When applying for a UK visa, it’s important to provide the Home Office with information that is correct and comprehensive to avoid delays or issues with processing and to avoid a visa refusal .

Mistakes can, however, happen. Once you realise you’ve made a mistake on your UK visa application, you should take steps to correct it.

In this guide for UK visa applicants, we explain the rules on correcting mistakes in Home Office applications, and discuss the potential implications of errors and false information on the outcome of your application.

Common UK visa application mistakes

UK visa application mistakes can range from simple spelling mistakes or typos, most of which may be immaterial to the basis of the application, to deliberate mistakes designed to fraudulently obtain a visa to which an applicant is not entitled. Somewhere in-between these extremes there are also those mistakes which are careless, but not intentionally deceptive, although run the risk of being construed by the Home Office as deliberate.

Examples of mistakes that could be potentially construed as deliberately misleading could include a failure to declare a criminal conviction, for example, where an applicant states that they have no criminal history, but they in fact have a driving conviction for speeding. It could also include where an applicant ticks “no” when asked if they have previously been refused a visa. This might be the case, even the applicant also provides clear evidence of a previous refusal, such as their passport containing a stamp confirming past refusal.

Another potentially misleading mistake could be where evidence submitted in support of a visa application clearly contradicts the information set out in the form although, for example, a form that cites an applicant’s income at £40,000 could just as easily be construed as an innocent error where the documentation demonstrates earnings of £4,000.

Implications of making a mistake on your UK visa application

If you submit a visa application with incorrect information, this could result in either the wrongful refusal of your application or the grant of a visa on an erroneous basis.

Wrongful refusal of a visa application

In circumstances where there has been minor but immaterial mistakes in an application, such as typographical errors, the Home Office caseworker should not refuse the application on this basis. This could be, for example, where an applicant has given an incorrect postcode or misspelt a name on their application form. However, an application may still be refused if the caseworker is not satisfied that the requirements of the rules are met, for example, if the applicant has claimed an income of £40,000, but has provided evidence for £4,000, even if the higher figure cited is an innocent mistake, the application may be refused if, on the evidence provided, the required income threshold is not met.

If your visa application is refused because of a mistake, you may be able to apply for an administrative review at a cost of £80, although an application must be submitted within 28 days of receiving your decision. It can then take up to 6 months or more to receive the result of the review and, even if a mistake was an innocent oversight, this does not necessarily guarantee that the outcome will be in your favour. You may need to reapply.

The grant of a visa on an erroneous basis

If your visa application is successful, based on a mistake that had not been discovered at the time a decision was made by the Home Office, once you realise that there has been a mistake, you are duty bound to report this to the Home Office.

In some cases, any mistake, innocent or not, may result in the revocation of your visa, especially if the information was material to the decision to grant you leave. However, in circumstances where the Home Office subsequently discovers the mistake, and you have failed to report this yourself, this is more likely to lead to a finding of deliberate deception.

Lying on a UK visa application

The consequences of lying on your visa application can be very serious, where mistakes are far more likely to lead to refusal of an immigration application or revocation of an existing visa where the Home Office interprets the matter as a deliberate attempt to deceive.

Deception is no longer defined under the UK’s Immigration Rules but can include making false representations or submitting false documents, even if not material to your application, or failing to disclose material facts, where silence or incomplete information can amount to non-disclosure. By using deception in an application for entry clearance or permission to stay in the UK, this will put you in clear breach of UK immigration law.

If a finding of deception is made against you, your visa will be automatically refused or revoked. You may also be banned from entering, or re-entering, the UK for a period of up to 10 years. Even in cases where you were not aware of any mistake, including where false representations have been made by third parties on your behalf, your visa application can still be refused on grounds of suitability. Equally, if your visa has already been granted, you can be refused entry to the UK by border officials, and detained and deported.

In all cases, but especially where any mistake is interpreted by officials as an attempt to mislead or deceive, it will then prove extremely difficult to apply for another visa in the future. This is because, even after any ban is lifted, a subsequent application is highly likely to be refused due to your adverse immigration history.

How do you correct a UK visa application mistake?

If you realise that a mistake has been made on your visa application, having already submitted your application form, you will need to contact UK Visas and Immigration (UKVI) . UKVI is the division of the Home Office responsible for making visa decisions. However, the way in which you address any mistake made will depend on the nature of the error in question. For example, if it is a simple error, such as a spelling mistake, you may be able to contact UKVI to ask for the mistake to be amended. In contrast, if the mistake goes to the very root of your visa application, you may need to ask UKVI to cancel your application so that you can start again and re-apply.

Importantly, even though mistakes on a visa application can lead to a refusal decision, this is not necessarily always the case. If application mistakes are thought to be innocent, refusal is not mandatory. It therefore follows that if you notify UKVI of any mistake, once this becomes apparent, the more likely the mistake will be interpreted as innocent.

Still, applicants are strongly advised to seek expert legal prior to addressing any UK visa application mistake. This is because it is important to know how best to approach the problem, and to understand the potential consequences of this on the outcome. In some cases, you may be advised to withdraw your visa application altogether, although your application fee will only be refunded if UKVI has not yet started processing your case. In other cases, a well-worded cover letter to the Home Office can often help to pre-empt any possible allegations of deception and clear up any misunderstandings.

How to contact UKVI to amend a UK visa application mistake

You can contact UKVI on the .gov website from both inside and outside the UK to amend a UK visa application mistake.

You will be asked where are you contacting UKVI from. The online tool will then ask you what you need help with or what your question is about. You will need to select the tick box for ‘something else’. You must then choose the language you want to use to speak to someone on the phone or to get a reply by email. If you would like a member of staff from the contact centre to communicate with you in a language other then English, you can choose from either Arabic, Cantonese, French, Hindi, Mandarin, Russian or Spanish.

Contact UKVI from outside the UK

To contact UKVI from outside the UK because you have made a mistake in your online application, you have the option of either sending an online query or by telephoning UKVI directly. Each online enquiry will cost you £2.74, although this cost includes your initial email plus any follow-up emails you send relating to the same enquiry. You will need a debit or credit card to use the online messaging service, and will be asked to enter your payment details before sending your message. However, you will not be charged until your message has actually been submitted. UKVI should then reply within 5 working days.

If your message is more urgent, you should telephone UKVI on +44 (0)300 790 6268, selecting option 1. Calls will cost 69 pence per minute on top of your standard network charges. If you cannot contact UK 0300 numbers, you can instead telephone +44 (0)203 875 4669. Importantly, UKVI contact centre staff cannot give you advice about your personal circumstances and have no involvement in the outcome of visa applications.

Contact UKVI from inside the UK

To contact UKVI from inside the UK to discuss a mistake on your visa application, you can telephone 0300 790 6268, selecting option 2. These lines are open Monday to Thursday, excluding bank holidays, 9am to 4:45pm and Friday, 9am to 4:30pm.

How do I ask UKVI to cancel my visa application?

