As we move through life, we find that there are many things out of our control. We can’t choose our parents, our genetics , or control the things that happen in the world around us. One thing that we can control is who our friends are, and this decision can either make our lives so much richer and beautiful, or more stressful and disappointing. Today we’ll focus on how to choose friends who enrich our lives and make them more beautiful.

Why friends are so important

Having solid friendships is important for two main reasons. First, they make life more enjoyable. We get to share the beautiful aspects of life with people who we love, which can enrich our everyday experiences. Second, our friends help us through the difficult times. Having friends to support us through hard times can make unimaginably difficult situations seem more tolerable.

The most beautiful part about pouring our time and energy into friendships is that not only do friends help enrich our lives, but we enrich theirs too! Friendships get us through the tough times in life, make things more fun and enjoyable, and all-around make our lives better. I urge you to take stock of your friendships and ask yourself if your current friends people build you up and support you, or is the friendship more one-sided?

As we explore friendships today, these are also inclusive of our partners. I believe that the foundation for any healthy relationship is friendship. So it’s important to group our romantic partners into this conversation too.

So, where do we find friends? This might sound silly, but finding friends can be challenging! When I first moved to California for my Ph.D., I didn’t have any friends out here. There were quite a few people in my program that I enjoyed spending time with. But, towards the end of school, they became very busy and were no longer able to dedicate time to hang out anymore. Thankfully, through the help of a very good therapist, I learned that it was important to enjoy life instead of striving for excellence all of the time. As a result, I learned how important it was to carve out time in my life for friends.

Unfortunately, the people I had dedicated time to thus far were achievement-oriented and were pouring their time into work and not our friendships. This forced me to seek out other ways to form connections with people. I ended up finding a local hiking group with the hopes of meeting people with similar interests. During one of these hikes, I met Jim, one of my best friends to this day.

We became instant friends. We have continued to support each other over the years, and even more importantly, we always make time for one another. We both view the friendship as one that makes each other’s lives better, therefore it’s always worth the time and energy. The backbone of any successful friendship is one where both sides put in equal effort and support.

Both Jim and I were forced to put in more effort when he moved across the country to the East Coast. Because we already had such a strong foundation, this didn’t impact our friendship. We talk all of the time and see each other several times a year. We make the relationship a priority no matter what coast each other is on. Like anything in life that is valuable to us, we must work at it and put time and effort into it.

When it's time to move on from a friendship

The second part of the friendship discussion can be a difficult one — reassessing your current friendships and potentially moving on from friends who don’t add value to your life.

Two of my best friends from high school went down different paths from me. We still keep in contact, but I don’t spend too much time with them anymore. The supporting, loving part of our relationship wasn’t there anymore, so it was no longer worth putting energy into maintaining a friendship that had changed so much.

This may be a story you can relate to. What I hope you take away from this post is this — friendships take energy, time, and commitment. And if you’re putting your time and energy into someone who isn’t enriching your life and giving you the support you need, it may be time to reevaluate that friendship.

If you find yourself in the market for friends (who isn’t?) I recommend you find groups or activities that you genuinely enjoy. This way you’ll have the opportunity to connect with people who have similar interests. And once you’re there, take a risk! Talk to people, exchange contact information, and follow up with them. It may feel scary at first, but the reward outweighs the momentary uncomfortable feeling you may have.

Friendship and dating

In many ways, the most important friendship in our lives is the one we have with our romantic partners. The first criteria we should look for in this partner is someone who is ultimately a good friend to us, meaning that they are kind, positive, loving, and supportive. If we’re dating someone and they’re a jerk, it’s probably safe to assume that they’re not a good friend. To avoid this, I recommend seeking out someone who is a good friend first, i.e. before the romance and sexual stuff gets in the way.

When there are bumps in a friendship or a romantic relationship , it’s important to work through those tough times. The tricky part is that it will take two people to fix that issue. We can only control our actions and hold ourselves accountable, but we cannot control our friend or our partner's reaction. In addition to our own actions, we have control over the friends or partners that we choose in the first place. If we prioritize choosing good people who we can trust will work through issues with us, then we can work through anything.

Friendships are a crucial part of living a fulfilling life. It’s so important that we surround ourselves with people who we have fun with, who support us, and people who make us better. You may already have beautiful friendships in your life, but if you’re still in the market for friends, it’s never too late to cultivate new relationships that will make your life even more magnificent.

T he car was all packed up; Ivana and her two children were belted in and ready to start the seven hour-long drive from Edinburgh to London, where they would be visiting on holiday. They were already running 45 minutes late, but they also couldn’t leave yet. One important thing was missing: Ivana’s husband. “He was inside, frying an egg,” she sighs. “He’d decided it would be a good time to have some breakfast.” Later, when he had finished his meal and returned to the car, he shrugged his shoulders and said to his family, “What’s the rush?”

