UK Spouse Visa

Checklist of documents for the UK Spouse visa, financial requirements, english langauge proficiency, the application process and more details.

British citizens and settled persons who have a spouse living outside the United Kingdom can take them to the UK through the Spouse Visa, which falls under the Family visa category. The UK spouse visa, also known as Marriage Visa in the UK, is a UK family visa , and it is the type of visa you will need if you want to enter and remain in the UK to live with a partner (spouse/fiance) for more than 6 months.

Do I Qualify for the UK Spouse Visa?

To qualify for the UK Spouse visa, the UK resident, and the applicant that wants to join them in the UK, both must fulfill some criteria set by the Immigration Authorities in the UK. The main condition for the Spouse visa is that both, the resident and the applicant must be over 18 since the British law does not recognize marriages under the age of 18. The other eligibility criteria are as follows:

  • The person you want to join must be a British citizen.
  • Your marriage or civil partnership must be recognized in the UK.
  • Your relationship must be at least two years old when you apply (this is to prevent arranged marriages which the British law does not recognize).
  • If you are a fiance you must show proof you will marry within 6 months.
  • If you are a proposed civil partnership you must show proof that within 6 months, you will be entering into a civil partnership.
  • The partner living in the UK must meet the financial requirement.
  • The applicant must meet the English language requirements.

Relationship Legitimacy for UK Spouse Visa

In order for you to be eligible for a UK Spouse Visa, your relationship must be recognized by the UK authorities. This is the first part of your application towards obtaining a UK visa.

Clarifications of terms

Registered Marriages The applicant and the UK resident need to submit the marriage certificate issued by the government or other formal governments from other countries, as evidence of a registered marriage.
Civil Partnership Civil Partnership is called the relationship between a same-sex couple. Though not recognized as a marriage, the Civil partnership couples have the same rights as married couples.
Traditional Marriages Traditional marriages that are not registered are not legally recognized, therefore these relationships must be registered at Home Affairs.
Fiancé, fiancée or proposed civil partner If you’re applying as a fiancé, fiancée or proposed civil partner, you will have to submit proof that your previous marriage(s) or civil partnership(s) have ended, if any. And also you will have to show proof that you plan to marry your partner within 6 months of arrival in the UK.

Further detail

How long does it take to get indefinite leave to remain.

Individuals will need to hold the UK Spouse Visa for 5 years to get Indefinite Leave to Remain.

ILR, sometimes referred to as Permanent residence, can be applied for after having held the this visa for a minimum period of 5 years. ILR can be applied for at the earliest opportunity 28 days before the 5 year period is complete. For individuals looking to move to the UK to start a new life with their family, the UK Spouse Visa is often the first logical step for making this a reality.

Find out more about Indefinite Leave to Remain in the UK.

How can you apply for British Nationality?

How soon you can apply for British nationality depends on if your sponsor is British or not. If they are, you can apply for British citizenship as soon as you have obtained your ILR and lived in the UK for a minimum of 5 years. If your sponsor is not British but just has ILR, then you need to wait a further 12 months after your ILR was granted before you can apply for a British passport.

UK Spouse Visa Requirements

There are 5 main Spouse Visa requirements which we will break down in more detail below:

  • Adequate Accommodation
  • English Language ability
  • Genuine relationship
  • Tuberculosis screening (if applicable)

Please note that this guide does not deal with issues around general grounds of refusal, as such if you have an entry ban or suspect you may be refused for general grounds of refusal such a criminal record, please contact us for further advice.

Spouse Visa Financial Requirements

1.1 how to meet the financial requirements.

The Financial Requirement of the Spouse visa application tend to be the most complex and document heavy. It is critical for applicants to meet the minimum income threshold and provide the exact corresponding evidence in order to satisfy this requirement. For the purpose of this guide we will go over some of the common ways to meet the financial requirements, if you do not meet examples below please consult with us as it is likely that there still is a way for you to meet the financial requirement

Firstly a calculation needs to me made on what the minimum income shall be, the starting point is always £18,600.

This value will increase if you wish to include any children whom are under 18 and are not;

  • British Citizens, or
  • Hold Indefinite Leave to remain, or
  • Are EEA nationals

If the are not then the minimum income will increase by;

  • £3,800 for the first child included, and
  • £2,400 for each additional child thereafter.

If you require further assistance with the UK Spouse Visa financial requirements, our team are happy to help.

1.2 Whose income can be used for the Spouse Visa application?

As a general rule of thumb if applying for entry clearance (I.e you are applying from outside the UK) then only the sponsor can show their income to meet the financial requirements. If applying to vary your visa or extending your current visa then both the sponsor and the applicant can show their income.

What sources of income are accepted?

The accepted sources of income can be broken down in to 5 broad groups:

  • Salaried or non-salaried employment income
  • Self-employed income or income as a Director from a UK company
  • Cash Savings
  • Non-employment income (eg property rental income from shares or interest from savings)
  • State or private pensions

Each of the above groups have their own specific sets of rules and required documentation.  Furthermore not all income sources may be combined with each other; e.g. Self-employed income cannot be combined with cash savings.