You can ask UKVI to cancel or withdraw an application for a visa or visa extension. You can then re-apply, this time ensuring that your application is mistake-free. However, whether or not you will be entitled to a refund will depend on what stage your application is at.

The way in which you cancel a visa application, and the deadline for getting a refund, will depend on the type of visa that you have applied for and how you were asked to prove your identity. You would have been asked either to attend an appointment to provide your biometrics and identity document in person or to use the ‘UK Immigration: ID Check’ smartphone app to upload your photo and to scan your ID document.

If you were asked to attend an appointment but have not yet done so, you can cancel your visa application online and your fee will be refunded. If you applied within the UK, you will need to fill in the online form to withdraw your application. If you applied outside the UK, you will need to sign in to your UKVI account using the link from your sign-up email. If you have already attended your appointment, you will need to fill in the online form to withdraw your application if you applied within the UK, or contact UKVI to withdraw your application if you applied outside the UK, but your fee will not usually be refunded.

If you used the smartphone app when you applied, you can cancel your application online. Your fee will be refunded provided you have not selected ‘confirm and upload’, either to upload your evidence or to confirm you do not have anything to upload, or you withdraw your application before the deadline given for uploading your evidence. To cancel, sign in to your UKVI account, go to your dashboard and select ‘Withdraw this application’.

If you are eligible for a refund of your application fee, it will be automatically paid into the bank account that you used to pay your fees when you applied. This can take up to 28 days. You cannot stop a cancellation request once this has been received by UKVI and, importantly, if you are already in the UK, you may lose your permission to stay.

How to Deal with a Mistake On Your UK Visa Application

UK-Visa-Application-Mistake

Applying for a UK visa needs careful attention. Even a small typo can cause problems. Big mistakes might lead to your application being refused and affect future applications. This blog post will show you the usual mistakes people make when they apply for a UK visa and how to avoid them.

Table of Contents

By the end of this post, you’ll know more about the mistakes that can happen and how to correct them.

Common Mistakes on UK Visa Applications

When you’re applying for a UK visa or for an extension under further leave to remain , careful attention to detail is vital. An error-free UK visa application sets you on the right path towards a favourable decision. However, errors often occur, and they usually can be divided into two categories:

Innocent Mistakes

The phrase “innocent mistakes” generally indicates unintentional missteps stemming from oversights or misunderstandings. The Home Office’s instructions for Entry Clearance Officers ( ECOs ) suggest that such mistakes should not result in a visa application denial.

Unintentional mistakes could be typo errors, an incorrect post code or address, or wrong dates and figures. For exmaple, an applicant can unintentionally misrepresent their income by declaring an annual income of £250,000 when it’s actually £25,000.

If the job offer letter and wage slips state the right amount, it will likely be viewed as an unintentional mistake. Providing incorrect documents or paying the incorrect application fee also falls under this category.

Deliberate Deceptions

There are specific errors that could lead to the rejection of your UK visa application. These are usually mistakes that suggest an attempt to deceive the visa authorities. They could range from failing to declare material facts or a previous criminal conviction to ticking ‘no’ on the question “Have you previously been refused a visa?” when there’s clear evidence of a past refusal.

Submitting false documents or providing evidence opposing the information stated in the application form also falls under this category. These mistakes could not only lead to the refusal of your current application but also result in a prohibition on future applications.

It is crucial to note that some errors are sometimes treated as evidence of deception. This can include entering the wrong passport number, providing the wrong birth dates, using your nickname instead of your real birth name etc.

Despite the potential severity of these mistakes, it’s important to remember that they don’t necessarily guarantee refusal. The Home Office ECOs will consider and assess whether an applicant knowingly submitted false information or documents. If it appears that the mistake was natural, the application may not be denied.

Nevertheless, the most reliable way to avoid these complications is to review your application carefully before submission. Ensure all the details supplied are accurate and the supporting documents align with the stated information. If you do discover a mistake after submission, take immediate steps to rectify it.

The Risks of Making a Mistake on a UK Visa Application

An error in your UK immigration application, whether a minor typo or a significant discrepancy, can lead to a range of outcomes. The response from UK Visas and Immigration (UKVI) can range from minor delays to outright denial or even the cancellation of an already granted visa.

Rejection of Visa Application

Minor errors could slow down your application process. However, severe blunders impacting critical data or eligibility criteria might lead to the refusal of your visa application. Discrepancies affecting your eligibility, such as false income figures or inconsistencies in your employment history, could lead to your visa application being refused.

Approval of Visa Based on False Information

Sometimes, errors in a visa application may not be identified immediately, leading to the granting of a visa based on inaccurate data. If you discover such an error after obtaining visa approval and entry clearance, it’s crucial to report it to the visa application centre as soon as possible. If they discover the error on their own and it’s substantial enough to influence the visa decision, they might revoke the visa.

Risk of Visa Revocation if Errors Are Significant

If you are extending an existing visa, it may be cancelled if a mistake is noticed by officials during the visa application process that could have impacted the decision. In more serious cases, this could lead to a ban on re-entry, particularly if it is believed that the error was made intentionally. You might even be asked to leave the UK if you are already in the country. It is essential to ensure that all visa application documents are completed accurately and truthfully to avoid any avoidable issues.

What Happens When You Lie on a UK Visa Application

Submitting false information, hiding key details, or presenting forged manuscripts on a visa application can have serious consequences when dealing with UK immigration authorities. Such actions may result in not only immediate visa refusal or revocation but also a future ban on entry, making it much more challenging to obtain a UK visa.

It is vital to be honest and transparent on visa applications. Deceptive errors can take various forms. Some common examples include:

1. Failing to Disclose a Criminal Conviction

If there are any criminal records, the applicant must reveal them in the visa application. Failure to do so could be taken as an intentional attempt to mislead UK immigration authorities. It is essential to be genuine when applying for a visa to avoid any potential legal consequences.

2. Providing False Information about Previous Visa Denials

If you’ve previously been refused a visa, you must disclose this in your application. Lying about past visa denials can lead to your current application being denied and potential entry bans.

3. Inconsistencies Between Application Form and Submitted Documents

Differences between the information you provide in your application form and the details in your supporting records can be seen as an attempt to mislead. It’s, therefore, crucial that all information you provide is consistent and accurate.

UK Visa Application Mistake: How to Fix it

If you spot an error in your UK visa application after submission, it’s natural to worry. But mistakes happen, and there are ways to fix them. The approach to fixing the mistake depends on its nature. For minor errors like spelling mistakes or wrong address details, you can usually fix them directly with UKVI.

On the other hand, significant inconsistencies such as discrepancies in your income or criminal record may require additional documentation and possibly expert legal advice.

However, here’s what you should do promptly:

  • Consult with an Immigration Lawyer : Professional advice can be a game-changer in these situations. An expert immigration solicitor can provide you with guidance tailored to your situation and help you correct your error.
  • Write a Cover Letter : Draft a clear and concise letter to the Home Office explaining the error. Be sure to enclose your application reference number at the top. In the letter, provide a straightforward explanation of the blunder and accurate information.
  • Submit Supporting Documents : If you have any additional documents that can back up your claim of a genuine error, submit them along with your cover letter. For instance, if you entered the wrong financial details, you could include the correct bank statements.

