What Happens If I Die Without A Will?

A lot of people assume that when they die their home, savings and possessions will automatically pass to their next of kin – but sometimes the law is not that simple.

With no will you could be leaving your surviving spouse and children with complex legal problems which could lead to painful and divisive family arguments.

Also, today more people are remarrying. Die without a will and your estate could automatically pass to your second spouse and their offspring. Any children from your first family would receive nothing as of right.

Why Make A Will?

Despite all the warnings, a staggering 75 per cent of people die without having made plans for the future of their property or possessions.

Whatever the size of your estate – even if it’s a modest one – you should always leave a clear and legally binding statement of your wishes. Making a will is the only way of guaranteeing that your wishes are respected after you have passed away.

Make a will and you are free to leave your property and possessions to whoever you want. If you die ‘intestate’ (without a will) then all your assets will be divided up according to rules set out by the government.

The rules of intestacy are a ‘one size fits all’ way of dividing up property. These strict rules apply to everyone the same way – no matter what you would have wished for your friends and family. The solution is simple: make a legally binding will and you will not be subject to the rules of intestacy.

Also, by making a will you get to choose your executor(s) – the trusted person/people who will administer the terms of your will. They will gather all your assets, share them out among your chosen beneficiaries according to your wishes and pay any outstanding bills (such as Inheritance Tax).

If you die without appointing an executor then the court will appoint someone. It will usually be a family member – but it may not be the person you would have chosen.

We believe your will is one of the most important documents that you will ever sign and should be dealt with by specialist lawyers. There are important matters to consider including:

  • provisions for your children
  • appointing executors and trustees to deal with your assets
  • the best structure for your will to minimise the amount of Inheritance Tax that will be payable on your estate

Making a will gives you the power to make more detailed provisions for your loved ones, such as:

  • deciding who looks after your children after you die
  • bequeathing assets to your children after they reach a certain age
  • making sure that your surviving spouse or partner has a roof over their head (while still ensuring that your children inherit some money)
  • ensuring that any children from a previous marriage remain beneficiaries.

Having a will also enables you to make specific wishes for your funeral.

What Are Mirror Wills?

Mirror wills are a pair of wills. Each reflects the terms of the other so they are generally used for married couples, civil partnerships or cohabiting partners.

You don’t have to be married, in a partnership or a relationship. Any two people can make mirror wills together.

One person may wish to leave virtually everything to the other – and vice versa. So it makes sense to take them out at the same time to make the process easier. A pair of mirror wills is also cheaper than two separate single wills.

How Long Does The Process Take?

After you have met with us and told us your wishes, we will get a first draft of your will to you within seven days.

You then come in for a second meeting to let us know if any amendments are needed. Once you have approved the draft will, you can then sign in (witnessed by us) and your will is officially a legal document.

There may be come circumstances – such as a ‘deathbed will’ – where time is limited and speed is vital. Our solicitors can act quickly to help you.

Sometimes people going on holiday abroad want the reassurance of making or reviewing their wills. Some leave it until the last minute before calling us. It is possible to complete a will under these circumstances but we would always recommend planning ahead.

What Is Probate?

Probate is the legal process by which a court makes your will a legal public document so its terms can be carried out according to your last wishes.

Where Should I Keep My Will?

Your will is an important legal document and you should always keep it somewhere safe – but NOT in a bank safety deposit box.

That make sound counterintuitive but keeping your will in a bank safety deposit box may stop your family from seeing it after you have died. This is because the bank can’t open the box until probate has been granted…and that can’t happen without the will.

It is possible to lodge your will with the Probate Registry – but only you can take it back while you’re alive.

So where should you keep your will? Choose a place which is safest for you. We can store your will for you safely for free according to Solicitors Regulation Authority rules. We will happily provide you with copies to keep at home with your other important documents.

We always advise against keeping your original will at home, no matter how secure your safe is! If – for any reason – your will cannot be found after you have died, then it is presumed in law that you have destroyed the will. In some circumstances it is possible to unravel this legal difficulty but the process is cumbersome and time-consuming.

It’s far better to play safe and to store your original will with your solicitor. Also, you should always let your executor know – in writing – where your will is kept.

How Do I Change My Will?

It is worth reviewing your will every few years just to make sure that it still matches your family circumstances and that your wishes remain the same.

Don’t simply make a will then forget about it. Times change quickly.