Furthermore it is noted that the following categories can only be shown by the sponsor unless the applicant also has permission to work in the UK:

  • Self-employed income or income as a Director

1.3 What income cannot be used?

The following types of income are not accepted as valid income for the Spouse visa application:

  • Financial support from third parties such as family or friends (child maintenance and gifts of cash savings that meet the savings requirements may be accepted)
  • Credit or other types of loans
  • Income assessed benefits such as; Housing benefit, Jobseeker’s allowance and Income Support etc
  • Child benefit, Child Tax credit, Universal Credit or other similar types of benefits
  • Any other income source not part of the five approved income sources

It is noted that receiving these benefits does not stop you from sponsoring your partner, it just means the money that you receive is not counted towards the minimum income you receive.

If you're unsure whether you meet the financial requirements, please get in touch so our team can assist you.

1.4 How long do I have to be earning  the required amount?

  • if you have been in your job for longer than 6 months then you only need to show the equivalent value over the last 6 months .
  • If you have been in your job for less than 6 months then you need to show that you earned the minimum amount over the last 12 months
  • For Savings you need to show that you held the funds for a minimum period of 6 months (see the cash savings section below for further details)
  • For Non-employment, you would need to show the last full tax year
  • For Self-employed and Income as a Director, then you would need to show the most recent completed tax year or the average over the last 2 financial years.

For Pensions an annual amount can be used providing it has been in receipt for at least 28 days.

1.5 What if my sponsor is currently living outside the UK?

If you are living with your partner outside the UK and you plan to re-enter the UK together then the rules vary. You can still rely on all five of the income sources mentioned earlier however for salaried and non-salaried employment the rules are different as it would require the sponsor to have a job offer in the UK.

Only the salaried or non-salaried income of the sponsor will be counted, there is a two step process to meet in order to satisfy the requirement;

Step 1: The Sponsor would demonstrate their current employment income meet the minimum income requirement, either over the last 12 months if they have been in their job for less than 6 months or just the last 6 months if they have been in their job for more than 6 months.

Step 2: The Sponsor would need to show that they have a job offer in the UK, which would give them an income reaching the minimum income requirement. This job would need to start within 3 months of their entry to the UK.

If your sponsor is living outside of the UK and you need assistance with the financial requirements of the Spouse Visa, please get in touch.

1.6 How does cash savings work?

Yes, savings held in the name of the sponsor, the name of the applicant or jointly between the two can be used. Savings can be used fully satisfy the income requirement or to cover any short fall in your income.

Please note that only cash savings are accepted, this means that property or assets are not recognised unless they are sold and held as cash.

It is not however as simple as just providing the missing amount from your income as the exact cash amount. The calculation is as follows:

(Required Income total minus actual income) x 2.5 (the length of the visa) + £16,000 = Savings total required.

Please note that cash savings must be held in cash at the point of application, the cash must have been held as a minimum balance.

Our team of lawyers are experienced in collating the evidence needed to prove that you meet the financial requirements of the Spouse Visa. If you need any assistance, please get in touch.

UK Spouse Visa Accommodation Requirements

The second requirement of the visa is that you can demonstrate that there is adequate accommodation for you, your sponsor and any children in the UK. You will be required to show accommodation documents which prove that your residence meets the criteria.

For this requirement you must first demonstrate your right to reside in the specified property, this may be because:

  • You or your partner own the property
  • You or your partner are renting the property
  • You are staying with friends and family whom have a big enough property

The property itself must not be deemed as overcrowded, this is based on the Housing Act 1985 and depends on the number of rooms in the property compared to the number of people living in the property. A room does not specifically need to be a bedroom, so long as it is not a Kitchen or Bathroom.

Here is a quick guide to overcrowding:

Number of Rooms Maximum number of people that can live in the property
1 2
2 3
3 5
4 7.5
5 10

For any properties of more than 5 rooms, an additional 2 persons per room can reside in the property. Children under 12 months are not included as a person and children between 1 and 10 years are considered half a person.

English Language Requirement

There is an English language requirement for the Spouse Visa, which means all applicants must be able to demonstrate their ability to speak English.

This can be done in three ways:

Citizen of a majority English speaking country.

If you are from one of the following countries then your passport will automatically prove your English language ability:

  • Antigua and Barbuda
  • The Bahamas
  • New Zealand
  • St Kitts and Nevis
  • St Vincent and the Grenadines
  • Trinidad and Tobago

Having an undergraduate degree or a higher qualification.

If you have passed an Undergraduate Degree, a Masters or a PhD from a UK colleague or University then this can be used to demonstrate your English language ability for the Spouse Visa.

If you have obtained a degree from a non-British institution but the course was taught in English then your qualification may still be accepted, however you need to obtain a certification from UK NARIC , an organisation which will check if your degree is the equivalent of a UK degree.

Taking an English Test

The final way you can prove you meet the English language requirement for the Spouse Visa is by passing an approved English language test. The test consists of English reading, writing, speaking and listening tasks to test understanding and proficiency. Only specific types of test providers, test types and test centres are accepted, as such it is important to double check that you are taking the right test.

The UK approved test list can be found here .

The required test categories are only Speaking and Listening at level A1 or higher. As such the most popular test to take is IELTS Life Skills A1, A2 or B1. There is no minimum mark to achieve on these test as they are only pass/fail. Although IELTS for UKVI General training or Academic is accepted they are not necessary for this visa category.

It is noted that the applicant must have passed the test before they submit their visa application.

However, if you are not from a majority English speaking country then there are two ways to prove your skills;

Genuine Relationship

This section of the application requires the applicant and sponsor to show that they are in a genuine ongoing relationship as husband and wife. What this means is that you will need to prove that you have legally married, but most importantly you must show that your relationship is genuine and on-going as would be expected from a husband and wife.