It’s critical to stay calm and organised in these circumstances. With the right advice and quick action, you can manage the situation and get your visa application back on track.

Contacting UK Visas and Immigration (UKVI) to Amend a Mistake

UKVI can be contacted from both inside and outside the UK. If you’re outside the UK, you can send them an online inquiry or make a phone call if the situation demands immediate attention. Please note that every online inquiry incurs a fee of £2.74 (a fee that is subject to change at any point in time).

To go through the online messaging service, you’ll require a debit or credit card. Payment details must be provided before sending your message, but the charge will only apply once the message has been officially sent.

Upon contacting UKVI , you’ll be asked to select your current location. Next, the online tool will inquire about the nature of your query or what you require assistance with. You should select the option ‘something else’. You’ll then be asked to select your preferred language for correspondence, either through a phone conversation or an email response.

If you’re inside the UK, you can phone UKVI during their phone service hours and choose the correct option for visa application inquiries.

Request UKVI to Withdraw Your Visa Application

If you’ve made a significant UK visa application mistake, it might be best to cancel your application and request a refund, especially if the mistake is substantial and could greatly influence your eligibility. The option to withdraw your application is generally available until your biometric appointment. However, eligibility for a refund of the payment made depends on the stage of your application.

This is a big step, so discuss it with your immigration solicitor first. They can assist you through the withdrawal process and help you reapply correctly.

  • Terms for Withdraw : The terms for withdrawing an application can vary. For applications that have not yet recorded biometrics, cancellation can be initiated online. For online applications submitted through the UKVI account, you may be able to retract the application via the account itself.
  • Procedures to Withdraw : Depending on where you stand in the application process, different methods are available to withdraw your visa application. For applications involving biometrics, the process can be initiated online. For others, you may be able to retract your application through your UKVI account.

What to Do If Your UK Visa  Application is Denied?

In case your UK visa application is rejected due to a mistake, there are options to challenge the decision, especially if the refusal imposes a re-entry ban. At this point, engaging an immigration solicitor could prove highly advantageous. They have the proficiency and expertise to handle your UK visa rejection efficiently.

Please note that contingent on your specific situation, a solicitor might suggest various other potential options, including:

  • The Administrative Review Process : The primary course of action to challenge a visa refusal that is a result of an error made by the UK Home Office itself is filing an administrative review . This enables you to explain the reasons behind the error and introduce the correct data along with relevant supporting evidence. A strong argument could potentially lead to the reversal of the initial decision.
  • Filing an Appeal : If there is a legal ground to challenge the refusal decision outlined in your refusal letter, an immigration appeal could be an option for you. Note that it may take more than 6 months to get a reply after making the appeal. So, proceed with caution and ensure that you have enough time for that.
  • Opting for a Judicial Review : If you’ve tried all other options, you might potentially go for a judicial review . This is a process which reviews the legality of a judgment or an action carried out by a UK court.
  • Submitting a New Application : If the error was considerable, it could be more beneficial to submit a fresh application. In certain cases, it could be more practical to consider applying for a different kind of visa that better aligns with your circumstances.

Even though dealing with a rejected visa application can be tough and discouraging, it’s crucial to remember that it doesn’t represent the end of your journey. With proper direction and a proper strategy, you can manoeuvre through this situation and boost your chances of successfully acquiring your UK visa.

Always remember to act quickly, offer accurate and truthful information, and seek professional advice when required.

We all make mistakes, but when they find their way into your UK visa application, they hurt your chances of visiting the UK. Fix them quickly and honestly, no matter how big or small.

Remember, your visa application is a snapshot of you. By acting fast to clear up any mistakes, you’ll be one step closer to getting your visa and starting your UK adventure!

However, if it has been processed, you might not obtain any refund.

What to Do If You Make Innocent Mistakes on UK Visa Application

What to Do If You Make Innocent Mistakes on UK Visa Application

Amar Ali Immigration Solicitors

By Amar Ali, Immigration Solicitor

Last updated on 28th April 2022

Mistakes on a UK visa application can lead to a refusal by the Home Office, but this is not always the case. If application mistakes are thought to be genuine and innocent, refusal is not mandatory. However, if the mistakes on a UK visa application are considered by the Home Office to be false and deceptive, it is more likely to be refused. Home Office Entry Clearance Officers (ECOs) often have discretion whether to accept or refuse an application based on their judgement of each individual situation.

What is interpreted as “innocent mistakes”?

Within the Home Office’s guidance for ECOs on false representations 1 , ECOs are required to consider whether an innocent mistake has been made. Where an ECO thinks that a minor innocent mistake has been made, they are not permitted to refuse the application on the grounds of false representation. Innocent mistakes in UK visa applications may include where:

  • A spelling mistake or similar error has been made (e.g. an incorrect postcode or year in a date)
  • An annual income included in the application is obviously incorrect, and proof has been provided of the correct income (e.g. If a person says their income is £250,000 but it is actually £25,000, and their job offer letter and wage slips show the correct amount, the ECO is likely to conclude that the application has put too many zeros by mistake).
  • Providing incorrect documents – e.g. providing a summary birth certificate when a full birth certificate is required
  • Paying the incorrect fee – in this case, the Home Office ECO is likely to request the correct payment before proceeding with the application

What mistakes can cause a visa rejection?

Visas are rejected for many reasons by the Home Office, including where mistakes have been made. Mistakes are most likely to lead to a refusal of an immigration application where the ECO considers interprets this as deception. Examples of mistakes which may be considered deception include:

  • Failure to declare a criminal conviction – e.g. where an applicant states that they have no criminal record, but they have a driving conviction for speeding
  • Where an applicant ticks “no” to the question “have you previously been refused a visa”. If their passport contains a stamp confirming past refusal, this may still be considered deception, although the applicant has provided clear evidence of their refusal. We recommend always erring on the side of caution with this type of question and fully disclosing any past refusal of entry or leave to remain.
  • Providing false documents – this includes not only false documents provided by the applicant but also by another person. There have been cases where immigration officials in other countries have been found to have used deception and issued documents incorrectly, hence leading to the refusal of a UK immigration application. It should be noted that in order for a 10-year re-entry ban to apply, it is normally required that the applicant themselves has used deception.
  • Where evidence submitted contradicts the information provided in an application form – e.g. where a tax document shows different income figures to those in the application form.

Mistakes such as those above will not necessarily always lead to refusal by an ECO. The Home Office guidance states that just because a false document was provided does not necessarily mean the applicant was deceptive. ECOs are required to weigh up on the balance of probabilities whether the applicant knew they were submitting a false document. Likewise, if a person does not include a criminal conviction, ECOs are advised not to refuse an application if this was a genuine error.

What to do if you make a UK visa application mistake?

