each LSA issue is cumulative and contains the CFR part and section numbers, a description of its status (e.g., amended, confirmed, revised), and the Federal Register page number where the change(s) may be found.”

The CFR references the Federal Register citation for the original adopting release as well as any releases amending the rule or regulation.

Unofficial Sources

The “ Regulatory Actions ” section of our website is an unofficial source of both Final and Proposed Rulemaking Releases. You should note that the date of the releases reported on our website is the date of the Commission’s approval and not the publication date in the Federal Register. 

The “ Rulemaking Index ” section of our website lists rulemaking activity since 2008 grouped by file number, which allows you to view the proposed rules, final rules and other actions related to a particular rulemaking. You can sort this list by most recent action, file number, or the informal short name of the rulemaking. By using the "Status" filter, you can view rulemakings that have been completed, or rulemakings that have been proposed but not yet completed. You can also filter to display rulemakings related to a specific SEC division or office. This index omits certain technical rulemakings, including updates to the EDGAR filing manual.

Tip:  Rulemaking releases, unlike the text of the rules found in the CFR, provide in-depth background information about the origin of specific rules. The releases include, for example, the Commission’s basis for proposing or adopting the rule, changes from earlier proposed rules, and a summary of public comments.

  • Final Rules.   Final rules releases  dating back to September 1994 are available on our website as are  selected rulemaking releases  for the period from 1962 to 1994. The Details section for a particular release will include links to the proposed rule(s), comments, and also identify the effective date and the compliance date (where appropriate). The “Final Rules” section also will include amendments or corrections to the rule as well as notices of extensions or compliance dates.
  • Proposed Rules.  The “ Proposed Rules ” web page includes links to the releases of proposed rules and links to public comments about the rules. We also post the Federal Register version of the release. You can find the proposed rules by looking for either the release number (in some cases the first of several release numbers for the specific rule) or by date. The web page does not organize the proposed rules by subject matter or by file number. The website includes proposed rules going back to 1994.

What Is an Effective Date?

The effective date is the date on which a rule or regulation begins to apply and becomes enforceable.

What Is a Compliance Date?

The compliance date is the date on which the entities covered by the rule must comply with the rule.

What Do the Prefixes to the Release Numbers Mean?

The prefixes included in the release numbers identify the Act pursuant to which the rule was promulgated. Common prefixes are:

33-: Securities Act of 1933 34-: Securities Exchange Act of 1934 39-: Trust Indenture Act of 1939 IA-: Investment Advisers Act of 1940 IC-: Investment Company Act of 1940 FR-: Financial Releases (should not be confused with citations to the Federal Register)

If you are researching a rule by release number, you can use the search engine at the top of our home page. This will help you to locate a release in the event that this is not the release number identified on the rulemaking pages.

What Is the Difference Between an SR- and an S7- File?

S7- files are the file numbers assigned to Commission rules. SR-files refer to rules of the self-regulatory organizations.

The Commission occasionally publishes  "concept" releases  to solicit the public's views on securities issues so that we can better evaluate the need for future rulemaking. The Regulatory Actions section of our website includes concept releases dating back to 1994.

The Commission occasionally provides guidance on topics of general interest to the business and investment communities by issuing  "interpretive" releases , in which we publish our views and interpret the federal securities laws and SEC regulations. Interpretive releases (like concept releases) are not enforceable laws and regulations but provide useful guidance as to the position of the Commission on various issues. The “ Interpretive Release ” web page includes interpretive releases from 1995 to the present. The Interpretive Release web page does not organize the releases by topic. However, the web page for the  Division of Corporation Finance  includes interpretive releases and other information, organized by subject category, dating back to 2002. The  Division of Trading and Markets’ and Division of Investment Management’s  web pages also include interpretive releases.

Tip:  The CFR includes indices of interpretive releases of the Commission, organized by the relevant Act. The CFR includes the Federal Register citation. For example, you can find citations for interpretive releases covering the Securities Exchange Act at  17 CFR, part 241 .

SEC Policy Statements

From time to time, the Commission issues a " policy statement " to clarify its position on a particular matter. The policy statements include interagency statements. You can find the policy statements on our “ Policy Statements ” web page.

The SEC staff provides informal guidance through various oral and written statements. Because they represent the views of the staff, these statements have no legal force or effect: they do not alter or amend applicable law, and they create no new or additional obligations for any person. You can find links to the available statements through the  Staff Interpretations  section of our website.

SEC Staff Legal and Accounting Bulletins

Staff Legal Bulletins  summarize SEC staff's views regarding various aspects of the federal securities laws and SEC regulations. They represent interpretations and policies followed by the Divisions of Corporation Finance, Trading and Markets, or Investment Management on any given matter.

Staff Accounting Bulletins  reflect SEC staff's views regarding accounting-related disclosure practices. They represent interpretations and policies followed by the Division of Corporation Finance and the Office of the Chief Accountant in administering the disclosure requirements of the federal securities laws. You also can find the  Codification of Staff Accounting Bulletins  on our website.

No-Action, Exemptive and Interpretive Letters

No-action, exemptive and interpretive letters  issued by the staff members of the Divisions of Corporation Finance, Trading and Markets, and Investment Management posted on our website date back to 2002. Staff Letters to Industry from the staff of the Office of the Chief Accountant are posted from 1998 to the present. No-action letters are inquiries sent by individuals or entities about a specified proposed conduct seeking the SEC staff’s views as to whether it would recommend an enforcement action in the event that the proposed conduct occurs.
