Some people think that dangerous sports should be banned, while others believe that people should be free to do any sports or activities. Discuss both views and give your opinion.

Opinions are sharply divided over the issue of whether dangerous sports should be banned. Some advocate for prohibition due to significant safety concerns, while others argue for the preservation of individual autonomy, emphasising that people should have the freedom to pursue any sports or activities they choose. Personally, although I acknowledge the legitimate concerns about safety, I believe that the principle of individual freedom should prevail.

Those in favour of banning dangerous sports often cite the significant risks involved such as severe injuries or even death. Activities like cliff diving or extreme mountain biking carry inherent dangers that often lead to severe or even fatal accidents. What is more, many impressionable young people are not fully aware of the consequences of participating in such activities. For these reasons, banning extreme sports is necessary to prevent unnecessary harm and the emotional and financial impact on the participants as well as their families.

Conversely, advocates for personal freedom believe that everyone should be free to choose their activities, regardless of the associated risks. They argue that high-risk sports can be incredibly rewarding, and offer personal growth and an unparalleled adrenaline rush. They further point out that with meticulous training and implementation of strict safety measures, the dangers of these sports can be considerably reduced. For instance, with thorough training and stringent safety protocols, the risk of skydiving can be substantially lowered, allowing participants to enjoy these activities responsibly.

In my view, while safety is crucial, it should not overrule people’s freedom to choose their sports. Banning dangerous sports outright might prevent some accidents, but it also strips away the right to make personal choices about risk-taking. A balanced approach, where high-risk sports are regulated through strict safety measures and informed consent is a more reasonable solution.

It is a common belief that we should strictly prohibit extreme sports due to the huge number of risks involved. In this essay, I am going to demonstrate that risk factors are present in all sports before suggesting that people should have the right to play any sports they want.

Advocates of banning certain sports may argue that their inherently dangerous nature may threaten lives. As extreme conditions are a prerequisite for these sports, risks like equipment failure render players more vulnerable than in other sports. For example, skydivers who freefall from enormous altitudes seem more prone to injuries or even death than players of ordinary sports. It not only imperils the lives of the people undergoing the severities post such injuries or mishappenings but also curbs one’s harmony as at times, the players may be rendered distraught and traumatized for life. This, as they say, is a clear lack of prudence and safety measures for the people participating in such sports.

In contrast, I believe that people should have the autonomy to play any sports they want, regardless of their danger. This is because they can already decide for themselves whether to take part in several dangerous non-sport activities. For example, those who reach the legal drinking age are free to purchase alcohol, the excessive consumption of which may have fatal consequences . If personal freedom is championed with regard to things like alcohol, one can argue that it should be extended to sporting pursuits as well. Instead of an outright ban on extreme sports, I believe there are ways to mitigate the risks attached to them. Sports associations could impose an age limit for extreme athletes to ensure only people who are fully developed physically are allowed to participate. Another solution is to bar players from practising or competing without the necessary protective gear. These measures would strike a happy medium without intruding on people’s personal freedom.

In conclusion, I believe people a re entitled to play dangerous sports if they want, and certain restrictions in lieu of a ban would help ease the safety concerns.

The media commonly provides a barrage of news about dangerous sports as the deaths and injuries associated with them often make for spectacular headlines . As a result, some people have argued that all extreme sports should be banned, although I would argue that such a policy would be out of all proportion to the real risks involved.

Those in favour of prohibiting people from taking part in dangerous sports tend to focus on the risk element. Even when individuals may be physically and mentally prepared to participate in extreme sports activities, and even when they have all the right gear, the dangers are potentially existing . To take an example, some sports are challenging and fraught with danger as BASE jumping. Participants hurl themselves off cliffs, and few escape without suffering severe bruising or acute abdominal pains, which normally last for several days. In addition, although sports equipment rarely malfunctions, this may still happen and the consequences may be fatal. The supporters of legislation to ban dangerous sports argue that such tragic outcomes not only affect the individual victims, but also leave mental scars that their families then have to live with for the rest of their lives.

However, I support the view of those who contend that participation in extreme sports must be a matter of personal choice. Firstly, overcoming physical challenges may be a springboard for positive personal transformation. It may make a person stronger and more determined, and the experience may be a life-changing one. Secondly, the rigours of preparation in order to go mountain-climbing, white-water rafting or other such extremely strenuous activities demand that an individual is in the peak of health and physical condition. Finally, there is an ethical aspect that dictates that a person should have the freedom to pursue the challenges which they set themselves, even though this may involve a level of risk which others might find unacceptable.