There is no genuine relationship test for applicants, but you will be required to demonstrate using documents that you have met, that you still meet when possible, that you communicate regularly and in some cases share responsibilities. The longer your relationship has been going the more documentation you should have.

The following documentation can be included as proof of your relationship:

  • Your marriage or civil partnership certificate, or equivalent.
  • A divorce certificate if you or your partner were previously married.
  • Evidence of cohabitation, for example a bill or a letter in a joint name.
  • Statements from family members or friends who can attest to the fact that the relationship is legitimate.
  • Personal possessions such as travel itineraries showing trips that you and your partner have taken together.
  • Photographs of your relationship showing its chronology.
  • Evidence of ongoing communication between yourself and your partner such as call logs or social media exchanges.

Migrants who have been married for a short period of time or have for cultural or religious reasons are not barred from applying, instead this needs to be carefully explained to the Home office together with sufficient evidence of a genuine relationship.

Tuberculosis Test

If you are applying from a country that is listed on Appendix T as a country where TB is at high risk, the applicant must obtain a certificate from an approved test centre to confirm they are free from TB. Before applying.

How long does the application process last?

The UK Spouse Visa Processing time can vary from country to country and time of year.

From inside the UK, the application timeline is 8-12 weeks. Individuals can use the 24 hour priority service if the normal service is too long. Internationally processing times can range from 4-16 weeks. Some countries have priority services which can reduce the time to between 2-6 weeks.

How to apply for a Spouse Visa

The application process will vary depending on if you are in the UK or outside the UK, however in general the application timeline will include:

  • Step 1 - Submit an online UK Spouse Visa application form with your details.
  • Step 2 - Pay to finalise your application and book a face-to-face submission appointment.
  • Step 3 - Attend your face-to-face submission appointment and provide your biometric information.
  • Step 4- Provide any original documents which are requested at your face-to-face appointment. Alternatively you may be asked to post your documents to a specific location.
  • Step 5 - The processing of your Visa is started by the Home Office.

What happens after the visa is granted?

The applicant will receive their passport with a 30 day entry visa. It is important to enter the UK within this time period as the full visa is issued on a Biometric card that can only be picked up in the UK. Once the Biometric card has been collected then you are free to enter and exit the UK as you please.

What Are the New Spouse Visa Requirements in 2024?

As of April 11th, 2024, the new Spouse Visa Financial requirement has officially changed from £18,600 to £29,000. This means that if you want to sponsor your foreign partner on any UK family visa route from now onwards, you now must meet this new financial requirement.

Table of Contents

This rule was first put into play in December 2023 by the UK Conservative-led government, which decided to drastically change the financial thresholds of the Spouse Visa and all other UK Family Visas, making applications much harder so they can reduce immigration figures.

In this article, our UK immigration experts will explain the new spouse visa requirements and how they will change again in 2024. We will also discuss everything from basic requirements to the application process for the UK Spouse Visa in 2024. Whether you are applying from within the UK or outside, our expertise and services have you covered.

Understanding the UK Spouse Visa Financial Requirements in 2024

When the price of immigration applications changes, this can certainly cause some confusion, especially when it impacts areas like family and spouses. That is why it is very important to understand the new rules so that you do not waste any time or money submitting an application that will not succeed due to the new rules. For any information that this article does not cover, you can contact our spouse visa experts, who can advise you and help you understand the process first-hand and submit the application on your behalf.

What Are the Current Financial Requirements Of the UK Spouse Visa?

Fulfilling the financial conditions for a UK Spouse Visa is a crucial part of the application process. The sponsor and the applicant must prove their financial stability to ensure that they can sustain themselves and any dependents without assistance from the government. Here’s a comprehensive look at the financial criteria:

The current financial requirement for UK Spouse Visas is £29,000 as of April 11th 2024. For the most recent information on how to fulfil these financial requirements through income, savings, pensions and investments , we encourage you to read our page on family visa financial requirements or get in touch with us.

Under the current rules, if a couple has children or other dependants, the threshold increases:

  • For the first child, an additional £3,800
  • For each additional child, an extra £2,400

However, under the new financial rules, when the financial requirement rises in April, the costs for children may be stopped. It is yet unclear. However, we will update you once the information is public.

Acceptable Sources of Income

The income can come from various sources, including:

  • Employment Income : Both from the sponsor’s employment within the UK and the applicant’s lawful employment outside the UK.
  • Savings : A certain amount of savings can offset the current income requirement. As of April 11th 2024, the amount is £88,500.
  • Pension : Includes both state and private pensions.
  • Self-Employment : Profits from a business can be considered if properly documented.
  • Rental Income : From properties owned, excluding the couple’s main residence.
  • Dividends from Investments : If they are consistent and can be verified.

For more info on how to meet the application through savings and other means, read our article here ,

Will the Spouse Visa Financial Requirements change again in 2024?

Spouse Visa Financial Requirements can change at any moment.

“A Spouse visa is required for a British citizen or settled resident wanting to bring a spouse, and potentially children, to live in the UK together. The minimum income required to sponsor a foreign spouse coming to the UK via the Family Visa scheme has now increased from £18,600 to £29,000. With the new Labour government now in office, it’s important to stay informed as the visa application requirements and policies could change once again. Our team is here to provide up-to-date guidance and support to help you navigate these potential changes. Contact us to learn more about how we can assist with your family visa application.” Dr Bernard Andonian – UK Immigration Solicitors and Former Immigration Judge

How to avoid meeting the new 2024 spouse visa financial requirement?

