The Ph.D. in Law degree program is designed to prepare J.D. graduates for careers as legal scholars and teachers through a doctoral program aimed at the production of a substantial body of academic research and writing under the close supervision of a three-member faculty dissertation committee. Unlike programs designed for students who wish to learn about law from the disciplinary perspectives of the social sciences or the humanities, the Ph.D. in Law is directed at students who wish to pursue advanced studies in law from the perspective of the law. This program offers emerging scholars an opportunity to contribute to the development of law as an academic field, and it provides an alternate pathway into law teaching alongside existing routes such as fellowships, advanced degrees in cognate fields, legal practice, and clerkships.

Because our entering Ph.D. students will have already completed their J.D. degrees, the anticipated course of study toward the Ph.D. in Law degree is three academic years and two summers in residence. In their first two semesters, Ph.D. students will enroll in courses designed to help them acquire the background and research skills needed to complete a dissertation in their field of interest and to prepare them for qualifying examinations that test the depth and breadth of the literacies and skills they have acquired. During their second year, students will prepare a dissertation prospectus and begin work on a dissertation. The dissertation may take the form of either three law review articles or a book-length manuscript and will make up a portfolio of writing that will be essential for success in the job market. Ph.D. students will also gain experience in the classroom, and receive the full support of Yale Law School’s Law Teaching Program , which has had remarkable success in placing graduates in tenure-track positions at leading law schools.

Ph.D. students receive a full-tuition waiver, a health award for health insurance coverage, and a stipend to cover their year-round living expenses, as well as support for participation in national and international conferences.

Applications for admission to the Ph.D. in Law program are available starting on August 15. The deadline for submission of all materials is December 15. Applicants to the Ph.D. in Law program must complete a J.D. degree at a U.S. law school before they matriculate and begin the Ph.D. program. Doctor of Laws (LLD)

The degree of Doctor of Laws (LLD) is the highest qualification available by examination within Melbourne Law School.

The work submitted for examination must be of such a standard that it makes "...a substantial and original contribution to legal scholarship and is of such standard as to give the candidate authoritative standing in the field of the candidate's study".

Entry Requirements

Applicants must be a graduate in law of the University of Melbourne of at least four years' standing; or a graduate of another university who has held a recognised degree for at least four years and received adequate training for legal scholarship. Applications to enrol in the degree normally follow an invitation from Melbourne Law School to individuals of considerable seniority and with a connection to Melbourne Law School. Applicants must also meet the University's English language requirements .

Eligibility

Melbourne Law School may admit as a candidate for the degree of Doctor of Laws:

  • Any person who is a graduate in Law of the University.
  • Any other graduate of this or another university who satisfies the faculty of having received adequate training for legal scholarship and whose degree is recognised by Melbourne Law School ('faculty') pursuant to Part 4 of the Academic Board Regulation as appropriate for the purposes of this award.

In either case of not less than four years' standing from the time of first qualifying for the degree.

Nomination for Admission

A formal application for admission to candidature for the LLD comprises a nomination by a Melbourne Law School academic. The nomination should be addressed to the Dean of Melbourne Law School.

The proposer should have sufficient familiarity with the proposed candidate and the candidate's field of research to enable the proposer to recommend that the quality of the work(s) to be submitted warrants the award of LLD.

The proposer must provide the following:

  • Information that demonstrates that the proposed candidate is eligible for admission to candidature for the LLD.
  • A statement expressing why the proposed candidate's work is "a substantial and original contribution to legal scholarship and is of such standard as to give the candidate authoritative standing in the field of the candidate's study".
  • A statement outlining the work(s) to be examined, which may comprise (i) a sustained body of work over a lengthy period, or (ii) a seminal work that has profoundly contributed to the corpus of knowledge in a particular field.
  • A curriculum vitae for the proposed candidate and a full list of the candidate's publications.
  • The names and contact details of three referees (other than the proposer) who have sufficient familiarity with the proposed candidate's field of research to enable them to recommend whether or not the quality of the work(s) submitted warrants the award of LLD.