It is not uncommon for immigration applicants to submit their application form and documents only to realise they have made a mistake. Unfortunately, applicants are typically unsure how to correct a mistake on a UK visa application. In this case, we recommend taking the following steps:

  • Contact an immigration solicitor who can advise and represent you
  • Prepare a covering letter and submit this with your uploaded documents to the Home Office (include your application reference number at the top of the letter), explaining the mistake made and clarifying the situation.
  • Provide any additional supporting documents to show that a genuine error was made.

If a more substantial mistake had been made, it might be preferable to withdraw your application and request a refund. An immigration solicitor can recommend the best course of action based on your circumstances, and the mistake you believe has been made. We will then proceed to handle the matter and seek a timely resolution on your behalf.

If your UK visa application is rejected

If your UK visa application has been rejected on the basis of a mistake, you may be able to challenge the decision. This is especially important if the refusal comes with a ten-year re-entry ban. By submitting an administrative review outlining why a mistake was made and providing the correct information and evidence, it may be possible to have the decision overturned. An immigration solicitor can handle your UK visa rejection on your behalf. Depending on your circumstances, they may either recommend submitting an appeal, applying for an administrative review or judicial review, submitting a fresh application or applying for an entirely different type of visa.

How To Write A Detailed Cover Letter For UK Visa Application

' src=

When applying for a UK visa, the Embassy may ask you to send a cover letter. The cover letter should be brief and to the point; it should clearly explain why you are seeking for a UK visa. Read the article below for more information on the UK cover letter, what to include, and other queries you may have.

Who Needs a Cover Letter When Applying for a UK Visa?

Everyone who applies for a UK visa can submit a printed and signed cover letter attached to their visa application form. However, It is only necessary to submit a cover letter if it is noted in your visa application form.

Important: The cover letter explains in more detail the reason and the purpose of your visit to the UK. By submitting a cover letter, the Embassy or Consulate of the UK will have a clearer vision of why you are applying for a UK visa.

Types of UK Cover Letters

The Republic of the United Kingdom has different visa types that apply to everyone who wishes to apply for a UK visa for any different purpose. With that being said, there are also other types of UK cover letters, such as:

  • Work cover letter
  • Student cover letter
  • Family reunion cover letter
  • Tourist cover letter
  • Business cover letter

You can write any of the mentioned cover letters depending on the visa type you are applying for.

How to Write a Cover Letter for UK Visa Applications?

Here are a few tips to help you write the perfect cover letter when applying for a UK visa:

1. The first step is to include the Embassy’s information and the name of the country you are applying from.

2. The second step when writing a cover letter is introducing yourself. In the first paragraph, you must include information about yourself, such as:

  • Full name (first and last)
  • Passport number
  • Citizenship
  • The city and country you live in
  • Your professional career

3. The third step is to introduce the purpose of your visit to the UK and how long you are planning to stay.

4. The fourth step is to explain in detail your trip itinerary; you must also include the accommodation and financial information (where you will stay and how you will financially support yourself during your stay in the UK).

5. The fifth step is to mention the documents you will submit together with your cover letter when applying for your UK visa.

6. The sixth step is to include your personal contact information, such as your email address and phone number. This information will help the embassy to contact you regarding your UK visa application results.

What Not to Do in a Cover Letter for UK Visa Application

Make sure you avoid these mistakes when writing your UK visa application cover letter:

  • Do not write long sentences or paragraphs
  • Be straightforward
  • Keep it simple
  • Do not copy your cover letter
  • Do not include unnecessary personal details
  • Do not be rude
  • Do not make grammatical mistakes
  • Do not give false information
  • Be formal and respectful
  • Do not forget any important information

UK Embassy in Macedonia

Todor Aleksandrov 165, Skopje 1000 North Macedonia

Dear Honorable Consul,

My name is Stojan Nikola (passport number: NM22330011). I am a Macedonian citizen who lives in Skopje, Macedonia, where I work as a graphic designer and have an income of DEN 50,000. I am writing this letter because I am applying for a UK tourist visa; I plan to stay in London from May 30, 2023.

It has always been a dream of mine to visit London, so it would mean a lot to me if I would finally make that dream come true. During my time in the UK, I have planned to visit as many tourist attractions as possible, such as the London Eye, the Tower of London, Buckingham Palace, and the National Gallery. I also have many friends I have met on social media that I would love to meet.

While in London, I will stay in a hotel I have already booked, and I will also cover my personal expenses. As soon as my ten-day visa expires, I will return to Macedonia since I have a lot of work waiting for me there.

I will attach all the required documents in my visa application form and cover letter. If you have any other questions, please do not hesitate to contact me.

Thank you for your time!

Common Mistakes and Errors in UK Visa Applications

Madeline Haas

When submitting a UK visa application through UKVI, any information provided ought to be true, accurate and complete according to the applicant’s knowledge. However, as the process is oftentimes complex and lengthy, it is not uncommon for applicants to make mistakes while preparing their visa applications. Where a mistake has come to an applicant’s attention, they should consider whether remedial steps should be taken in order to prevent further issues from arising.

The Home Office caseworker guidance on false representations recognises the potential for an applicant to make mistakes in their visa application. Nevertheless, the consequences of submitting an application containing incorrect information can be very severe if there is a finding of false representations, deception, false documents or nondisclosure of relevant facts.

This blog post is the first part of our guide to visa application mistakes. In this post, we discuss common application mistakes and consider what falls within the parameters of an ‘innocent mistake’. In the next post in this series, we will discuss the potential consequences of submitting an application containing mistakes, and what corrective steps can be taken after discovering them.

Common UK Visa Application Mistakes

It is possible to make mistakes in the representations and information submitted in a UK visa application. For this purpose, the Rules encompass statements and details provided either orally or in writing, whether they are provided by the applicant or a third party. This could, for example, include the answers provided in a visa application form, oral answers provided in an immigration interview, or any further submissions provided in an immigration application.

An applicant might also mistakenly fail to disclose relevant facts . Examples of nondisclosure that may adversely affect a UK visa application may include:

  • Failure to disclose the existence of a family member, where relevant;
  • Failure to disclose a criminal conviction;
  • Failure to disclose previous travel to the UK;
  • Failure to disclose presence of family members in the UK; or
  • Failure to disclose a visa refusal.

It is equally possible to submit incorrect or irrelevant documents by mistake. Depending on the circumstances, this could have anything from a very minor impact to quite a severe impact on an application. This will be discussed in more detail within Part 2 of this series.

What is Considered an ‘Innocent Mistake’?

The Home Office guidance, Suitability: false representations, deception, false documents, nondisclosure of relevant facts Version 4.0, as published on 14 November 2023, distinguishes between false representations and innocent mistakes . It is important to understand what differentiates the two, as a finding of ‘false representations’ can have serious consequences on a pending application, any future applications, and even on an applicant’s current immigration status in the UK.