The only way to avoid additional hikes in the financial requirement criteria is to apply now. This is because the further increases in financial thresholds, which are set to transform the UK Spouse Visa Route once again in the coming months, may limit your eligibility. Based on this, our spouse visa lawyers advise that you act fast if you are planning on making a spouse visa application and process it as soon as possible to avoid being subjected to the rising financial thresholds that are set to come into effect later in the year.

To get your application started immediately or to speak with a spouse visa expert, pls do not hesitate to contact us.

Why is the financial requirement changing?

The spouse visa financial requirement is changing because the current UK Conservative government wants to reduce the UK immigration figure from over 6000,000 to under 300,000, a plan unveiled by Jame Cleverley from the Home Office in late December 2023.

What if my application fails because I do not meet the New Financial requirements for Spouse visas?

If your Spouse Visa is refused based on financial grounds, it’s essential to understand your options and the steps you can take to address the refusal. Here are some strategies and considerations:

The refusal letter from the Home Office will detail why your application was denied. Understanding the specific reasons for the financial refusal is crucial for determining your next steps.

If you do, in fact, meet the criteria and the refusal was due to a mistake and occurred because you were missing documents or incorrect financial information, you might be able to rectify the issue and reapply.

If you were refused because you were close to meeting the financial requirement but fell a bit short at the end, consider ways to increase your income or savings to meet the threshold legitimately. This could involve securing a higher-paying job, adding savings to meet the cash savings requirement, or including permitted additional sources of income.

If your application was refused because the Home Office was not satisfied with the financial evidence provided, look into submitting alternative evidence that clearly demonstrates you meet the financial requirement. This might include more detailed bank statements, additional payslips, or letters from employers.

Seek professional advice from an immigration lawyer who can assess your refusal and advise on the best course of action. They can help you identify any errors in the Home Office’s decision, advise on the viability of making a new application, or whether to appeal the decision if an error of law is identified.

Remember, each Spouse Visa refusal based on financial grounds has its unique context and reasons. It’s important to approach your next steps with a clear understanding of the refusal reasons and a strategy to address them effectively.

Benefits and Privileges of Holding a UK Spouse Visa

Holding a UK Spouse Visa brings forth a wide range of benefits that facilitate the transition into UK life:

  • Right to Work: The visa holder can enter the UK and seek employment or start a business without any restriction, thus making it easier to work on a spouse visa.
  • Access to Education: The visa permits access to public and private educational institutions, enabling academic growth and skill development.
  • Healthcare Benefits: With the UK Spouse Visa, you are entitled to use the NHS, the UK’s public healthcare system, ensuring medical security.
  • Potential Pathway to Citizenship: After living in the UK for a certain period on the spouse visa, you may become qualified to apply for indefinite leave to remain. It is a process that can help the applicant to settle in the UK.

Other requirements needed to make a successful Spouse Visa Application

To qualify for a spouse visa, besides meeting the financial requirements, you need to fulfil various requirements, including meeting the English language requirement, accommodation requirements, and more.

Here’s a detailed breakdown of each aspect with the most up-to-date information for making a Spouse Visa Application in 2024.

1. Sponsor Status and Age Requirement

When it comes to the UK Spouse Visa application, the sponsor’s status is a critical element. The sponsor must be a British or Irish national or have settled status, such as ILR within the UK. Alongside this, the applicant’s requirements must also be met, which include:

The sponsor and the applicant must be at least 18 years old to qualify for a UK Spouse Visa. This ensures alignment with the legal marital age in the UK. Sponsor status is a foundational aspect of the UK Spouse Visa application process and must be understood in conjunction with other requirements.

2. Relationship Requirement

An authentic and ongoing relationship is the cornerstone of a successful UK Spouse Visa application. This requirement confirms the authenticity of the connection between the sponsor and the applicant. The relationship requirement ensures that the UK Spouse Visa supports genuine couples intending to build their lives together in the UK.

3. English Language Requirement for a UK Spouse Visa

personal statement for spouse visa uk

English language requirements must be met to apply for the UK spouse visa. The applicant must exhibit a fundamental command of the English language at the A1 CEFR level if applying for entry clearance as a spouse.

Applicants must take a test with an approved provider. Common tests include:

  • IELTS for UKVI : A special version of the IELTS exam tailored for UK Visas and Immigration.
  • Trinity’s ISE : A test offered by Trinity College London at various UK locations.

The scores required will depend on the test, and the provider’s guidance should be followed. Some applicants may be excused from the requirement, such as:

  • Those aged 65 or over
  • Applicants whose mental or physical state prevents them from fulfilling the requirement.
  • Nationals from the majority of English-speaking countries

4. Accommodation Requirement for the UK Spouse Visa

An essential UK Spouse Visa requirement is the provision of suitable accommodation. The applicant and sponsor must show that they have adequate accommodation available for themselves and any dependents that are not overcrowded per the Housing Act’s standards. It must be free from public health hazards.

Living with others is possible, provided there’s exclusive use of sleeping rooms and no overcrowding. However, temporary places like hotels can’t typically be used as evidence of accommodation.