Being chronically late is an affliction almost all of us will be familiar with. Whether it’s a partner, a best mate, or possibly even – whisper it – ourselves, we’ve all at one point or another been burdened by it . It can affect every facet of our daily lives: parties, meetings, dinners, gigs, flights, and so on. There is no limit to the number of plans a chronically late person can screw up for you. Sometimes catastrophically. And yet, there’s often nothing you can do about it. Being late is, after all, hardly the most egregious of crimes. Not when you compare it to standing someone up, for example, or cancelling last minute. But it’s irritating, particularly when it happens so often.

“I had a close friend who was always late, sometimes by 15 minutes, but often by over an hour,” says Mike*, 62, in Florida. “Over time, the lateness became more than just a minor annoyance: it felt like a sign of disrespect. We’d plan to meet for dinner, and I’d end up sitting alone, watching everyone around me enjoying their meals while I waited.” The last straw was when the pair had planned a surprise party for a mutual friend. “My chronically late friend showed up as the surprise was happening, completely missing the point of the whole event.”

Lateness is a strangely understudied phenomenon. According to a YouGov survey from 2012, one in 10 Britons admitted to being frequently late. Meanwhile, 28 per cent said their partner is usually late. There are no clear reasons behind chronic lateness. But the one that gets bandied around the most is usually self-involvement. “They were late because they thought their time was more important than mine,” is a common refrain among people with chronically late friends and partners. As is: “They’re always late because they’re so obsessed with themselves they couldn’t possibly consider how their timekeeping affects others.” In short, late people tend to get pretty bad press – and it’s not hard to see why it ruptures relationships.

“It can be perceived as a lack of respect or consideration from the family member or friend,” explains psychotherapist Kamalyn Kaur. “Trust in the relationship can also be eroded as it can make a person seem less reliable and dependable if they are always late. In some cases, the lateness can also make people feel undervalued, neglected or not as important, which can lead to arguments, misunderstandings, or even distance in the relationship.”

Most of the time, though, this is not the case. “I always think things will take less time than they do,” one chronically late friend tells me. “I just think I can get more done in a day. Then inevitably I can’t and I wind up being super late to everything, which is just as frustrating for me as it is for my friends.” As obvious as it might seem, poor timekeeping is a big, albeit frustratingly inane, reason for chronic lateness. “Time perception issues can also be the case for some individuals who are neurodivergent,” adds Kaur. “These people may find it hard to judge how long a task, travel time, and getting ready is going to take.”

It can create feelings of shame, inadequacy, guilt, or frustration when you’re always late to things. It makes you feel that you have let people down even though that might not be the case

Of course, there are instances where people do think their time is more important than other people’s. “I think sometimes we can be in phases of life where maybe there’s a particular hobby or a particular work, mission or project that is taking precedence over everything else in our lives,” explains Sami Wunder, a relationship coach. “There could be cases where somebody is chronically late because they are prioritising that [thing] over and above everything else.”

Occasionally, there are valid reasons for lateness that can be difficult for others to understand. “I am often late to things because of my Crohn’s,” says Sarah*, 51, in Hertfordshire. “It makes life very difficult as anxiety can make your stomach do erratic things. So, going to meetings, especially to meet people for the first time, makes me very anxious. But I don’t tell many people about my illness, so they mostly just think I’m late for no reason other than poor organisation.”

Perhaps more sympathy is needed for the chronically late among us, particularly because most of us want to be on time. “It can create feelings of shame, inadequacy, guilt, or frustration when you’re always late to things,” adds Kaur. “The individual might feel incapable of managing their time or meeting expectations, which can affect their overall self-esteem. It makes you feel that you have let people down even though that might not be the case.”

‘Improving chronic lateness involves practical steps and self-compassion’

In some cases, someone else’s lateness – and how it affects us – can tell us a lot about ourselves. After a while, Mike realised that his friend’s lateness affected him so viscerally because it reminded him of his childhood. “My mother used to arrive late to collect me from everything,” he recalls. “This was a time before mobile phones so I’d just wait and wait for her. With some perspective, I understood that I was punishing my friends in the present for things I was really angry at my mother for much more than them.”

Ivana has also learnt to grapple with her husband’s consistent lateness, seeing it as an invitation for her to slow down. “Only recently did I realise that he’s not going to change and if I stress out about him being late, it’s only going to make things worse,” she adds. “So I tried to see it from his perspective. It’s not easy but I’m getting there. I’m always two steps ahead and that’s not good either. So his slowness is helping me to slow down when I need to. This is how I’m trying to see it so I don’t go crazy.”

As for the chronically late themselves, rectifying those habits will often depend on the reason for their lateness. “Improving chronic lateness involves practical steps and self-compassion,” says Dr Elena Touroni, a consultant psychologist and co-founder of The Chelsea Psychology Clinic . “Start by using tools like planners and reminders to better manage your time. Breaking tasks into smaller, more manageable parts can also help avoid feeling overwhelmed.”