Relevant Factors in Determining if a Mistake is ‘Innocent’

If there is reason to suspect a false representation has been made in a visa application, decision makers are required to first consider whether an innocent mistake has, or could have, been made. The guidance states that decision makers must not refuse a visa  on grounds of false representations where there may have been an innocent mistake. In considering whether an innocent mistake has been made, the following factors should always be considered:

  • How easy would it be to make an innocent mistake?
  • How likely is it that the applicant was unaware the information has been provided?
  • how likely is it the applicant, or the person providing the information, etc, is aware that the information is incorrect)?
  • Does the false information benefit the applicant?
  • Is it contradicted by other answers on the application form, or by any information in any documents provided with the current or a previous application?
  • Does any endorsement or stamp in the passport or ID document contradict any answer given?
  • has a new passport been presented, and if so why?
  • Has this ‘innocent mistake’ also been made on a previous application?

Examples of ‘Innocent Mistakes’

The guidance provides further examples of mistakes that should not prompt a refusal on grounds of false representations. These mistakes normally involve minor , but immaterial inaccuracies . For example, while applicants should of course strive to avoid typographical errors in visa applications, a misspelt name or incorrect postcode should not be cause for a decision maker to refuse an application.

The exception is where a mistake prompts the decision maker to believe that the requirements for a visa are not met in full. The following example is provided in the guidance:

“…if the applicant has said they have an income of £40,000, but has provided evidence only for £4,000, you may take the view that the higher figure was an innocent mistake but may still refuse the application on eligibility grounds if on the evidence provided the required income under the rules is not met.”

Thus, the severity of the mistake made is an important factor in determining the outcome of a case. Even where a mistake results in an application being refused, it is still possible for a decision maker to consider it an innocent mistake rather than a false representation .

Distinguishing an ‘Innocent Mistake’ From a ‘False Representation’

In AA (Nigeria) [2009] EWCA Civ 773 , the Court concluded that “dishonesty or deception is needed” in order to refuse an application on the grounds of false representations under paragraph 9.7.2 . Therefore, an innocent mistake – that is, a mistake with no element of dishonesty or deception – should not prompt a mandatory refusal on the grounds of false representations. The court stated:

“…a false representation stated in all innocence may be simply a matter of mistake, or an error short of dishonesty. It does not necessarily tell a lie about itself. In such a case there is little reason for a requirement of mandatory refusal, although a power, even a presumption, of discretionary refusal would be understandable.”

This decision aligns with the longstanding legal principle that carelessness, negligence or innocent mistakes are not equal to dishonesty, as per Royal Brunei Airlines v Tan [1995] UKPC 4 .

However, as highlighted in the judgment of AA (Nigeria) , representations that do not give rise to mandatory grounds for refusal can still give rise to a discretionary power of refusal. This is reflected in paragraph 9.7.1. of the Immigration Rules, which applies to false representations whether or not they are in the applicant’s knowledge. Please see this article for an in depth discussion of false representations and the distinction between paragraph 9.7.1. and paragraph 9.7.2. of the Rules.

What’s Next?

Part 2 of this series will discuss the possible consequences of submitting a UK visa application containing mistakes. This may include a finding of deception, a wrongful refusal of an application, or a grant of permission on an erroneous basis. Part 2 will then discuss the relevant actions an applicant should take if they have submitted an application containing false information.

Innocent Mistake In UK Visa Application

Danielle Cohen

By Danielle Cohen Immigration Law Solicitor Linkedin

Mistakes on visa application forms can be disastrous. If the mistake is interpreted by officials as an attempt to mislead or deceive, the application must be refused. If the application is for an entry clearance, it will also lead to a 10 year ban on re-entry.

Given the length of time, one has to remember that the ECO needs to be satisfied that deception has been employed and or that the applicant intended to deceive the ECO. The majority of cases where this requires the ECO’s judgement will relate to how an applicant has completed the VAF, Form, most usually in relation to questions about previous visas refusals or the grant or refusal of leave to remain. A prime example of this is where an applicant ticks the wrong box on the VAF in answer to the question “Have you previously been refused a visa”? If the applicant has ticked that they have not previously been refused a UK visa but has presented a passport containing a refusal stamp and or previous refusal notice, this should not be considered to be deception and therefore paragraph 320(7)A should not apply.

The most recent case is the case of Shen [2014] which is an example of an applicant with a driving conviction who ticked the no box to the question about previous convictions, standard on all immigration application forms. Even the Home Office policy guidance recognises that mandatory refusal is not necessarily justified on such facts. In this case the applicant’s evidence was that she did not realise she had been convicted because she had not received any further communication from the police about her case. What we have learned from this case is that if an application form is false in a material way, this may be relied upon as some prima facie evidence which assists in establishing dishonesty. The inference of deliberate deception can be strengthened by reference to other facts, for example if the conviction is shortly prior in time to the completion of the application form. However, this is not positive of dishonesty and it is open to an appellant to provide an innocent explanation. If an innocent explanation is advanced, ie., the one that meets the minimum level of plausibility, then the burden switches back to the Secretary of State to answer that evidence. At the end of the day the Secretary of State bears the burden of proof. This is a proposition which is uncontroversial.

The second recent deception case is R –v- Secretary of State for the Home Department [2014]. In this case the police said a student was thought to have used false documents in 2006 and was initially refused entry. Later in 2006 he reapplied, admitted in interview that documents were false and was admitted. He extended his leave in a series of applications and no point was ever taken about the previous use of deception. However, for some reason in 2011 the Home Office decided to refuse his latest application because of that historic deception. This was justified on the basis of failure to declare the previous deception. The applicant challenged the decision by way of an application for Judicial Review which the Judge, Mr Justice Robert Jay, concluded that the decision was not Wednesbury unreasonable. Although the Judge was inclined to accept the applicant’s submissions the judgement ends with a suggestion that although the Judicial Review application must fail, a more senior official at the Home Office should look at the case given the Home Office acquiesced to entry in 2006 in the full knowledge of the deception.

As always and as expected excellent work and detailed excellence throughout.

Cannot express our thanks and high gratitude to you and Danielle who made it all possible with your hard efforts and dedication.

Boost your UK visa approval chances with a well-written cover letter

HOW TO WRITE A COVER LETTER FOR UK VISA APPLICATION

Getting around the complex procedure of obtaining a UK visa can feel overwhelming, especially when it comes to crafting the perfect cover letter to accompany your application. Whether you’re seeking entry for tourism, business, or study, your cover letter serves as a crucial introduction to your application. Crafting a meticulously written cover letter can tip the scales between visa approval and rejection. Here, we’ll explore the essential ingredients of an effective cover letter for UK visa, and the specific nuances to consider for different types of visa applications.

The Anatomy of an Effective Cover Letter for UK Visa

Perfect your UK visa application with effective cover letters

A cover letter for UK visa isn’t just a formality – it’s your personal statement, often the first impression the consular officer will have of you. Crafting an impressive letter involves several key components:

Personal and Contact Information

Start your cover letter with your name, nationality, and current address. Include your contact details, such as your phone number and email address, for the Visa Officer’s convenience.