Document Checklist: Spouse Visa Supporting Documents

To apply for a spouse visa in the UK, you will have to present a number of papers, including the following:

  • Passport : Valid passport or other travel documents.
  • Proof of Relationship : Marriage certificate or evidence of a genuine relationship.
  • Financial Evidence : Pay slips, bank statements, proof of savings, etc., to meet the financial requirement.
  • English Language Test Results : If applicable, from an approved provider.
  • Accommodation Evidence : As discussed earlier.
  • Tuberculosis (TB) Test Results : If applying from certain countries.
  • Previous Immigration History : Any previous visas, refusals, or immigration correspondence.
  • Sponsor’s Information : Including their passport, employment details, etc.
  • Children’s Documents : If children are included, their birth certificates and other necessary information.
  • Photos : Passport-sized photographs meeting the UK specifications.
  • Online Application Form : Properly filled and submitted.

Understanding the document requirements, ensuring that all the essential documents are properly organised, and providing clear and accurate information are essential for the success of the UK Spouse Visa application.

  • Addressing the Requirements : Carefully answer questions about the financial and English language requirements, relationship status, and accommodation arrangements.

What if My Spouse’s Visa is Refused for other reasons?

A refusal of a UK Spouse Visa, whether it be based on finances or not, can be catastrophic, but that doesn’t imply you have to leave the UK or can’t come to the UK. Understanding the reasons and the next steps after a denial can make the situation more manageable.

If your UK Spouse Visa was refused for another reason besides finances, it may have been because of:

  • Insufficient Evidence: Failing to provide enough evidence to meet the requirements for a UK Spouse Visa, such as having adequate accommodation o r relationship evidence.
  • Mistakes in the Application : Errors in the application form or incorrect documents are provided.
  • Failure to Meet English Language Requirement : Not being able to fulfil the required level of English language mastery.
  • Concerns About the Authenticity of the Relationship : If the authorities believe that the relationship is not genuine.

How can I Appeal or Overtun a Spouse Visa Refusal?

If the UK Spouse Visa application is refused, you may have the right to appeal or request an administrative review. Here are the general steps:

  • Understand the Refusal Letter : Carefully read the refusal letter to understand the exact reasons.
  • Consider Professional Legal Advice : A solicitor specialising in UK visas and immigration may be helpful.
  • Prepare the Appeal : Gather the necessary evidence to counter the reasons for refusal.
  • Submit the Appeal : Follow the guidelines in the refusal letter to raise the appeal or administrative review.
  • Wait for a Decision : Appeal decisions can take several months.

In some cases, it may be wise to explore alternatives such as:

  • Fiance Visa : If planning to marry in the UK.
  • Unmarried Partner Visa : If you have lived together in the UK for at least two years.
  • Reapplying : After addressing the reasons for refusal, you may choose to submit a new UK Spouse Visa application.

Depending on what the home office letter says, you may even be able to submit a free application by providing more robust evidence to support your case. In any case, understanding the reasons for refusal and taking swift action can have a significant impact on the outcome. As dealing with a refusal can be complex, it’s wise to seek legal advice.

You Ask, We Answer

Faqs about the uk spouse visa updates.

The current conservative government aims to reduce net migration by approximately 300,000, as it was estimated at 672,000 in the year ending June 2023. The increase is part of efforts to reduce these numbers further.

The income requirement for UK spouse visa applicants is set for several increases. It has already experienced a staunch rise from £18,600 to £29,000 in April 2024. Later in 2024, it will increase to about £34,500, and by early 2025, it will reach approximately £38,700.

The increase from £18,600 to £38,700 represents an over 200% rise. The Home Office aligns these thresholds with UK earnings percentiles, with the new figures representing the 25th, 40th, and 50th percentiles of earnings for RQF3 skill-level jobs.

Yes. According to the House of Commons Library, Immigration Rule changes typically become effective automatically unless opposed by the House of Commons or Lords within 40 days, which is not a common occurrence.

No, these changes will only affect new applicants. Current applicants, including those applying before the increase and children joining parents in the UK, will be assessed under the current requirements. The same applies to those on a fianc(é)e visa applying for a spouse visa.

Individuals on different visa types who wish to switch to the five-year partner visa route must meet the new income requirement once it becomes effective.

It’s possible that under the new rules, there may not be additional financial requirements for children, but this is still to be determined.

Those currently on a spouse visa applying for ILR are expected to be exempt from the new threshold. Further details will be provided in the Home Office’s “transitional provisions”.

There are no specific exemptions mentioned for the financial requirements of a UK Spouse Visa. Applicants must meet the minimum income threshold, which varies depending on whether they have dependents.

The new policy restricts most students from bringing dependants to the UK. This change is expected to reduce the number of dependants accompanying students significantly.

Under the new immigration rules announced by Home Secretary James Cleverly on December 4th, 2023, care workers will no longer be allowed to bring family members to the UK. This change is part of the broader strategy to reduce net migration.

The immigration health surcharge increased from £624 to £1,035 per year starting January 2024. This rise will affect Spouse Visa applicants starting in January and will be the new mandatory fee for accessing the UK’s National Health Service (NHS).

Those considering a UK spouse visa should consult an immigration solicitor as soon as possible to understand their options and prepare for the upcoming changes on April 11th, 2024.

Yes, the family visa requirements in the UK, like many immigration policies, are subject to change and can be influenced by the outcomes of political elections. If a different party wins an upcoming election and forms a government, they may have different views and policies regarding immigration and may change the financial requirements as a result of this.

Spouse Visa Financial Requirement and Exemptions 2024

Spouse Visa Financial Requirement and Exemptions 2024

Amar Ali Immigration Solicitors

By Amar Ali, Immigration Solicitor

Last updated: 11 April 2024

If you plan to apply for a UK spouse visa, one of the main eligibility criteria you will need to meet is the spouse visa financial requirement. The current spouse visa financial requirement is that you must have a combined income with your partner of at least £29,000 per year. However, if you applied for a fiancé, fiancée or proposed civil partner visa before 11 April 2024, you will only need to meet the previous £18,600 income threshold.