In conclusion, while acknowledging the real risks, I would defend the right of any individual to take part in the extreme sport of their choice.

Some people believe that goverment should ban dangerous sports, while other agrue that everyone should have freedom to practice any sports or activity. In this essay i am going to discuss why people want goverment to ban this sport and also why other people argue against this opinion.

Firstly, people want goverment to ban dangerous sports because some sports like wrestling, kick boxing and many other can cause a permanent physical as well as mental injury to person who is participating in the activity. For example recently in kick boxing tournament one of the player got hit on the back of the neck and was paralyzed and it took about 2 year for him to recover from that, even after 2 years he is not fully recovered and won’t be able to practice the sport anymore. Another reason is that this sports are broadcasted worldwide so young ones who are watching this shows, amy get influenced in a negative way and possibly adapt a violent nature.

Moving forward, To the people who argue that this sport should not be ban and everyone should have freedom to choose activity of their choice. One of the major reason this sports are encouraged is the betting market. where people put money on the winning horse, let’s take example to understand this better. Now if there is a fight between person A and B, than people will put money on them on the basis of winning probablity .

In conclusion, I believe that yes everyone has a right to choose sport they want to play but goverment should put certain restrictions and established strict regulations. S o life of person practicing that sport is not in danger and parents should also monitor what kind of media content their children’s are consuming to prevent negative impact on them.

Overall Band: 4 Main ideas are difficult to identify and such ideas that are identifiable lack relevance, clarity and support. Large parts of the response are repetitive. While some people endorse the idea that highly risky sports should be prohibited by the government, I disagree with this position and support the opposite party that praises freedom over security.

Proponents of banning dangerous sporty activities might state that this would significantly affect the well-being of our society and environment. Firstly, their approach would protect the sportspeople from injuries and — in the worst case — death. Secondly, bypassers would be protected, especially when it comes to forms of sport that are performed in a public area and pose a constant risk for people staying there. Lastly, forbidding dangerous sports that take place in nature, like rock climbing, could help to reduce damages on flora and fauna.

Whereas these alleged outcomes sound promising at first sight, no prove can be furnished that illegalizing these sports would actually lead to people ceasing them. It is more probable, that they would continue practicing their hobby furtively. This will not lessen but increase the danger of their activities due to the lack of proper supervision. Furthermore, this question bears an ethical aspect, since we live in a highly individualized society, where personal freedom is a much valued moral concept. Therefore, implementing the suggested restraint would contradict our modern ideals. For these reasons suppressing specific sports completely is not an option, but it should be considered to set stricter regulations to them, comparable to the laws on the acquisition and use of weapons. Conceivable restrictions may be a specific training or license compulsory for exercising in this field.

To conclude, even if there are arguments for a comprehensive interdiction of sports which are highly risky, they can not outweigh the disadvantages. Instead of banning these sports it would be more effective to impose some conditions on their practice.

Model Answer:

The growing popularity of dangerous sports has sparked a heated debate and many people insist on prohibiting life-threatening sports. I think otherwise and believe that it is the right of an individual to choose whatever sporting activity she or he wants.

The reason why a ban on adventurous yet risky sports is warranted is that these sports contain the potential hazard to athletes. Even a slight fault can ruin one’s life. An athlete can die if the parachute fails to open, for example, when he or she takes part in skydiving. A case in point is a 17-year-old US skydiver named John Nikola, whose parachute failed to open, plummeted 2000 metre to the ground and got killed instantaneously. In addition to the grave risk, these sports also encourage violent behaviour, thereby desensitizing society to dangerous activities. Therefore, opponents of dangerous sports urge the government to ban these sports.

The proponents of extreme sports have some valid arguments. Human rights and freedom, according to them, are violated by imposing such a ban on dangerous sports. They go on arguing that since athletes are keenly aware of menace from adventure sports, they should have the liberty to choose any activity or sport they find suitable for them. Besides, almost every sport possesses a risk to an extent. If the government prohibits all potentially risky sports, then there will be limited opportunity for individual’s choice and freedom, which ultimately undermines democratic values. Therefore, extreme sports should not be banned so as to exercise players’ democratic rights.

In conclusion, I believe that preventing individuals from participating in extreme sports due to the potential of inflicting fatal wounds is unjustifiable. People should have the freedom of choice to pursue their favourite adventurous sports. If an act does not cross others’ rights, a person has the rights to do it.