Acceptance for Admission

A nomination for admission to candidature is considered by a committee established by the Dean of Melbourne Law School, comprising at least two Melbourne Law School academics. The Dean and Associate Dean (Research) of Melbourne Law School may be members of the committee, but the proposer may not. In considering whether to accept the candidature, the committee considers:

  • Whether the proposed candidate's work as identified in the nomination meets, on a prima facie basis, the subject, scope and character required for admission to the degree of LLD.
  • If the proposed candidate is not a graduate in law of the University, whether or not the proposed candidate has received adequate training for legal scholarship and whether or not the proposed candidate's degree is recognised pursuant to Part 4 of the Academic Board Regulation as appropriate for the LLD.
  • If work is submitted for assessment that has previously been presented for a degree in any university, whether or not this work should be approved for examination.

The decision of the committee will be taken by consensus or, if necessary, by majority.

Doctoral studies have been completed on local government/devolution/federalism in South Africa, Uganda, Ethiopia and Kenya and Zimbabwe. Please note that there are LLD/PhD positions available for the 2023 academic year.

Admission requirements

To be considered for admission, applicants must meet the following minimum requirements:

  • an LLM degree, or Masters degree in political science, economics, public administration or other related social sciences;
  • proven ability to undertake advanced research; and
  • relevant experience, where applicable.

How to apply for bursaries

The National Research Foundation (NRF) offers a few PhD bursaries through the South African Research Chair in Multilevel Government in the 2023 academic year.

The NRF minimum academic requirement for postgraduate funding is 65%. Applicants for doctoral funding must not be over 32 years by 31 December 2022. Successful applicants will be funded either at Full Cost of Study (FCS) or Partial Cost of Study (PCS). The FCS funding will be awarded to South African citizens and permanent residents only, who are either financially needy (i.e., those whose combined household family income is less or equal to R350 000 per annum), living with a disability or exceptional academic achievers. However, the PCS funding will be awarded to 5% of international students including South African citizens and permanent residents who could not be funded under FCS but meet other minimum requirements for the NRF scholarship funding.

An application for a bursary must also be accompanied by an application for admission to the programme, as explained above.

Bursaries are available only for full-time students. To be nominated for a PhD bursary, an applicant must have an excellent academic record as well as proven research ability. The degree is awarded on the strength of a thesis that is examined by an internal and two external examiners.  The thesis may be on any topic which falls within the Faculty’s research focus namely law, justice and sustainability.  There must be sufficient expertise on the topic available in the Faculty to provide effective study guidance. The student must, within 9 months from registration submit a research proposal to the Post Graduate Programme committee for approval. After approval of the research proposal the student must pass an oral exam to determine whether he/she  is ready to proceed with the writing of the thesis.

Duration (minimum and maximum duration

  • For full-time students, the study period is at minimum one year and the maximum duration of study is four years.
  • For part-time students it is minimum one year and the maximum duration of study is five years.
  • If a student has not completed the study within the maximum duration of studies allowed, the student may be terminated

Admission requirements

  • To gain admission to the LLD, a student must have obtained an LLM degree from this University or another South African university or a foreign university or must have the status of such a Masters degree granted, on request, by the senate.
  • An evaluation certificate as issued by the South African Qualifications Authority (SAQA) must be submitted if a previous qualification was obtained in a foreign country.
  • Applicants must have achieved a minimum of 65% average for the LLM degree as well as for the mini-dissertation/dissertation (research report) to be admitted to the LLD programme.
  • Students must furnish a concept note (a four-page mini proposal) submitted with the application form as proof of his/her research skills before the applicant receives permission to register.
  • Students are strongly encouraged to interact with a potential promoter prior to the application process.

Future requirements

  • Research doctoral degree students must (in consultation with his/her supervisor) submit the research proposals for a thesis six months after the final date of registration for doctoral degrees (31 October) in their first year of registration .
  • A student is required to successfully complete a research discussion six months after the approval of the research proposal
  • Allocation of supervisors or promoters Students applying for a doctoral programme must consult with possible promoters simultaneously with the application process, before registration. The Faculty Board may, in exceptional circumstances, approve the appointment of a co- or assistant promoter, on the grounds of relevant technical expertise.