There are certain trigger events that should act as a spur for you to review and update your will:

  • the arrival of new children or grandchildren
  • marriage, divorce or remarriage
  • someone named in your will dies before you do
  • you want to change executors (if they die before you or are no longer suitable for the role).

In some cases you can amend your will using a codicil (an addition) but these are rare today. Most people now simply amend and replace their will.

Also, it is possible to change the will of someone who has already died using a deed of variation.

Are Wills Private Or Public?

Before probate your will is private. It becomes a public document once probate has been granted. Anyone can search through probate records (for people who died after 1858) online.

You can obtain a copy of a probate record online around 14 days after probate has been granted or by post within four weeks.

You can set up a trust within your will for a variety of reasons – such as to protect assets.

Who Should You Appoint As Executors And Trustees?

You must be certain that your executors are capable of carrying out all the duties expected of them under the law. Those responsibilities include:

  • identifying and valuing your assets and your liabilities
  • contacting (and checking the identities of) your chosen beneficiaries
  • applying to the court for a Grant of Probate (confirming their authority to administer your estate)
  • settling any Inheritance Tax liabilities that may be payable
  • handling any Income Tax or Capital Gains Tax matters
  • dealing with the administration of your estate by collecting the assets and settling all debts (including your funeral costs)
  • ensuring that the remainder of your estate is paid to your chosen residuary beneficiaries in the correct proportions
  • preparing accounts setting out the transactions in the estate for those beneficiaries.

Your trustees are legally responsible for:

  • managing any trust that might arise in your will
  • holding funds for children until the dates you have specified in your will and, in the meantime, investing the funds in accordance with advice obtained from a suitably qualified financial adviser.

Your executors and trustees have a legal duty to act carefully and properly. If your executors or trustees cause a loss to the funds under their control, they could be personally liable to make good the loss to your estate from their own money.

Can Wills Be Contested, Disputed Or Overturned?

Wills are now more likely to be contested than ever before. These legal wrangles – though not commonplace – are now happening more often.

There are various reasons for this. Increased publicity over celebrity will disputes has prompted more people to question why they were left out of their family wills or why they received less than they expected.

An advance decision (also known as a ‘living will’) enables a person to specify what actions should be taken on their behalf if they become unable to take decisions for themselves due to illness, old age or life-changing injuries.

Janet (49) & John (56) have been married for 10 years and they have little Susan 7 years old. John has two grown up children from a previous relationship, Adam and Jack. Janet has Amanda, 15, from a previous marriage, who lives with them both. Though John gets on fine with his ex, Janet doesn’t and doesn’t want him to have anything to do with her children. Janet and John bought a house together a few years ago, and though it’s mortgaged it is worth around £350k. Both have works pensions and a few savings in the bank, but not much.

John wants to make sure Janet, Susan and Amanda are looked after if something should happen to him, but he also want to be fair to his older boys. Janet wants John to look after Amanda and Susan if she isn’t around.

The solutions is a well drafted Will for them both. After a detailed consultation they decide to use a Trust to protect the family home.

In John’s Will he gifts his half of the house into a Trust that allows Janet to live there for the rest of her life, or have use of the equity of his half if she decides to move / downsize. On Janet eventually death his share would be split 4 ways between Susan, Amanda, Adam and Jack.

In Janet’s Will, she does the same as John with her half of the house but on John’s death, her share only gets split 2 ways, Susan and Amanda. She also appoints John as Guardian of all the children and additionally writes a Letter of Wishes to explain why she doesn’t want her ex-husband to have custody of Amanda. Though her ex has parental responsibility her wishes are now known and will carry great weight with any court.

Why do you need to make a Will?

  • To ensure your money, property and possessions end up with the people you choose after your death.
  • To make sure your children are cared for, in the event of your death, before they reach 18 by appointing guardians.
  • To make sure your estate does not pay any more Inheritance Tax than necessary.
  • To appoint the executors that you trust – your executors must follow the instructions in your Will after your death and will oversee the distribution of your assets to your beneficiaries.

What happens if you don’t make a Will?

If you die without making a Will (called dying “ intestate ”), or your Will fails because it has not been prepared correctly, then the law sets out who will inherit your assets according to a strictly ranked list of relatives. This may result in your family paying more Inheritance Tax at the time of your death than necessary and a distribution of your assets which does not reflect your wishes. If you don’t have any family then ultimately the Crown would receive your assets.