According to the latest Home Office policy paper 1 , the spouse visa minimum income requirement will continue to increase in phases to £38,700 (starting at £29,000, then progressing to £34,500, and ultimately reaching £38,700).

How to meet UK spouse visa financial requirement

The financial requirement for a spouse visa can be met in a number of ways, but typically, this is either through income or cash savings, or a combination of the two. If you have enough savings, you may be able to reduce or even fully meet the annual income requirement. For more detailed information, please find below the section “Cash savings for spouse visa”. If the applicant has children, there will be no longer additional income requirement.

Everyone’s circumstance is different. Our immigration lawyers will provide advice and guide you on how to meet the requirement if you need help applying for a Spouse Visa. Contact us for a free consultation by callin g at 020 3744 2797

Income requirement for spouse visa

The minimum income requirement for a spouse visa (income threshold for spouse visa) is £29,000 per year at the moment. To prove your income, the most common method is to provide payslips. If you have been with your current employer for 6 months or more, you should submit payslips covering the last 6 months. If you have been with your employer for less than 6 months, or if your income varies, you will need to provide 12 months of payslips.

Additionally, there are other types of proof of income that can be used to meet the financial requirement. Please see the summary below for further details

Income from employment

Income from self-employment

For the last financial year:

Income received as the director of a limited company in the UK

For the last full financial year:

Cash savings in excess of £16,000

Money received from a pension

Official documentation from:

Non-employment income (e.g. property rental or dividend income)

Rental income:

Dividend income:

£88,500 cash savings for spouse visa (used to be £62,500)

You can meet the spouse visa financial requirements by solely relying on cash savings, provided you have at least £88,500 available (up from the previous requirement of £62,500). Using savings to meet the spouse visa requirements offers the advantage of not needing to demonstrate evidence of ongoing income, as long as you have sufficient funds. However, you still need to meet cash saving requirements, such as:

  • The money is held in a bank/savings account in a current, deposit, or investment account
  • The money has been held for at least 6 months prior to applying, as evidenced by your bank statements
  • The account is with a properly regulated financial institution
  • Regular bank statements are provided
  • The savings are held in cash and can be immediately withdrawn (with or without penalty)
  • The savings are under your control and/or of your partner and have been for 6 months
  • The source of the funds is legal
  • The source of the funds has been declared

Savings held in a term deposit or ISA can be used as long as you can access them immediately.

One of the benefits of using savings to meet the financial requirement for a spouse visa is that if you have enough funds, you will not need to show evidence of ongoing income. If you are relying solely on savings to meet the spouse visa financial requirements, you will need at least £88,500 in cash savings. To calculate the effect of your savings on meeting the financial requirement, you will need to:

  • Minus £16,000 from the amount of savings you hold
  • Divide the remaining sum by 2.5 (2.5 is the number of years that your initial spouse visa will be granted for)

For example:

£88,500

(88500 – 16000) ÷ 2.5 = £29,000

£0

£60,000

(60000 – 16000) ÷ by 2.5 = £17,600

£11,400

£33,000

(25000 –16000) ÷ 2.5= £6,800

£22,200

£25,000

(17500 – 16000) ÷ 2.5= £3,600

£25,400

£17,500

(17500 – 16000) ÷ 2.5 = £600

£28,400

Based on the table above, if you have £33,000 in savings, this will reduce the annual income requirement by £6,800 (i.e. £29,000 - £6,800 = £22,200), meaning you will only need £22,200 per year from other sources of income. If you have £88,500 in savings, you will fully meet the income requirement of £29,000.

Spouse visa financial requirement exemptions

Some spouse visa applicants may be exempt from meeting the financial requirement, including individuals who receive specific types of public funds or benefits due to their circumstances, such as Personal Independence Payment, Disability Living Allowance or Carer’s Allowance.

Even if you are eligible for the spouse visa financial requirement exemption, you will still need to prove that you have sufficient funds for your stay in the UK without needing access to public funds and that you can adequately accommodate yourself.

In addition, if you do not meet the financial requirements or qualify for an exemption, you may still be eligible for a spouse visa if you can prove that exceptional circumstances apply. Exceptional circumstances may apply, for example, if you can prove under Article 8 of the European Convention of Human Rights (ECHR) that there will be “unjustifiably harsh consequences” for you and/or your family if your spouse visa is refused. In this scenario, the UKVI decision-maker may take into account other sources of income (e.g. a guarantee of financial assistance from another person).

If you’re a UK citizen looking to apply for a visa for your spouse, you’ll need to write a Spouse Visa Cover Letter Sample to accompany your application.

Writing a good letter is essential to getting your application approved, so taking time and understanding the process is important. This blog post will provide all the information you need to know about writing a spouse visa cover letter sample in the UK.

We’ll look at what to include in your letter, what format to use, and how to make sure your letter is successful.

Why a Cover Letter is Important for a Spouse Visa Application

When applying, a UK spouse visa sponsor letter sample is important to include in your application package. Here are some reasons why:

Demonstrate your intentions:

A letter allows you to outline the purpose of your application and why you want to live with your spouse in the UK. It can demonstrate your commitment to the relationship and your intention to abide by the immigration rules in the UK.