Extreme sports such as sky diving and skiing are very dangerous and should be banned. To what extent do you agree or disagree with this view?

Safety First Many people claim that risky sports including skiing and sky diving should be prohibited. I oppose the aforementioned view and my reasons will be explained in the following paragraphs. First and foremost,it goes without saying that these two sport (1) are able to evoke astounding thrills and raise adrenaline. However, incidents occur primarily due to the lack of professional training (2) . Amateurs attempt to learn on their own without being aware of the risks they are exposing themselves to. Furthermore,accidents happen because of bold stunts performed by people searching for adventure. Special tricks demand help and ideal conditions,otherwise they will convert into imminent failures (3) . In addition,a proper equipment is a necessity when it comes to plunging into such sports. A broken sky set or a rusty fly engine can ultimately trigger terrible repercussions to the people involved. On the top of that (4) ,skiing and sky diving represent a profitable area of investment. Therefore,governments in charge of these dangerous activities can spend in rural regions, thus contributing to the development and beauty of the site. (5) On the flip side, despite of making all required steps to ensure for a safe experience , nature remains a game changer (6) .Poor weather and sudden swifts have a tremendous impact on one’s life (7) .For instance,many wounds have led to disabilities and in less fortunate scenarios to death. To draw the conclusion,after weighting both sides of the argument I support the view that such sports should not become extinct irrespective of the public belief (8) .

Sport s — ‘sports’ is normally pluralised in British English.
Accidents occur — ‘incident’ is usually a more general term that can refer to both good and bad, planned and unplanned event. ‘Accident’ is something that happened by chance and is definitely something unpleasant. Later on in the text you use the right word. There’s a good article on the matter at espressoenglish.net.
Special tricks require help and ideal conditions,otherwise they will imminently/inevitably turn into failures — ‘demand’ sounds too imperative here; ‘turn into’ is more suitable than ‘convert into’ — the latter makes it sound more like a business transaction than a sports mishap. I also opted for adverb ‘imminently’. This way the idea of something turning into failure is easier to see in motion, instead of it being an ‘imminent failure’ from the beginning. This is not a mistake but more a matter of preference.
On top of that — ‘On top of that’ is an idiom, no article is needed here.
I couldn’t understand the connection between the last two sentences and the rest of the paragraph. Make sure there’s a clear progression of idea, the text is cohesive and easy to follow.
On the flip side, despite ( in spite of ) making all required steps to ensure for a safe experience , nature remains a game changer — it is either ‘despite’ or ‘in spite of’.
‘Swift’ as a noun means a certain species of bird. You must have meant something different here.
To draw a conclusion,after weighting both sides of the argument I support the view that such sports should not become extinct irrespective of public belief — public opinion shouldn’t take an article because you mean public opinion in general; ‘to draw a conclusion’ is the normally used form; however, the phrase implies that you infer the conclusion from something that isn’t explicitly stated. In your case you are summing up your own writing, which means that the conclusion should be clear to you. See this article for clarification.

Despite the fact that this text has very nice examples of vocabulary and grammar, it remains fairly inconsistent with collocations and numerous vocabulary inaccuracies ( see #1-3; #6, #7) as well as occasional grammar mistakes. This could negatively affect the overall IELTS Writing score (see criteria of IELTS Writing assessment ).

Make sure you use words and phrases you are confident about, brush up your knowledge of articles , make sure all of your sentences contribute to the general idea of the paragraph they belong to.

How long does it take to do the IELTS test?

Nowadays many people attracted to dangerous sports and other dangerous activities. From my everyday experience and observation I think it is a result of dramatic changes in people’s life.

Just imagine at old times men had to hunt for food, fight, face many challenges and obstacles. Now our days are quite ordinary with a cup of coffee, donuts, computer, desk table and TV. Basically, we do not have to straggle every day for our life and we have nutritious meal without any efforts. So, all we have to do is to contemplate out life. However, I must confess it can be boring. All improvements created for the past centuries made our life easier. Nowadays people look for adventure. Personally, I think that every person sees different goals in doing dangerous activities. Some people want to add some stress and tension to their lives. From the other side, other people want to eliminate stress and tension gained from their everyday lives. They can forget about all troubles and leave them behind. I believe that dangerous activities give one freedom, happiness, feeling of independence and tone.

To sum up, I think that dangerous sports and activities are irreplaceable in our life. Without them out life would be miserable and boring.