What does an executor have to do?

In short, an Executor is the deceased’s legal representative after their death. They are responsible for carrying out the deceased’s instructions as per their Will. The Executors make arrangements for the funeral, determine whether Inheritance Tax is due and may have to apply for a Grant of Probate They should sell the deceased’s assets and pay off the liabilities. Then they pay the inheritance to the Beneficiaries named in the Will. This process is called “administering the Estate”. The Executors should prepare a set of “Estate Accounts” which is a document that provides a financial overview of the administration of the Estate.

How do I become executor of an estate without a Will?

Where there is no Will, it will be necessary to appoint an Administrator. An Administrator has the same role of an Executor in circumstances where there is no Will or the Executor appointed in a Will cannot act. A person is eligible to appointed as an Administrator of the estate if they have an entitlement under the rules of intestacy. There is a list of people who will be entitled under intestacy which depends on which family members are surviving. For example, if a spouse is surviving they have first refusal to act as the Administrator; if a person has no spouse/civil partner, the deceased’s children will have first refusal to act as Administrator.

Can an executor of a Will change a Will?

No, an Executor must comply with the terms of the Will and distribute the estate to the beneficiaries in accordance with the Will.

Why do I need a Will?

A Will dictates what should happen to your money, assets and property after you die (collectively termed your estate).

Having a Will makes it much easier for your family to sort out your estate once you have passed on; without a Will, your estate will be shared out according to the law of intestacy, which may not be in line with your wishes, especially if you have remarried or have members of your family who are estranged (see below “What happens if I die without a Will?”)

Writing a Will can also help mitigate the amount of inheritance tax that may be payable on the value of your estate, and allows you to leave assets to people outside of your immediate family.

Do I need a solicitor to make a Will?

Whilst it is not essential that your Will is drawn up or witnessed by a solicitor, it will ensure that it is completed professionally and accurately. Not all Wills are straightforward (even if you think it might be!) and there a number of legal requirements that must be met to ensure that your Will is binding in the eyes of the law.

Who is the Executor of a Will?

The Executor is the named individual in a Will given the legal responsibility of ensuring that the deceased’s estate is shared out in accordance to their Will.

This includes payment of bills and taxes for the estate as well as making any necessary court appearances should any problems arise with the administration. If there are any disagreements, then the Executors are responsible for dealing with these on behalf of your estate.

Who is the Trustee of a Will?

It is the job of a Will Trustee to manage any ongoing Trusts which arise from the deceased’s Will. A Trust occurs when one (or several) individuals are tasked to look after property and assets on the behalf of someone else, most frequently a child or a vulnerable loved one.

Those who stand to benefit from the Trust are called Beneficiaries. Your Executors do not need to be Trustees, so you can appoint different people in this role if you feel that they would be more suitable (such as guardians for any children under the age of 18).

What is Probate?

In order to carry out the administration process, the Executor may need to apply for a Grant of Probate. This will depend on the value of the estate, what assets are held within it and how they are held. The Executor can either do this themselves or use a solicitor to act on their behalf. As part of the process, you must estimate and report the estate’s value (this is to determine Inheritance Tax).

Even if there is no Inheritance Tax to pay, an account still needs to be submitted to HMRC if you are applying for a Grant of Probate. If there is no Will, it is known as a Grant of Letters of Administration and can be applied for by beneficiaries or other people with an interest in the estate (such as creditors).

Can I contest a Will?

Yes, a Will can be contested if its validity is brought into question or it is believed that the writer of the Will was coerced in some way or did not fully understand what they were signing. What happens if I die without a Will?

If you die without writing a Will (known as dying ‘intestate’), your estate will be divided up according to the rules of intestacy. This is also the case if the Will is proved to be invalid.

  • If you are not married or in a civil partnership with your partner, they will be entitled to nothing when you die.
  • If you are married or in a civil partnership, your partner will be entitled to most of your estate – this is true even if you are separated but not divorced.
  • If you have children but no partner, then your estate is shared equally among them or their descendants.
  • Inheritance Tax payable on your estate might be higher than if you had written a Will.
  • If you have no living relatives when you die, your estate will belong entirely to the Crown. This is known as the law of bona vacantia, and is relatively rare but nonetheless does happen!

What should be included in my Will?