Purpose of Your Visit

Clearly state the purpose of your visit, whether it’s for tourism, business, family visit, or any other category. Elaborate on the reason for your trip, the itinerary, and mention any invitations you may have from individuals or organizations in the UK.

Background and Ties to Your Home Country

Provide a brief history of your travel background, including previous visits to the UK and other countries. Detail your employment status, ties to your home country, and any responsibilities that ensure your return, such as property ownership, family, or ongoing educational pursuits.

Financial Means

Demonstrate your ability to support yourself throughout your stay in the UK. This includes providing bank statements, salary slips, and other financial documentation specifying your income, savings, and any financial assistance you may receive.

Accommodation and Maintenance in the UK

Outline your planned accommodation in the UK or any arrangements you’ve made for this. If you’re staying with a relative, friend, or in a hotel, provide the relevant details.

Intention to Return

Reiterate your intention to return to your home country at the end of your visit or after pursuing your studies. Citing strong ties, as mentioned earlier, supports this aspect of your cover letter.

Supporting Documentation

Mention any additional documents you’re including in your application to substantiate the information provided in your cover letter. This could range from flight itineraries to employment letters, and should be organized and listed for reference.

An important rule to remember is to keep your cover letter concise and to the point. It should not exceed a single page in a standard A4 format, with clearly organized sections and a professional tone throughout.

Crafting the Perfect Introduction

Your introduction should include a polite salutation; for instance, “Dear Sir/Madam” or “To Whom It May Concern.” State the purpose of your letter immediately to provide clarity and set the right tone for the rest of the content.

Finance Matters and the Road to Viability

The financial section is often a make-or-break for visa applications. Ensure all presented financial data is easily verifiable and offers a clear picture of your financial situation. Highlight your financial stability and capacity to cover your expenses without recourse to public funds in the UK.

The Quintessence of Proof and Corroboration

Reinforce your claims with solid evidence, using documentation to support every statement in your cover letter. This evidence should be consistent with the expectations and regulations set out by UK Visas and Immigration .

Types of UK Visa Cover Letters

Perfect your UK visa application with effective cover letters

Each category of visa application requires different approaches to the cover letter’s content. Here’s how to tailor your letter to three common visa types.

Tourism Visa

For a tourism visa, focus on your proposed activities and demonstrate that you’re a genuine visitor with intent to return. Provide your complete itinerary, including flight and hotel reservations, and any planned excursions. Mention how this trip fits within your longer-term travel plans.

Business Visa Cover Letter

When applying for a business visa, elaborate on the professional reasons for your trip. This could include meetings, conferences, or other business engagements. Also, include an invitation letter from the UK company or organization you’re visiting as a vital support document.

Study Visa or Tier 4 Student Visa

In the case of a Tier 4 Student Visa, your cover letter should emphasize your academic goals and the benefits of studying in the UK. Describe your course, plans post-graduation, and elaborate on any scholarships or sponsorships. A letter of acceptance or sponsorship should be included as a supporting document.

Family Visit Visa

For a family visit visa, highlight your connection to the family member in the UK, the duration of your visit, and any important events you plan to attend. A formal invitation from your UK relative should be among your supporting documents.

Common Pitfalls to Avoid

Ensuring the success of your visa application also means avoiding common mistakes:

Providing Irrelevant Information

Every detail included in your letter should directly support your application. Irrelevant information can clutter your cover letter and detract from your case.

Inconsistencies with Other Application Elements

Any information or claims in the cover letter should match the facts in your application form and supporting documents. Discrepancies can raise red flags and jeopardize your application.

Neglecting to Proofread

A cover letter with typos, grammar errors, or incorrect facts reflects poorly on your attention to detail. Always proofread your letter, and if possible, have a third party review it for clarity and correctness.

Concealing Negative History

Be transparent about any past visa refusals, travel bans, or criminal history, if applicable. While it’s not necessary to go into detail, it is important to address these circumstances honestly and succinctly.

Final Words of Encouragement

Approaching a UK visa application with a precise and informed mindset can significantly boost your success chances. Your cover letter tells your story, so create it thoughtfully.

Craft a standout cover letter by balancing substance and brevity. Provide solid, verifiable details with proper documentation, all in a clear, structured format.

Remember, your visa cover letter should advocate convincingly but professionally. Maintain a formal tone, steer clear of overly emotional language, and stick to the facts that support your case.

Use these insights to draft a compelling UK visa cover letter. Pay attention to your visa’s requirements and ensure all components are in order to navigate the application process confidently towards approval.

  • What you need to do

How to apply for a visa to come to the UK

Getting a decision on your application.

You’ll get a letter or an email telling you the Home Office has made a decision on your application.

It will tell you what you need to do next.

If you have not received your email, check your spam or junk folder.

If your application is successful

You’ll be given either:

  • a sticker (called a vignette) that goes in your passport - if you gave your biometric information at a visa application centre
  • access to view your immigration status information online - if you used the smartphone app to prove your identity

The vignette or online immigration status information will show:

  • what you’ve been granted (for example, a Student visa)
  • the dates your visa is valid (start date and end date)
  • the conditions of your visa

Your visa conditions

The conditions say what you can and cannot do in the UK. For example, they might say:

  • ‘No access to public funds’ - you cannot claim benefits
  • ‘No work’ - you cannot take paid or unpaid work in the UK
  • ‘Restricted work’ - you can only work for your sponsor

Getting your vignette

If the visa application centre kept your passport, they’ll either:

  • send it to you with the vignette inside - if you paid for this service when you applied
  • ask you to collect the passport and vignette

If you kept your passport, you’ll need to take it to the visa application centre to collect your vignette.

If there’s an error in your vignette

If you notice an error in your vignette, you should contact your visa application centre immediately to correct it before you come to the UK.

If you notice the error after you’ve arrived in the UK, you must report it to UK Visas and Immigration ( UKVI ) within 3 months of arriving or you’ll need to make a new application.

Getting a biometric residence permit

If you get a vignette and you’re coming to the UK for more than 6 months then you have to collect a biometric residence permit ( BRP ) after you arrive.

You must do this before the vignette sticker expires or within 10 days of arriving in the UK, whichever is later.

You choose where to collect your BRP from during your application.

When you get your BRP , check the details are correct. If your name is long it may appear ‘cut off’. This is not a mistake - it is because there is limited space on the BRP card. However, if there’s a spelling mistake, you must report it .

You need to report any errors in your BRP within 10 days of collecting it.

If you get access to your immigration status information online

You’ll be able to view your immigration status information online . You can also use the online service to share your immigration status information with others, for example employers or universities.

Some government organisations and public authorities will be able to access your immigration status information, for example when you travel through the UK border.

You will not get a vignette or a BRP .

If your application is refused

You’ll get a letter or an email explaining why your application was refused.

Your passport will be returned, if it was kept as part of your application.