Definition-

You will have one hour to finish the entire writing test, including tasks 1 and 2. It is advised to complete work 1 in no more than 20 minutes and devote the remaining time to task 2, as task 2 will earn you more band than activity 1. Grammar and word usage on the test will both be taken into account when determining your score. Use around 150 words for task 1 and 250 words for task 2, respectively.

Some people believe that harmful sports should be outlawed by governments, while others believe that people should be allowed to engage in any sport or activity they choose. Talk about both points of view and share your own.

Sample Answer-

The media frequently releases a torrent of news about risky sports because the fatalities and injuries related to them frequently make for sensational headlines. Because of this, some have argued that all extreme sports ought to be prohibited. However, I would contend that such a policy would be wholly excessive given the actual risks involved.

People who support outlawing participation in risky sports frequently emphasise the risk factor. Even if people are intellectually and physically capable to engaging in extreme sports activities, even if they have the necessary equipment, there is still a chance of danger.As an illustration, some activities, like BASE jumping, are difficult and dangerous. Many participants who jump off cliffs end up with significant bruises and intense stomach pain that typically lasts for many days. Additionally, even while sporting equipment rarely breaks down, it nevertheless might, and the results could be fatal. Legislators who favour banning dangerous sports contend that such terrible consequences not only harm the individual victims but also create psychological scars that the relatives of the victims must endure for the rest of their lives.

In conclusion, I would defend the right of any person to engage in the extreme sport of their choosing, while realising the genuine hazards.

Personally, the fact that all sport is optional and anyone participating in a ‘dangerous sport’ does so of their own free will suggests that it is not an activity that needs to be restricted or prohibited.

There are obvious reasons why dangerous sports are popular among many people. They offer excitement and the opportunity for people to see something different in terms of entertainment. It is also true that the participants in such sports are usually extremely competitive and have trained extensively in order to take part in such events.

The argument that because of their dangerous nature they should be banned is an invalid one, as there are numerous cases of other athletes suffering injuries and even death while taking part in sports and other activities that many people would not normally consider as dangerous. There have been soccer players who have collapsed on the field, and there are certainly more injuries in sports like American football and Rugby than in some of the more extreme and presumably dangerous sports such as bungee jumping, cliff diving and others of a similar nature.

One could even argue that more people are injured or killed driving their cars every year in many countries than there are athletes who suffer minor or fatal injuries through participating in dangerous sports. Whether a sport is considered dangerous or not is for the individual participant to contemplate before making their decision to train for it or enter a particular event. There is really no need for any kind of formal restriction on such activities as participation is never mandatory or forced.

For most of this year, the JN.1 variant of the coronavirus accounted for an overwhelming majority of Covid cases . But now, an offshoot variant called KP.2 is taking off. The variant, which made up just one percent of cases in the United States in mid-March, now makes up over a quarter.

KP.2 belongs to a subset of Covid variants that scientists have cheekily nicknamed “FLiRT,” drawn from the letters in the names of their mutations. They are descendants of JN.1, and KP.2 is “very, very close” to JN.1, said Dr. David Ho, a virologist at Columbia University. But Dr. Ho has conducted early lab tests in cells that suggest that slight differences in KP.2’s spike protein might make it better at evading our immune defenses and slightly more infectious than JN.1.

While cases currently don’t appear to be on the rise, researchers and physicians are closely watching whether the variant will drive a summer surge.

“I don’t think anybody’s expecting things to change abruptly, necessarily,” said Dr. Marc Sala, co-director of the Northwestern Medicine Comprehensive Covid-19 Center in Chicago. But KP.2 will most likely “be our new norm,’” he said. Here’s what to know.

The current spread of Covid

Experts said it would take several weeks to see whether KP.2 might lead to a rise in Covid cases, and noted that we have only a limited understanding of how the virus is spreading. Since the public health emergency ended , there is less robust data available on cases, and doctors said fewer people were using Covid tests.

But what we do know is reassuring: Despite the shift in variants, data from the C.D.C. suggests there are only “minimal ” levels of the virus circulating in wastewater nationally, and emergency department visits and hospitalizations fell between early March and late April.

“I don’t want to say that we already know everything about KP.2,” said Dr. Ziyad Al-Aly, the chief of research and development at the Veterans Affairs St. Louis Healthcare System. “But at this time, I’m not seeing any major indications of anything ominous.”

Protection from vaccines and past infections

Experts said that even if you had JN.1, you may still get reinfected with KP.2 — particularly if it’s been several months or longer since your last bout of Covid.