Before writing a Will, you should summarise your total estate and its value, so you know exactly what you need to allocate in your Will. Common assets listed in a Will include:

  • Any properties you own
  • Bank savings
  • Premium bonds

  • Jewellery and other precious belongings

Can I change my Will?

Yes, you can make changes to your Will and there are many reasons to do so, for example, you have children, grandchildren, get married, divorced, or someone named in your Will passes away.

If making slight amendments, you can use a document called a ‘codicil’. This is a legal document that is only valid in conjunction with the original Will and will need to be witnessed and signed in the same way. There is no limit to the number of codicils you can add to a Will.

If you are making more dramatic changes, we recommend that you write a new Will from scratch and cancel your old one. Your new Will should state that it officially cancels the old one and the previous Will should be destroyed.

What makes a Will valid?

Legally, a Will does not need to be written on any special document – that means it could be written on notepad paper and still be valid. For a Will to be valid:

  • The Will must be written and signed by you.
  • The Will signing must be witnessed by two people.
  • You must have the mental capacity to fully understand the implications of your Will, what you are giving away and who might have an interest in your estate.
  • You must not have been coerced in any way.

What is a Living Will?

A Living Will, also known as an Advance Decision to Refuse Treatment, is a written statement where you specify your right to refuse medical treatment in the case you lose mental capacity or are unable to communicate your wishes. This lets your family, friends and healthcare professionals know in advance what type of treatment you refuse.

You must be clear in your Living Will regarding which treatments you do not wish to accept, especially if you wish for treatment in some cases and not others. It is important to take advice if writing a Living Will as it can invalidate other previously made documents (such as a Health and Care Decisions Lasting Powers of Attorney) if not drafted correctly.

Making a power of attorney is the best way to plan for a future where you need extra support.

We are living longer than ever before which means many of us are at greater risk of being diagnosed with an illness such as dementia or having an accident during our lifetime. A power of attorney allows someone you trust (called an attorney) to make decisions for you in the event you become unable to make decisions for yourself in the future. Your attorney can be authorised to make decisions about your health and welfare and/or your financial affairs.

It is always worth considering a power of attorney to ensure your best interests are protected, no matter what the future brings.

Like powers of attorneys, living wills (now called advance decisions) allow you to express your wishes in case you lose the capacity to make a decision for yourself for the future.

Specifically, a living will allows you to refuse future medical treatment (including lifesaving treatment), for example, because you are unconscious or you have an illness such as dementia.

Not only does this allow you to make sure your wishes are respected and followed, it also saves your loves ones from having to make a difficult decision on your behalf.

As you grow older, you will probably be thinking about whether you will eventually need long term care and how this will be funded. It is common for people to feel concerned about the costs of care and particularly about the impact it will have on their loved one’s future inheritance.

As well as appointing deputies, the Court of Protection has the power to make a will on someone’s behalf and make important one off decisions about matters such as consent to medical treatment.

The process of applying is complex so consulting a specialist Court of Protection solicitor in these matters is essential.

You may be able to change a loved ones Will after their death so long as any beneficiaries left worse off by the changes give their consent. There are many reasons why you may want to vary a well including to:

  • Reduce the amount of inheritance tax due
  • Provide for someone who was left out of the will
  • Make the will clearer

Disputed Wills

Disputes over the validity of the Will, inheritance, and the way the personal representatives are handling the estate are all common issues that can arise after the death of a family member. What happens if someone dies without leaving a will?

If this happens to one of your relatives, it is best to seek legal advice as soon as possible, because the law sets out who should then inherit their estate (their money, property and possessions).

Usually, a close relative like a spouse, parent or child has the right to deal with the estate of the person who has died. They are referred to as an ‘administrator’ - the person who deals with the estate if there’s no will.

You can usually apply for a grant of representation to be the administrator of the estate if you’re the person’s next of kin, for example their husband, wife, civil partner or child.

What is a Mirror Will?

Mirror Will are similar documents created on behalf of a married, civil partnership or unmarried couple.  They are virtually identical Wills where one member of the couple leaves their estate to the other in the event of their death.

How is the estate of someone who's died valued?

You need values of any money, property and possessions (known as their estate) of someone who’s died, on the date of their death, before you are able to get a ‘grant of representation’. This is the legal right to deal with their estate.

You also use your valuations to work out if inheritance tax must be paid on the estate.