Your refusal letter will explain if you have the right to either an:

  • administrative review
  • immigration decision appeal

"Hence my gross earnings in last 12 month is 34000 GBP" (this amount is in bold face and is correct as per my gross salary in INR) So now, the same page on covering letter shows two different amounts.. 1. ~33000 <- this is incorrect 2. ~34000 <- this is correct Also please note that the gross salary in INR is correctly mentioned and there is no mistake there.. Do you think case worker will be ok with this in covering letter or this can lead to any issue ?

How to challenge UK visa refusal

Updated: September 8, 2023

How to challenge UK visa refusal

There are incidents where UK visas are refused due to unjustified reasons. It’s not uncommon for ECOs to make mistakes or overlook crucial documentation. If you believe that your UK visa was refused on unjustified grounds, you can challenge it. In this article, you will learn how to challenge UK visa refusal.

How to challenge UK visa refusal?

You can challenge UK visa refusal through a reapplication. Read your refusal letter carefully and understand the reasons for your visa refusal. If the reasons were unjustified, address them with the necessary information and supporting documentation. Draft a strong cover letter and point the ECO to the new information and documentation.

Let’s look at how to reapply and a few other ways to challenge your UK visa refusal.

WAYS TO CHALLENGE UK VISA REFUSAL

UK visa re-application process

You can challenge your UK visa refusal in these ways –

  • Re-application ( recommended )
  • Judicial review ( expensive )
  • Appeal ( only if eligible )

Re-application

The easiest and inexpensive way to challenge your UK visa refusal is by a re-application. If you believe that ECO has made a mistake in your application, challenge your refusal with a re-application by writing a strong and detailed cover letter.

It’s not uncommon for ECO’s to overlook crucial information and make quick decisions. Mention the information or documentation that was overlooked in your other information section and cover letter. Make this the first section in your cover letter to catch ECO’s attention. You want the ECO to cut through the chase and get straight to the point. This will save time, money and spare you from another refusal.

Judicial review

If you feel that there is no point in submitting another application with the same set of documents, you can very well go for a judicial review.

Keep in mind that judicial review is a legal challenge. You must have legal grounds to prove that ECO has made an unlawful decision in your case.

You would need to hire a legal firm specialized in immigration law to file a judicial review with UKVI on your behalf. The legal firm will cite the appropriate immigration laws to challenge your visa decision.

Keep in mind that these legal firms charge hefty fees for filing judicial reviews. Legal firms in the UK typically charge upwards of £600 for the Pre-Action Protocol (PAP), which is just the first step in the judicial review process. That’s just the first step. You can imagine how much you will end up spending overall.

Legal firms can also take advantage of your situation. They can recommend judicial review even though you do not have proper grounds for judicial review. You may end up losing the case and a lot of money during the process.

In my opinion, it’s easier and cheaper to just reapply than going for an expensive and complicated judicial review. A fresh UK tourist visa application costs you only £95.

UKVI has suspended the right to appeal for visitor visas. Currently, the right to appeal is available only in certain cases based on humanitarian grounds.

ECO will indicate in your refusal letter whether you have the right to appeal to the tribunal . If you do, the ECO will also indicate the appropriate section and the act.

Keep in mind that an appeal is also an expensive and time-consuming process. It’s really not worth it for regular visitor visa refusal.

How do you know if your UK visa is denied?

UKVI notifies you via email when a decision has been made on your visa application. The email notifies you that a decision has been made, but it does not disclose the visa result itself. The only way to know the visa result is to wait till you receive your passport.

When you receive your passport, you should see either a UK visit visa sticker in your passport or a refusal letter enclosed in the package.

If there is a visa sticker, then your visa is APPROVED. Verify your name, visa type and expiration dates to make sure everything is correct.

If there is a visa refusal letter enclosed, then your visa is DENIED. Read the letter thoroughly to understand the reasons for your UK visa refusal.

Do you get a refund if your UK visa is refused?

You cannot get a refund if your UK visa is refused. UK visa fee is non-refundable.

UKVI requires resources to review visa applications, conduct background checks and other visa related tasks. The amount of resources required to process a visa application is the same irrespective of its outcome.

Even though the outcome is a refusal, UKVI has technically spent your visa fee on the visa process. So, you cannot get a refund of your UK visa fee.

NOTE UK visa fee is refundable as long as you haven’t given your biometrics. Once you have given your biometrics, the UK visa fee is non-refundable.

What are the chances of getting UK visa after refusal?

Your chances of getting a UK visit visa after refusal are higher if the ECO has made a mistake or overlooked crucial information. In your re-application, you would need to make the new ECO aware of your previous refusal, mistakes or overlooked information and point the ECO to the right information/documentation.

Your chances are also higher if you know exactly what caused your refusal and how to address those refusal reasons. Reasons can be inadequate information, missing documentation, an error from your side, etc. Fix these issues in your re-application and point the new ECO to the new information or documentation provided.

But if your visa was refused due to ineligibility, deception or re-entry ban, you have absolutely zero chances. It’s wise not to spend any more money on your UK visit visa re-application.

Can you reapply for UK visa after refusal?

Absolutely! You can reapply for UK visa after refusal. But you must first determine if it’s even worth reapplying for your UK visit visa. It’s you who have to make the decision whether to reapply or not. Like I mentioned above, if your UK visa was refused due to ineligibility, there is no point in reapplication. The visa result would be the same.

Read the remarks from the ECO in your refusal letter. This will indicate whether your visa was refused due to ineligibility. Ineligibility could be insufficient funds, low income, lack of ties with your country, lack of travel history , etc. Reapplying for your UK visa without fixing these will lead to refusal again.

How soon can you reapply for UK visa after refusal?

There is no set time limit on how soon you can reapply for UK visa. You can reapply the very next day of your refusal.

Jumping too quickly into re-application without understanding the reasons for your previous refusal will only lead to another refusal.

Take some time to understand the reasons for your UK visa refusal. Research on the internet, gain some knowledge and learn from other applicants. Determine and gather all the additional information or documents necessary for your re-application. And then start your re-application.

How to apply for UK visa after refusal?

Applying for a UK visa after a refusal is the same as applying for a fresh UK visa. But it’s very important to address your refusal with relevant information and documentation in your re-application.

Draft a write-up on your refusal, the reason for refusal and additional information or documentation to address the refusal. Adjust the language, spell check and format it well.

You will see a question “Is there any other information you like to be considered…” which is usually at the end of the application with a large text area for the answer. You can use this large text area to mention your previous refusal and how you would like to address it. Add your explanation to this area.

Add the same information in your cover letter as the very first section. Format it well, use bullets and screenshots if necessary.

Let’s look at an example and a sample write-up.

Example: UK visit visa was refused due to a large deposit in your bank account

UK visa refusal due to large deposits in the bank statements is very common. Bank statements are very important in your UK tourist visa application. ECOs are not just looking at your balance, but they are looking at patterns that tell them whether you are a genuine visitor. Many fail to understand the importance of bank statements for UK visa . They come to realize how important they are only after receiving their refusal letter.

Below is a sample write-up that should be added to the “other information” text area in your online UK visa application.