KP.2 could infect even people who got the most updated vaccine, Dr. Ho said, since that shot targets XBB.1.5, a variant that is notably different from JN.1 and its descendants. An early version of a paper released in April by researchers in Japan suggested that KP.2 might be more adept than JN.1 at infecting people who received the most recent Covid vaccine. (The research has not yet been peer-reviewed or published.) A spokesperson for the C.D.C. said the agency was continuing to monitor how vaccines perform against KP.2.

Still, the shot does provide some protection, especially against severe disease, doctors said, as do previous infections. At this point, there isn’t reason to believe that KP.2 would cause more severe illness than other strains, the C.D.C. spokesperson said. But people who are 65 and older, pregnant or immunocompromised remain at higher risk of serious complications from Covid.

Those groups, in particular, may want to get the updated vaccine if they haven’t yet, said Dr. Peter Chin-Hong, an infectious disease specialist at the University of California, San Francisco. The C.D.C. has recommended t hat people 65 and older who already received one dose of the updated vaccine get an additional shot at least four months later.

“Even though it’s the lowest level of deaths and hospitalizations we’ve seen, I’m still taking care of sick people with Covid,” he said. “And they all have one unifying theme, which is that they’re older and they didn’t get the latest shot.”

The latest on symptoms and long Covid

Doctors said that the symptoms of both KP.2 and JN.1 — which now makes up around 16 percent of cases — are most likely similar to those seen with other variants . These include sore throat, runny nose, coughing, head and body aches, fever, congestion, fatigue and in severe cases, shortness of breath. Fewer people lose their sense of taste and smell now than did at the start of the pandemic, but some people will still experience those symptoms.

Dr. Chin-Hong said that patients were often surprised that diarrhea, nausea and vomiting could be Covid symptoms as well, and that they sometimes confused those issues as signs that they had norovirus .

For many people who’ve already had Covid, a reinfection is often as mild or milder than their first case. While new cases of long Covid are less common now than they were at the start of the pandemic, repeat infections do raise the risk of developing long Covid, said Fikadu Tafesse, a virologist at Oregon Health & Science University. But researchers are still trying to determine by how much — one of many issues scientists are trying to untangle as the pandemic continues to evolve.

“That’s the nature of the virus,” Dr. Tafesse said. “It keeps mutating.”

TikTok challenges U.S. ban in court, calling it unconstitutional

TikTok's suit is in response to a law passed by Congress giving ByteDance up to a year to divest from TikTok and find a new buyer, or face a nationwide ban.

TikTok and its parent company on Tuesday filed a legal challenge against the United States over a law that President Biden signed last month outlawing the app nationwide unless it finds a buyer within a year.

In the petition filed in the Court of Appeals for the District of Columbia Circuit, the company said the legislation exceeds the bounds of the constitution and suppresses the speech of millions of Americans.

"Banning TikTok is so obviously unconstitutional, in fact, that even the Act's sponsors recognized that reality, and therefore have tried mightily to depict the law not as a ban at all, but merely a regulation of TikTok's ownership," according to the filing.

The law, passed through Congress at lightning speed, which caught many inside TikTok off guard, is intended to force TikTok to be sold to a non-Chinese company in nine months, with the possibility of a three month extension if a possible sale is in play.

Yet lawyers for TikTok say the law offers the company a false choice, since fully divesting from its parent company, ByteDance, is "simply not possible: not commercially, not technologically, not legally," the challenge states. "And certainly not on the 270-day timeline required by the Act."

Anupam Chander, a law professor at Georgetown University who specializes in technology regulations, said if TikTok loses this legal fight, it will likely shut down in the U.S.

"The problem for TikTok is that they have a parent company that has these obligation in China, but they're trying to live by free speech rules by the United States," Chander said in an interview. "The question is whether American courts will believe that that's even possible."

TikTok says law based on "speculative and analytically flawed concerns"

Lawmakers in Washington have long been suspicious of TikTok, fearing its Chinese owner could use the popular app to spy on Americans or spread dangerous disinformation.

But in the company's legal petition, lawyers for TikTok say invoking "national security" does not give the government a free pass to violate the First Amendment, especially, TikTok, argues, when no public evidence has been presented of the Chinese government using the app as a weapon against Americans.

According to the filing, the law is based on "speculative and analytically flawed concerns about data security and content manipulation — concerns that, even if grounded in fact, could be addressed through far less restrictive and more narrowly tailored means."

