A  residential letter of intent to lease is a document used by lease applicants to express a formal interest in renting residential property. It’s drafted after the landlord and applicant negotiate rental terms, but before the parties enter into a definitive contract. By signing the letter, the applicant makes it clear that they are ready and willing to make a binding lease agreement with the landlord . The letter summarizes the basic rental conditions, including the lease duration, monthly rent, and security deposit amount.

  • Residential Rental Application – For screening prospective tenants prior to signing a lease.
  • Residential Lease Agreement – A comprehensive contract for renting property to one or more tenants.

Essential Elements of the LOI

There are certain items an LOI must always include to relay the applicant’s intentions while establishing the main terms of the lease agreement . The essential elements of an LOI are:

  • Date & Contact Information – The date on which the letter is written, along with the applicant and landlord’s name, address, and contact information.

In many of parts of Australia, there’s stiff competition for great rental properties. The cover letter that goes with the application is a way for prospective tenants to explain why they should get the rental above other applicants.

Essentially, a cover letter is a summary of all the key information and data provided in the application, showing why someone would be a good tenant – similar to the cover letter that accompanies an application for a job.

If an online portal like Ignite is used, there may not be a specific spot for a cover letter, but the advice for writing a good one applies equally to how tenants answer the all-important question: “Why is this property right for you?”.

What should a cover letter include?

Michelle Wilde , the principal of Queensland-based Stella Property, uses Ignite to handle applications, so doesn’t require cover letters. However, she said applications need to make it clear the would-be tenant can pay on time, are responsible and will look after the property. The biggest red flag for Ms Wilde is if a tenant has had an issue or dispute with a previous property manager.

How to Make Your Rental Application Stand Out

You’ve found an apartment that checks all the boxes—great location, ideal amenities, even the right price. Unfortunately, you’re not the only one that thinks it’s the perfect place to live. Other prospective tenants are considering the property, too. So, how do you make your rental application stand out?

Start taking steps as soon as you decide it’s time to move so you’ll be ready to present yourself on the application in the best possible light. Here’s a detailed breakdown of what to do to ensure you’re the one signing on the dotted line and hanging a “Home Sweet Home” sign on the wall.

Before you complete the application

One of the biggest mistakes you can make when it comes to your application is being unprepared. During the time you spend trying to gather necessary information and find good referrals, someone else can fill out an application and be approved. Or, in your haste, you might appear disorganized and make a bad impression. Don’t let that happen! Before you begin searching for that perfect rental , take these steps.

Gather your documents

When you apply, you’ll need to prove you are who you claim to be and you can afford to live in the rental property. That requires you to first provide a government-issued identification such as a driver’s license, state ID, passport or green card. Make sure the photograph is unquestionably you—if it you appear drastically different, find another form of identification—and the information on it doesn’t contradict the information you’ll be putting on your application.

You’ll also need current pay stubs, bank statements and last year’s filed tax return to prove you can pay your rent. If you are self-employed, the bank statements and tax return should suffice, but you may also want to be prepared with a statement from your current landlord stating you pay your rent on time.

To make things easier, scan these documents and have them available electronically. That way, you can easily forward them to the landlord or property manager when requested. Additionally, if you are going to have roommates, encourage them to follow your lead and prepare ahead of time, too.

Check your credit score

Someone, at some point in the process, will check your credit score. Be prepared. Pull your credit score for free at AnnualCreditReport.com , a site sponsored by credit reporting agencies Equifax, Experian and TransUnion. Scores range from 300 to 850. Anything above 700 is considered good credit while anything between 620 and 699 is average. Below 620 is considered bad credit.

Ideally, you want your credit score to be above 700, especially if you are competing against other people who want to rent the same property. However, you can raise a low score by paying off debt. (It will take a few months for your credit score to reflect your reduced debt, so if you have bad credit and can wait, consider postponing your move.)

Surprised by how low your credit score is? Review it carefully for inaccuracies, such as closed accounts being reported as open or the same debt being listed more than once. If you find an error, contact the credit reporting agency to dispute it. Similarly, review your personal information and report any discrepancies to the agency.  Different addresses than the ones provided on your rental application, for example, could be a red flag.