Highlight the strengths of your application:

In addition to providing an overview of your relationship and intentions, a letter can also highlight the strengths of your application. This includes outlining your financial situation, employment status, and accommodation plans.

Clarify any issues:

A spouse visa cover letter sample can also be useful for clarifying any issues or potential concerns that the visa officer may have. For example, suppose you have gaps in your employment history or have been previously refused a visa. In that case, a letter can help explain these issues and provide additional information.

Provide context for supporting documents:

When you apply for something, a letter can help explain why you are sending the other papers. You can use something to help make sure the person who gives you a visa knows your story.

Overall, a UK Spouse Visa Cover Letter Sample can play an important role in your application. If you want to get a visa, it is important to give the visa officer all the details they need to make the right decision.

Dos and Don’ts of Writing a Cover Letter

Writing a letter is hard because you have to know the rules. When applying to the UK, you should write a letter to your spouse. Here are some tips to help you write a good letter.

  • Do address the letter to the Entry Clearance Officer (ECO): When you write a letter, make sure you write the name of the person you want to read it so they can look at it.
  • Be concise and clear: Make sure your letter is brief and to the point while still addressing all the necessary information. Use clear and simple language that is easy to understand.
  • Highlight your relationship: Show pictures or letters that prove you and your spouse love each other.
  • Do explain your circumstances: If any particular circumstances affect your application, such as health issues or financial difficulties, explain them clearly in the letter.
  • Proofread your letter: Check it for spelling and grammar mistakes and ensure it is free of errors before submitting it.
  • Don’t include unnecessary information: Keep your letter concise and relevant to your application. Do not include information irrelevant to your application, such as your employment history or travel plans.
  • Don’t use overly emotional language: While it is important to convey your feelings, it can make your letter appear less professional.
  • Don’t make false claims: Be truthful and honest in your letter. Making false claims or exaggerating your circumstances can negatively impact your application.
  • Don’t forget to provide evidence: Provide supporting evidence for any claims you make in your letter, such as photographs or correspondence.
  • Don’t forget to sign and date the letter: Make sure to sign and date your letter before submitting it, as this shows that you have read and understood its contents.

Following these dos and don’ts can help you write an effective spousal visa extension letter for your UK application. Writing a good letter can help you get what you want!

Common Mistakes to Avoid When Writing a Spouse Visa Letter

Writing a letter for a spouse application is hard and if you don’t do it right, it could stop your application from being accepted. Here are some common mistakes you should avoid when writing your spouse letter:

Not Including Your Contact Information:

You need to write your name, phone number, email, and home address in the letter. This will enable the UKVI to contact you in case of any further queries or issues.

Not Addressing the Letter to the Correct Person:

Always address your letter to the correct person or department. Don’t use ‘To Whom It May Concern’ when you’re applying for something. It looks like you’re not taking it seriously.

Including Irrelevant Information:

When writing a letter, you should only write about yourself, your partner, and how you two are connected. When writing something, only include important information about yourself and don’t add things that are not related.

Using Generic Language:

When writing a letter to your spouse, make it special and different. Don’t use words that everyone else is using. Make sure you use your own words and convey your relationship’s authenticity.

Being Overly Emotional:

When you write a letter to someone you love, tell them how you feel but don’t get too emotional. You should maintain a professional tone while explaining your relationship.

Submitting the Wrong Document:

Check twice to make sure you gave the right papers for your partner’s application. You need to put a letter, copies of your passport, and other papers with your application.

Great! The best guidance on a spouse visa cover letter for UK applications. One additional suggestion I would make is to consider, it could benefit from addressing the importance of addressing potential red flags or concerns upfront in the cover letter and providing proactive explanations or mitigating factors. This proactive approach can enhance transparency and credibility in the application process. Collaborating with Passport Legacy could provide applicants with additional expertise and guidance, enhancing their chances of a successful visa application.

Sample Bank Proof of Funds Letter for UK Spouse Visa

Hi Visa Matchers! For those looking to obtain a UK Spouse Visa, satisfying the financial requirement is a key hurdle. Even for my wife, who is a lawyer, it was imperative for us to have a good understanding of this requirement to avoid any issues during our visa application process.

To help the Home Office confirm your financial status, they require applicants to declare the source(s) of their cash savings in their application. This confirms that you have sufficient funds to support yourself and your partner without relying on public funds.

Here is a sample letter of how UK Spouse applicants can confirm their source of funds. We used this template to successfully receive our Spouse Visa!

NOTE: The sources of funds in this template may be different from yours

Template: Bank Proof of Funds Verification Letter

If you require further information, please contact me at [PHONE NUMBER] or email me at [EMAIL].

Yours sincerely,

[SPONSOR’S FULL NAME]

What Should Be Included In a Bank Proof Of Funds Letter?

An effective bank proof of funds letter should include the following:

  • Your full name
  • Your current balance
  • Your bank information (e.g., sort code, account number)
  • The dates of the bank statements
  • The different sources of funds in your bank account (e.g., salary, gift from family, investment proceeds)
  • Your contact information

Who Do I Send the Bank Proof Of Funds Letter To?

You have to address the letter to the UK Home Office (The Clearance Officer who will be reviewing your application). This letter will be part of your other required UK Spouse Visa letters and UK Spouse Visa documents.

In conclusion, the bank proof of funds letter is an essential requirement for individuals applying for a UK Spouse Visa. By following the Home Office’s guidelines and seeking professional advice where necessary, applicants can ensure that their visa application process runs smoothly and is successful.