Constitutional scholars say there are few ways for the government to restrict speech in a way that would survive a legal challenge. One of those ways is if the government can demonstrate a national security risk. Also key, legal experts say, is the government showing the speech suppression was the least restrictive option on the table.

TikTok said Congress ignored less restrictive ways of addressing the government's national security concerns.

"If Congress can do this, it can circumvent the First Amendment by invoking national security and ordering the publisher of any individual newspaper or website to sell to avoid being shut down," the filing states. "And for TikTok, any such divestiture would disconnect Americans from the rest of the global community."

Since more than 90% of TikTok's users are outside of America, Georgetown's Chander said selling the U.S.-based app to a different owner would cannibalize its own business.

"You can't really create a TikTok U.S., while having a different company manage TikTok Canada," Chander said in an interview. "What you're doing essentially is creating a rival between two TikToks," he said. " It may be better to take your marbles out of the United States and hope to make money outside of the U.S., rather than sell it at a fire-sale price."

TikTok critics call app a 'spy balloon on your phone'

The filing sets off what could be the most important battle for TikTok. It has been fending off legal challenges to its existence since former President Trump first sought to ban the app through an executive order in the summer of 2020. That effort was blocked by federal courts.

Since then, Democrats and Republicans have shown a rare moment of unity around calls to pressure TikTok to sever its ties with ByteDance, the Beijing-based tech giant that owns the video-streaming app.

Trump's Ban On TikTok Suffers Another Legal Setback

Congress has never before passed legislation that could outright ban a wildly popular social media app, a gesture the U.S. government has criticized authoritarian nations for doing.

In the case of TikTok, however, lawmakers have called the app a "spy balloon on your phone," emphasizing how the Chinese government could gain access to the personal data of U.S. citizens.

Worries also persist in Washington that Beijing could influence the views of Americans by dictating what videos are boosted on the platform. That concern has only become heightened seven months before a presidential election.

Yet the fears so far indeed remain hypothetical.

There is no publicly available example of the Chinese government attempting to use TikTok as an espionage or data collection tool. And no proof that the Chinese government has ever had a hand over what TikTok's 170 million American users see every day on the app.

TikTok says it offers U.S. a plan that would shut app down if it violated agreement

TikTok, for its part, says it has invested $2 billion on a plan, dubbed Project Texas, to separate its U.S. operation from its Chinese parent company. It deleted all of Americans' data from foreign servers and relocated all of the data to servers on U.S. soil overseen by the Austin-based tech company Oracle.

While the plan was intended to build trust with U.S. lawmakers and users, reports surfaced showing that data was still moving between staff in California and Beijing.

In the filing on Tuesday, TikTok said it submitted an agreement to the Committee on Foreign Investment in the United States, which has been probing the app for five years, that would allow the U.S. to suspend TikTok if it violated terms set forth in a national security plan.

But, lawyers for TikTok say, the deal was swept aside, "in favor of the politically expedient and punitive approach," the petition states.

Mnuchin claims he will place a bid to buy TikTok, even though app is not for sale

Despite the new law giving TikTok the ultimatum of selling or being shut down, there are many questions around how the app could even be bought by another company or group of investors.

Former Treasury Secretary Steven Mnuchin told NPR on Monday, he is planning to assemble a group of investors to try to purchase TikTok without the app's algorithm.

Mnuchin, who declined to answer additional questions, said in between sessions at the Milken Institute Global Conference in Los Angeles that the proposal to buy the app is still in the works, but he would not say when it would be formally submitted.

One major obstacle in any possible sale of TikTok is a glaring problem: The app is not for sale.

Despite the new law in the U.S., ByteDance says it does not intend to let go of the service. Furthermore, winning the support of China would be necessary, and officials in Beijing are adamantly against any forced sale.

In 2020, amid the Trump administration's clamp down on the app, China added "content-recommendation algorithms" to its export-control list, effectively adding new regulations over how TikTok's all-powerful algorithm could ever be sold.

ByteDance, not TikTok, developed and controls the algorithm that determines what millions see on the app every day. The technology has become the envy of Silicon Valley, and no U.S. tech company has been able dislodge TikTok's firm hold on the short-form video market. Experts say key to its success is its highly engaging and hyper-personalized video-ranking algorithm.

The algorithm, which involves millions of lines of software code developed by thousands of engineers over many years, cannot be easily transferred to the U.S., even if China did allow it, TikTok's challenge states.

Lawyers for TikTok argue that "any severance [of the algorithm] would leave TikTok without access to the recommendation engine that has created a unique style and community that cannot be replicated on any other platform today."