Secure a guarantor

You don’t have to give up on your dream property if you have a low credit score or no credit score at all. Find a guarantor or co-signer, someone who will pay your rent if you don’t and cover any damages you leave behind.

Since a co-signer will also have to show proof of identity and the ability to pay the rent if you can’t, he’ll need to get his documents and information ready ahead of time, too.

Write a cover letter

A cover letter can help you stand out among a sea of other applicants. Write a professional, error-free letter telling a little about yourself, why you are moving and what you like about the property. It’s a good time to mention any pets (add obedience training certificates, immunization records and emotional support/service animal registration to your gathered documents pile), too.

Your cover letter should also address any potential issues, like a gap in employment or bad credit. Just be careful in the way you explain the situation. It’s okay to say your credit took a hit following a divorce, but don’t rant about how awful your ex is. Your application may stand out but probably not for the reasons you want.

Not one for writing? Make a video instead. You’ll want to address the same issues as above and be personable, just as you would in the letter. Before filming, test your audio quality and check your background. A messy living room or a pyramid of last night’s beer cans might be a turnoff to a landlord.

Line up your reference

You’ll need to have at least three references. Determine who would make a good reference, and reach out to them before you start filling out applications.

Obviously, some references are better than others. Your current landlord or property manager is probably the best reference you can have because they can answer questions about how you take care of the property and pay your rent. Another good option is your employer. Avoid listing your best friend from high school or your parents; their reference will carry little weight.

Overhaul your social media

What will the person reviewing your application find if they Google you or look up your social media accounts? Before you apply, comb through your social media pages and remove anything that might be a red flag to a landlord, including references to parties, alcohol and drugs and photos with messy rooms in the background.

On the application

What you include (or don’t) on your application can have a big impact on whether it stands out or is shuffled to the bottom of the pile. In addition, certain issues raise red flags on the application. Avoid them by taking the following steps.

Fill in the application completely. An incomplete application will raise eyebrows. If you can’t remember the information being asked for, you’re better off taking the application home and submitting it the next day.

Be truthful. Even worse than leaving something blank is providing incorrect information. For example, providing a wrong address could look like an attempt to hide your rental history. An incorrect job title could make the landlord think you’re lying about other information, too.

Provide landline numbers. Don’t leave the landlord wondering if they’re really talking to your employer or your best friend. Write down the company’s or current landlord’s main phone number.

Don’t lie about pets. Maybe you can avoid a pet deposit by saying you don’t own one, but sooner or later, your landlord will find out, no matter how hard you try to hide it. Be upfront. Show him your pet’s obedience training certificates, or ask your current landlord to testify to how well-behaved he is.

Follow up on your application

After you submit your application, it could be several days before you hear anything from the landlord or his property management company. Usually, you will hear from someone if they have questions or need follow up information. Always try to be helpful and pleasant. Reply as quickly as possible, and provide any requested information in a timely manner, the sooner the better.

If you haven’t heard anything within a few days, it’s okay to follow up. Just be polite and not overly pushy.

What’s a Letter of Intent (LOI)?

A letter of intent is a formal step towards leasing or purchasing a commercial property. It’s a non-binding document that’s not enforceable by the court of law. However, it’s an important document between the property owner and the prospective tenant. It contains the statement of intent on behalf of a prospective tenant indicating his seriousness in leasing the commercial property identified in the document.

For all these reasons, it is important to draft a letter of intent to lease commercial property carefully.

The letter of intent to lease commercial property acts as a formal show of interest in a property. This is expected to begin a process of negotiations in which the finer details will be finalized. These details will be included in the rent agreement entered into by the property owner and the tenant.

If the property owner agrees to lease the property to the person or company, he will also write a letter of intent to the prospective tenant. Once these two letters of agreement are accepted by the respective parties, the property is by and large ready to be leased and no new parties will be entertained by the property owner.

In the case of commercial properties, the actual takeover by the tenant may take a few weeks or months. This is because the property might need some upgrade or renovation. Signed letters of intent by both parties ensure that both are committed to the agreed set of terms and conditions even during the intervening period before the legal contract is signed. 

Tips on How to Write a Letter of Intent to Lease Commercial Property

A letter of intent to lease commercial property is a business letter that needs to be written in a manner that is formal and high on clarity.