I have answered on another thread. A MOD may move it here.

Thank you very very much Joppa!!! I have seen it in the other thread!! You are such an expert!!!!

No more than 1000 words (two sides of A4, preferably less). First give a brief rundown of your relationship history, with significant events highlighted like first meeting, engagement, marriage etc. Spell out your current and future plans. Say something about why you have decided to have your future together in UK. Explain special circumstances, such as why you haven't been able to travel as much you like to see each other (e.g. through pressure of work, caring for a sick relative).

Family visa applications for the year ending June 2024 have reached their highest level in recent years, continuing an upward trend since the end of 2021. Figure 1 illustrates that family-related visa applications and grants remained relatively stable until 2018, followed by a slight increase prior to the COVID-19 pandemic, and a subsequent decline in 2020 due to travel restrictions imposed during the pandemic. Nevertheless, applications have increased by nearly 70% compared to the year ending December 2019, prior to the onset of the COVID-19 pandemic.

Pakistani nationals accounted for nearly one-sixth of all applications in the year ending June 2024, with 16,339 applications. There has also been a notable increase in Syrian applicants, now the second-largest group. Over the past 3 years, Syrian applications have increased from 1,548 in the year ending June 2021 to 6,630 in the year ending June 2024.

There were 84,403 family-related visas granted in the year ending June 2024, an increase of 12% from year ending June 2023.

Family-related visa: Grants

In the 5 years prior to the COVID-19 pandemic and the UK leaving the European Union, the number of family visa grants averaged around 43,000 per year (from calendar year 2015 to 2019). The number fell in 2020 following the COVID-19 outbreak, and again following the war in Ukraine when the Ukraine visa schemes were first introduced and case working prioritisation changed to support this. However, since year ending June 2022 (36,043), the number of grants has since increased by nearly 50,000.

In the year ending June 2024, a notable increase in family-related visa grants has been largely driven by a significant rise in visas issued under the Family: Other route, of which there were 16,956. The number of visas granted through this route has surged by nearly 3 and a half-times the number granted in the previous year ending June 2023 (4,901). Over 95% of granted Family: Other visas in year ending June 2024 were Family reunion visas , which allow family members of refugees or individuals granted humanitarian protection to join them in the UK.

In line with the trend in family visa applications, Pakistani nationals accounted for over one-sixth (17%, or 14,439) of all family-related visas granted, with the majority (89%) issued through the Family: Partner visa route. The number of Pakistani nationals granted family-related visas was nearly 3 times that of Syrian nationals (5,041), who were the second-largest group. The number of Syrian nationals granted family-related visas increased by more than 3 and a half times compared to the year ending June 2023.

EUSS family permits

In addition, 13,746 EUSS family permits were granted in year ending June 2024, around half the number (49%) granted in year ending June 2023. For further information on EUSS family permits, see ‘ How many people have been granted settlement via the EU Settlement Scheme? ’

Indefinite Leave to Remain: Migrant Journey

Those arriving on family routes are more likely to acquire indefinite leave to remain ( ILR ) than those arriving on work and study visas. Analysis from the Migrant Journey: 2023 report shows that of those whose first leave to enter the UK was on the family route since 2007, 62% had ILR after 5 years, increasing to 83% after 10 years. This is much higher than those starting on work and study routes, where 21% and 7% respectively had ILR after 10 years.

2. Extensions for family reasons

Extensions of stay for family-related reasons relate to people wishing to extend their stay in the UK for family-reasons. It covers extensions where an individual is applying based on their relationship to a person settled in the UK or a British citizen. An individual is required to apply for an extension before their existing permission to enter or stay expires and may make more than one application in any given year.

There were 117,874 extensions of stay granted for family reasons in year ending June 2024, a decrease of 9% compared with year ending June 2023 and 13% lower compared with year ending December 2022 when grant levels were at their highest level.

Analysis from the Migrant Journey: 2023 report , which links the current category of leave to the previous category of leave shows that 75% of family-related extensions granted in 2023 were to people who held a family-related visa before their current family extension. A further 5% previously held leave as a student, and 6% as a worker.

3. About these statistics

The statistics in this section provide an indication of the number of people who had an intention to enter the UK for family reasons.

Before the end of the transition period for the UK leaving the EU on 31 December 2020, EU nationals were able to come to the UK under freedom of movement and did not typically require separate permission (such as a visa). The majority of UK immigration control before 2021 related to non-European Economic Area ( EEA ) nationals. From 2021, EEA nationals became subject to immigration controls and are now more likely to obtain permission to travel to the UK. For many this will be under the EU Settlement Scheme (see How many people are granted settlement via the EU settlement scheme ), while others will require a visa.

Entry clearance visas allow an individual to enter and stay in the UK within the period for which the visa is valid. From 2021, EEA nationals require a visa to enter the UK for family reasons, unless they are eligible for the EU Settlement Scheme or a free EU Settlement Scheme family permit.

Year-on-year comparisons of the number of decisions can be affected by quarterly fluctuations in the data. These fluctuations can be examined in the quarterly data in the published tables.

For figures on family-related grants of settlement as well as residence documentation issued to EEA nationals and their family members, see ‘ How many people are granted settlement or citizenship? ’. Further data on the Family reunion visa category can be found in ‘ Safe and legal (humanitarian) routes to the UK ’.

More information about the statistics can be found in the user guide .

Further information on the statistics in this section can be found in the extension section of the user guide .