My previous application for the UK visitor visa with GWF number {GWF number} was refused on {date}. I would like to address the reason for my previous visa refusal with an explanation and relevant additional documentation. Please consider my explanation and additional documentation to evaluate my case.

Reason for refusal: The sources of these deposits were not demonstrated by the documents provided

Explanation: The deposit in question was made on 10-Dec-2020 for an amount of £850. This amount was my yearly bonus from my employer. We typically receive our yearly bonus in the first week of December. Please find the attached documentation to address the concern for the refusal.

Additional Documentation: (1) Bonus slip, (2) bonus announcement email and (3) letter from my employer with details of bonus, amount and dates.

Below is a sample write-up that should be added as the first section in the cover letter.

Re; Visitor visa for George Job, passport number 66798 Expiry Date; 3rd July 2021

This letter is coming your way to give you additional information that might interest you more about my visitor visa application. My name is George Job and I work as a medical scientist in the US. My company is incorporated in a pharmaceutical company that is based in Japan. I’m a regular worker that receives $60,000 yearly and splitting this into months will make it $5000 per month. This payment includes my taxable income, allowances and other expenses.

I’m trying to visit my friend in the UK, this is why I’m applying for the visitor visa and I want to be there for only 2 weeks. I would have to return to work after the expiration of this period so this confirms that I wouldn’t be staying beyond the time or duration on my visa. I will be taking care of all the expenses associated with the trip though my friend also wants to sponsor the trip. Whichever way, this also confirms that the trip will adequately provided for.

Thanks you for your approval

Politics latest: Sunak faces 'realistic prospect' of being ousted after local elections

A former Number 10 director of communications thinks Tory MPs could move against the prime minister if the local elections go particularly badly. Jeremy Hunt has admitted the Conservatives are expecting "significant losses".

Guto Harri, the former Number 10 director of communications under Boris Johnson, has said it is a "realistic prospect" the Conservatives could move against Rishi Sunak if the results of the local elections are bad.

"I think that would be mad and unfair, but I think it's a realistic prospect now," he tells Sophy Ridge .

"It's clear that one or two mayoral contests could be read as the trigger. It could be that the overall number is so bad that that is the trigger."

'It can be very brutal'

Mr Harri says that, by Sunday, there could be conversations across Westminster on whether Tory MPs could move against Mr Sunak.

"It can happen very, very quickly, and it can be very brutal," noting the speed at which his old boss Mr Johnson was toppled.

Andrew Fisher, former head of policy for Jeremy Corbyn, says that, in contrast, Thursday could be a good night for Labour.

"It's clearly going to be a bad night for Rishi Sunak," he says.

The Tory mayor of the West Midlands is sending voters an endorsement from Boris Johnson which urges people to "forget about the government", Sky News can reveal.

Andy Street's campaign website makes no mention of Rishi Sunak on its homepage and is coloured in green rather than Conservative blue, suggesting the mayor is trying to run on his credentials as an independent campaigner rather than under the unpopular Tory brand.

Other campaign literature - including the front page of a campaign "newspaper" seen by Sky News - makes no mention of the Conservative leader.

You can read more from Sky News below:

The Sky News live poll tracker - collated and updated by our Data and Forensics team - aggregates various surveys to indicate how voters feel about the different political parties.

With the local election campaign well under way, Labour is still sitting comfortably ahead, with the Tories trailing behind.

See the latest update below - and you can read more about the methodology behind the tracker  here .

More than 2,600 seats are up for election in 107 English councils on Thursday.

Now, YouGov has made its final calls for some key contests using the MRP polling method after interviewing almost 9,000 people over two weeks.

Here, exclusively on Sky News, are the headlines.

We'll start with two key battlegrounds...

By Tomos Evans , Wales reporter

Calls for an investigation into a £200,000 donation to Welsh First Minister Vaughan Gething have intensified in recent weeks.

A motion calling for an independent probe into the money was debated in the Senedd on Wednesday and defeated by 27 votes to 25.

But former deputy climate change minister Lee Waters said Mr Gething should do "the right thing" and return the donation.

Mr Gething was elected leader of Welsh Labour in March and succeeded Mark Drakeford as Wales's first minister.

Opposition parties launched a bid to appoint an independent advisor to check whether there was any conflict of interest over the donation during the leadership campaign.

That's it for tonight's Politics Hub programme - we'll end with an exclusive report from our political correspondent Serena Barker-Singh .

Tory MPs are threatening to rebel over the government's new housing proposals.

In a letter to Chancellor Jeremy Hunt, more than 30 Tory MPs have stated their dissatisfaction with the current leasehold system and implored the government to scrap ground rent on leasehold properties.

Housing Secretary Michael Gove previously called that "a charge for nothing" and has stated a personal preference to move towards a "peppercorn" system, where ground rent is as close to zero as possible.

Multiple Tory MPs who have signed the letter are also in favour of this proposal - citing that promise made in the Tory 2019 manifesto.

Former England cricket star Monty Panesar, who's standing at the next election for George Galloway's Worker's Party, is now joining Sophy Ridge .

He is asked about his change in career.

"When I played cricket for England I had fans up and down the country, I had Monty Mania happening, everyone knew who I was.

"Obviously I am a very popular figure in this country so hopefully by me getting involved in politics, I can maybe make a difference to ordinary people."

He adds: "I believe there is a huge divide between the rich and the poor at the moment, and hopefully me being involved with the Worker's Party of Britain I can come together and be that voice for the ordinary person who is walking down the street."

'Hear the voices of working people'

So why the Worker's Party?

Mr Panesar says he was introduced to the party by a friend, and asked if he wanted to run as an MP in the Ealing Southall constituency at the next general election.

Pressed, the former cricketer says he doesn't believe Labour and the Tories are here to "hear the voices of the working people".

He says the party wants to "redistribute the power between the rich and the poor", by introducing wealth tax on large estates.

The would-be MP wants to extend free public transport for children across the UK.

Sophy is now joined by Labour frontbencher Nick Thomas-Symonds, and they begin their conversation on the government's Rwanda scheme.

So will Labour scrap the policy?

"We will replace the Rwanda policy," he says. "And we've seen previously the work of similar schemes.

"Israel, for example, had an agreement with Rwanda that had to be abandoned in 2018 because it wasn't working.

"We can see from past experience, what the situation is with a scheme like this.

"We believe that the money that's been allocated to the Rwanda scheme would be better spent on a new unit in the National Crime Agency that would be able to work internationally to bust the model of the people smuggler gangs.

"Secondly, we need to really get a grip of the asylum system, the enormous backlog that we have.

"The amount of money that's being spent on people in hotels, a miserable existence for them, really is not value for money for the taxpayer."

Next up on tonight's show is some relief for Scotland's outgoing first minister after his government survived a no confidence vote.

Humza Yousaf announced his resignation earlier this week, but it could have been worse for the SNP after Scottish Labour forced a vote at Holyrood this afternoon.

Despite Labour and the Tories uniting to try to bring down the government, it wasn't enough to force the nationalist party out of office.