The letter of intent for commercial lease of a property should start with an introduction to your business or company. This should be followed by a description of your need for a commercial space. After this, you can identify the property you want to lease by indicating how it serves your purpose.

Finally, you can give a time extending 15 to 30 days or as the case may be for the landlord to respond to your proposal. You should close the letter on a formal note by signing it.

  • Mention the names and addresses of both the landlord and the tenant
  • Identify the commercial property under discussion for the lease
  • Mention the measurements and other significant details of the property

How To Write A Business Letter Of Intent To Rent Or Lease A Space

If you’re interested in putting up a business inside a mall, the first thing that the mall administration will ask from you is to submit a business Letter of Intent (LOI) .

A Letter of Intent is not a document we often see. That’s why most entrepreneurs don’t know what to write inside it.

Some might also ask, how should it be written? Or, is there a correct template or layout for making a Business Letter of Intent?

What is a Letter of Intent?

Before I give you the answer to these questions, let me first share with you what a Letter of Intent is according to Wikipedia. They have the simplest definition that I found online.

“A Letter of Intent or LOI is a document outlining an agreement between two or more parties before the agreement is finalized.

The concept is similar to the so-called heads of agreement. Such agreements may be Asset Purchase Agreements, Share Purchase Agreements, Joint-Venture Agreements, and overall all Agreements which aim at closing a financially large deal.”

That really sounds so formal, don’t you think? However, there’s really no reason for you to be afraid of getting your LOI wrong.

Although it does usually resemble a contract, it is most of the time, non-binding . This letter is often just issued to initiate a formal business transaction.

What’s inside a Letter of Intent?

For renting or leasing a space inside a mall or other commercial space, a Letter of Intent would contain the following information:

  • A statement saying your intent to lease a space inside the mall.
  • A description of your business including it’s basic concept, the business model it follows and a brief background and history.
  • A list of your products and services which should include pricing , merchandise packaging design and a description of your target market.
  • Your space, utilities and manpower requirements including the types of equipment you’ll be using and the number of employees you’ll have.
  • If there’s any, it would also be good to show pictures of your other branches or stores.
  • Your contact details and the best schedule for you to have a meeting

Before writing your Letter of Intent, it might help if you can ask the administration if they have an LOI template that you can just follow.

They could also provide samples that was submitted to them by past lessees. If not, do ask them what specific details they need stated in your LOI.

To help you with writing your Letter of Intent, here’s a very simple LOI template which you can use if you’re planning to rent or lease a space in a mall for your business.

XYZ Foods would like to present this Letter of Intent to signify our interest in leasing a commercial space inside ABC Mall.

We are the business behind the food cart, W Burgers, which has been selling gourmet hamburgers since 2004. Our products include a variety of hamburger sandwiches and burger rice meals. We also sell ice cold beverages.

Currently, our burger sandwiches and rice meals sell for P80 each. Our clients are usually young professionals who order our food as packed meals for lunch or dinner.

The W Burger food cart that we plan to put up would require at least 6 square meters and a power outlet for a cash register, a small freezer, a rice cooker, a soda vendo machine and a gas operated frying griddle.

The food cart would be manned by two employees.

We already have 5 branches located in various commercial areas in the city but this is our first venture in putting up a branch inside a mall. Attached are the photos of our existing branches.

We believe that our food cart complements the business concept of ABC Mall because we cater to the same target market.

A letter of intent is as essential tools for investing. It’s a great way to break the ice on a negotiation. It’s always surprising how few people use them! I know if a potential client is talking about it, it’s probably a safe bet that this is not their first time around the block 🙂

Noteworthy though…a letter of intent can be much longer than this also, and I highly encourage anyone using one to still have it drafted by your attorney. ESPECIALLY the simple stuff…that’s where it’s easy to screw things up!

Thanks for this sample. It is very helpful for non-lawyers like me. I just would like to point out a very minor error though. In the last paragraph, the correct word to use would be “complement,” not “compliment”:

“We believe that our food cart compliments the business concept of ABC Mall because we cater to the same target market.”

Compliment with “i” is when you praise or say nice things about someone or something. Ex. “Your mother is a nice lady” is a compliment. Or “Your performance was awesome” is a compliment.