Before you start, you’ll need details of all the person’s assets and debts when they died - plus any assets they gave away before they died (known as ‘gifts’) and also any assets they held jointly with someone else.

An asset is anything the person owned with a value which could be sold.

What is a Power of Attorney?

Power of Attorney is someone you trust who you believe will make decisions in your best interests and take care of your finances and sign forms for you if you have an accident or become ill and are no longer physically or mentally able to deal with your own affairs.

How do you appoint a Power of Attorney?

This can be achieved by signing a document called a ‘Lasting Power of Attorney’, known as an LPA.  It can only be completed while you have mental capacity.  There are two types of LPA; one for property and financial affairs and one for health and welfare.

What is a lasting power of attorney?

A lasting power of attorney (LPA) allows an individual to give someone that they trust (e.g. family member) the legal authority to make decisions on their behalf if they lose mental capacity in the future.

There are two types of lasting power of attorney – “property and affairs” and “personal welfare”. By setting up a lasting power of attorney you can therefore appoint one or more people of your choosing (the attorneys) to deal with your financial affairs, your personal welfare, or both. This can include:

  • giving your attorneys access to your bank accounts
  • paying your bills
  • dealing with your medical care
  • selling your property if required
  • generally handling your affairs

The 2023-24 New Media Writing Prize , directed by BU’s Lyle Skains and judged by BU practitioners and researchers Dalia Elsheikh , Jim Pope , and Brad Gyori has drawn to a close after a bright and exciting two days of creative “Unconferencing”, a brilliant and thought-provoking keynote on generative AI and electronic literature from Professor Anastasia Salter , and the announcement of all winners for this year’s prizes. The keynote and awards ceremony are available on YouTube for anyone who missed them.

This year the events were moved to May from January to fit better with semester timetables and activities around the Bournemouth Writing Prize . This move proved fortunate as we saw our entries nearly double this year over previous years, with 194 eligible works submitted from 45 different countries. Our judges certainly needed the extra time to review and debate the wealth of high quality submissions of interactive digital narrative and journalism.

Social Good Prize

2023-24 marks the very first year this prize has been awarded; it is supported entirely by the associated NMWP Unconference. The focus on interactive digital narrative for the purposes of social good or addressing global challenges (such as the UN Sustainable Development Goals) is drawn from Lyle Skains’ research into the creation and efficacy of interactive narrative to inspire attitude and behaviour change on topics of socio-cultural, medical, and ecological importance.

Unconference Report

Anastasia Salter’s keynote (viewable on YouTube ) capped off the Unconference and transitioned us to the awards ceremony. Their insights on generative AI and how it is already influencing electronic literature (another wave of software reproducing social bias and inequality) even while offering the next step in the evolution of creative tools were both concerning and exhilarating—perhaps a perfect note to strike in an Unconference themed around inclusivity.

Our second annual Unconference unfolded over two days leading up to the NMWP Award Ceremony. 40 creatives, academics, and students attended from across the world, including the UK, USA, Canada, India, Norway, and Mexico.

As a more creatively-focused event, the Unconference focuses on workshops and performances, with relevant academic talks dispersed throughout. We learned fundamentals of programming, how to create a GitHub website, and considerations for creating interactive digital narratives with purpose (such as wellbeing).

We were also treated to electronic poetry, a preview of the very first Indian anthology of electronic literature, Instagram storytelling, and discussions of art and health.

We played together in netprov (improvisational, collaborative online storytelling), spitballed approaches to teaching electronic literature and making it more accessible, and became Wikipedia editors as we seek to grow elit’s representation on this foundational site of knowledge.

Williamson’s family drama series The Waterfront has been ordered to series by the streamer. It comes a few months after Deadline revealed that the Scream writer was working on the series as part of a new overall deal with Universal Television.

Inspired by true events, The Waterfront dives into the flawed Buckley family as their attempts to retain control of their crumbling North Carolina fishing empire drive them to increasingly dangerous means to keep themselves afloat.

Williamson was born in New Bern, North Carolina, the son of a fisherman.

He will write and exec produce the series with Ben Fast from his Outerbanks Entertainment also exec producing.

The Waterfront was one of a number of shows that Williamson is developing under his overall deal. He is also working on a remake of Rear Window , which has been set up at Peacock, The It Girl, based on Ruth Ware’s book and The Game based on the David Fincher film.

The Waterfront was announced as part of Netflix’s first Upfront in New York.