Complement, on the other hand, means to enhance something or go well with something else, which is the intent in the case of your sentence. Ex. “The cashew nuts were an excellent complement for the soup.”

In other words, the cashew nuts go well with the soup, or in your example, your food cart goes well with the business concept of ABC Mall because you both cater to the same target market. Thus the need to use “complement” with “e”.

Whether you need to request repairs, complain about your neighbors, or make a simple request, writing a letter or email to your landlord can be beneficial in all kinds of different situations. 

In this article, we’ll walk you through some tips for writing your landlord and offer a series of sample templates you can use as guidelines for your own correspondence. 

Basic tips for crafting a successful letter or email

Any time you write a letter or email to your landlord, keep your language clear and concise to eliminate any potential for confusion. Include relevant details such as the date of writing, the dates of any instances referenced within the letter, and your contact information and unit number.

Depending on your reason for writing a letter, you may wish to cite the details of your lease or the tenant laws in your state. If your landlord is flaky, reminding him that you know your rights may be enough to spur him into taking action. 

To write or to email?  

Both posted letters and emails can be effective ways to communicate with your landlord, and in many ways they’re interchangeable. Email is faster, and allows you to keep a clear record of your communications. And it’s easy to keep multiple parties in the loop on one email conversation.

Mailing a letter can be a great way to reinforce your request or message, especially if your landlord has been unresponsive. Make sure to include your return address so your landlord has no excuse not to write you back.

Paying the rent late

A well-crafted letter explaining why your rent is late and offering solutions can be a powerful tool for staying on your landlord’s good side and lessening the penalties that typically accompany late payment. Use the following sample to craft a letter to your landlord regarding late rent payment.

I have applied for unemployment benefits, but it may take up to 2 weeks before I receive my first payment. I can pay $500 on the due date, and I will pay the remainder of the rent as soon as I receive my first unemployment check. I’ve also picked up some freelancing gigs and am actively interviewing for new jobs to avoid this problem next month. Please let me know if this payment plan will work for you. I understand that my late payment may have negative repercussions on your financial situation, and I’m very sorry for the inconvenience. I’m working diligently to ensure this never happens again. Intention to vacate

When you decide to move out of your apartment, you must give notice to your landlord. Check your lease agreement to see how many days of advance notice you are obligated to provide. If you have a good relationship with your landlord, you may wish to give early notice so he has plenty of time to find new renters.

In the letter, you should state the date you plan to vacate and remind the landlord that you wish to have your security deposit returned. You can offer to do a walk-through to assess the condition of the unit. Don’t forget to share your forwarding address so your landlord can get in touch with you in the future, if necessary. 

You can use the template below to craft your letter.

[Date] Dear [Landlord’s Name] I am writing to inform you that I will be vacating my rental at [rental address] on [date you will move out]. I’m confident that you’ll find the unit in excellent condition. Request for Security Deposit

In some states, your landlord isn’t required to return your security deposit unless you request it. Each state has different rules stipulating how long your landlord has to return your deposit. 

The following was written in the context of California law. Make sure to adjust the following template to conform to the laws in your state.

[Date] Dear [Landlord’s Name] I wish to request that you return my security deposit in the amount of $________, which I paid for the rental at [rental address].  I expect to receive my deposit within 21 days, as stipulated by California state law. I vacated my rental on MM/DD/YYYY and thus expect to have my deposit returned no later than MM/DD/YYYY. Please send payment to the following address: [Your forwarding address] If you have any questions or concerns, you can reach me at XXX-XXX-XXXX. Best Regards, [Your Name]

Contesting deductions from your security deposit

As long as you leave your rental unit in the same condition in which you found it (minus normal wear and tear ),  you are entitled to have your full security deposit returned. If your landlord determines that you’ve caused property damage that warrants repair, they may deduct from your deposit to cover those expenses. Unfortunately, some landlords may try to pull one over on you by making deductions that are excessive or unfair.

If you disagree with your landlord’s deductions from your security deposit you can dispute them. Do so in writing so there’s a clear paper trail.

Use the following template to craft your letter.

[Date] Dear [Landlord’s Name] I am writing to formally contest the deductions you made from my security deposit for the rental at [rental address]. Your deduction of $ _____ based on the claim that I left my rental “excessively dirty” is unjustifiable. I hired a professional cleaning service to clean the unit before I vacated and oversaw the work myself. I am confident the unit was left in impeccable condition. You will find the receipt for the cleaning attached to this letter.  Please send the remainder of my deposit, totaling $_______ to the following address within 7 days. [Your forwarding address] If I do not receive the payment by MM/DD/YYYY I will pursue legal action. If you have any questions or concerns, you can reach me at XXX-XXX-XXXX. Best Regards, [Your Name]

Request for Repairs

When it comes to repairs on your rental, it’s wise to create a paper trail of your requests in case there are ever issues regarding maintenance in the future.

In your letter, state the date the issue began, describe the problem in detail, and outline a timeline for arranging repairs.

If you have already requested maintenance and the issue is ongoing or has yet to be repaired, writing a letter is a great way to follow up and remind your landlord that you are still expecting a resolution. Don’t be afraid to pressure your landlord by referencing state laws or the terms of your lease regarding maintenance.

The following is a template you can use for a standard maintenance request. 

[Date]  Dear [Landlord’s Name] I am writing to inform you that the bathroom sink in my rental unit located at [rental address] has been leaking into the vanity cabinet since [date the issue started]. I have been unable to fix the problem on my own and request that it be evaluated by a professional. I appreciate your arranging to have this repaired as soon as possible. I can make myself available to let a technician into the rental any day this week after 2 PM. Please let me know when the technician will be arriving. If you wish to discuss this issue further, you can reach me at XXX-XXX-XXXX.  Best Regards, [Your Name]

Following up on request for repairs

In some instances, you may contact your landlord over the phone to request repairs rather than writing a letter, especially if the issue is urgent. In this case, it’s wise to write a follow-up letter confirming what you discussed to ensure that there is a record of the problem.

Use the following template to craft your own follow-up letter.

[Date] Dear [Landlord’s Name], I am writing to follow-up on the repairs we discussed over the phone on [MM/DD/YYY] As you know, on [MM/DD/YYY], the faucet in the kitchen sink of my unit, #_______, began leaking.  I contacted a plumber and had the faucet replaced. The cost of the repair came to $123.75.  As we agreed, I would appreciate it if you could send a check reimbursing me for that amount within 10 days. Thanks for your assistance with this issue.  Best Regards, [Your Name]

Vacating your rental due to uninhabitable conditions

When your landlord fails to keep your rental in inhabitable condition, they are violating the terms of your lease. If you find yourself in this situation, you can break your lease agreement and move out early without penalty. 

In your letter, detail the issues that render the unit unfit. Collect as much evidence as you can to support your claims in case your landlord disputes the issue. If you can provide photos and documentation as well as a record of communication with your landlord regarding the problems, it will all be helpful if the issue is ever escalated. 

Here’s a sample letter you can send to your landlord in this situation. Adjust the tone of the letter to suit your relationship with your landlord. 

[Date] Dear [Landlord’s Name], I am writing to inform you that I will be vacating my rental at [rental address] on [move out date]. As you are aware, my lease doesn’t expire until [MM/DD/YYYY] but I will be moving out early due to ongoing maintenance issues that render the unit uninhabitable.  I have reported the presence of black mold in the bathroom multiple times, first on [MM/DD/YYYY] and again on [MM/DD/YYYY] and the issue has yet to be addressed.  As you know, pursuant to California Civil Code Section 1942 , I am entitled to break my lease and vacate the rental free of penalty because the mold is a health concern. As such, I expect that you will forward my damage deposit in the amount of $_____ to the following address by [MM/DD/YYYY]. [Your forwarding address] If you wish to discuss this you can reach me by phone at XXX-XXX-XXXX. Best Regards, [Your name]

Complaint about neighbors sample letter

If noisy neighbors are causing you to lose sleep at night, it may be worthwhile to have your landlord intervene. 

Ideally, a civil conversation will be all it takes to come to a resolution, but in extreme cases, having noise complaint letters on file might assist your landlord in building a case for eviction.

Before you draft the letter, review your lease agreement to see what it says about noise issues . It may be helpful to quote the language on your lease in your letter to your landlord.