If the reasons for your lateness are related to deeper issues, such as ADHD or anxiety, seeking support from a therapist or counsellor can be very helpful. “Cognitive-behavioural techniques might assist in adjusting your time perceptions and habits,” adds Dr Touroni. “Remember, making gradual changes can lead to significant improvements over time.”

And those changes could be anything. It could mean seeking professional support from a therapist, or simply learning how to better map out your time by planning ahead. If all else fails, though, you could always just buy a watch.

JERUSALEM — Three hundred and thirty-two days after Hersh Goldberg-Polin danced in the courtyard next to his Jerusalem synagogue on the holiday of Simchat Torah, more than a thousand people gathered there in grief and prayer to mourn his murder by Hamas terrorists in Gaza.

During the Sunday night vigil, the courtyard railings were lined with oversized yellow ribbons to symbolize advocacy for the hostages, Hapoel Jerusalem soccer flags — the 23-year-old’s favorite team — and posters that read, “We love you, stay strong, survive,” a mantra coined by his mother, Rachel Goldberg-Polin.

Just hours earlier, one of the posters had been hanging over the balcony of the home of Shira Ben-Sasson, a leader of Hakhel, the Goldberg-Polins’ egalitarian congregation in the Baka neighborhood of Jerusalem.

“We were sure we would take it down when he came home,” Ben-Sasson said.

The community wanted to unite while respecting the Goldberg-Polins’ desire for privacy, she said, prompting them to organize the prayer gathering.

“But it’s like a Band-Aid or giving first aid, it’s what you do in an emergency. I don’t know how we go on after this,” she said.

She added that the community, which has a large contingent of English-speaking immigrants, was not prepared for the High Holidays, which begin in about a month. She said, “Seeing his empty seat is hard.”

For Ben-Sasson, who wore a T-shirt bearing the Talmudic dictum “There is no greater mitzvah than the redeeming of captives,” the tragedy is especially painful because, she said, it could have been avoided with a ceasefire agreement that freed hostages.

“Hersh was alive 48 hours ago. We think a deal could have saved him. There is no military solution to this,” she said.

That feeling of bereavement, often mixed with betrayal, pervaded gatherings across Israel on Sunday, as the country struggled with the news that six hostages who may have been freed in an agreement were now dead as negotiations continue to stall. Speakers at protests in Tel Aviv blamed Israeli Prime Minister Benjamin Netanyahu, who himself apologized for not getting the hostages out alive but blamed Hamas for obstructing a deal. The country’s labor union, the Histadrut, has called a national strike on Monday to demand a deal.

A rare early September rain lashed parts of Israel on Sunday, leading to a widespread interpretation: God, too, was weeping.

Some at the Jerusalem gathering, including the relative of another former hostage, said Netanyahu had chosen defeating Hamas over freeing the captives.

“We knew months ago this was going to happen. Bibi’s formula, to dismantle Hamas and return the hostages, wasn’t logical. It’s an either/or situation,” Engel said, referring to Netanyahu by his nickname. “He’s tearing the country apart. I’m afraid that in the coming months there won’t be a state at all.”

Engel said he felt a close bond with Hersh’s father Jon Polin, not only because of their joint activism in the hostage families’ tent outside the Prime Minister’s Residence, but also because of their shared identity as Jerusalemites.

“There aren’t many of us in the hostage circle,” he said. “We’re like family.”

Sarah Mann, who did not know the family personally, said the weekend’s tragedy reminded her of Oct. 7.

“This day has sparks of the seventh, which created numbness and an inability to talk. Just complete shock,” she said.

Part of the reason for that, Mann said, was Rachel, who she described as a “force of faith.” Goldberg-Polin’s mother emerged as the most prominent advocate for the hostages globally and became a symbol in her own right as she crisscrossed the world calling for her son’s freedom.

“Millions of people around the world held onto her. Once that was cut, people’s ability to hold onto faith was knocked out today. But even though this has shattered us, we need to keep holding onto God,” Mann said.

For Susi Döring Preston, the day called to mind was not Oct. 7 but Yom Kippur, and its communal solemnity.

She said she usually steers clear of similar war-related events because they are too overwhelming for her.

“Before I avoided stuff like this because I guess I still had hope. But now is the time to just give in to needing to be around people because you can’t hold your own self up any more,” she said, tears rolling down her face. “You need to feel the humanity and hang onto that.”

Like so many others, Döring Preston paid tribute to the Goldberg-Polins’ tireless activism. “They needed everyone else’s strength but we drew so much strength from them and their efforts, “she said. “You felt it could change the outcome. But war is more evil than good. I think that’s the crushing thing. You can do everything right, but the outcome is still devastating.”

Guy Gordon, a member of Hakhel who moved to Israel from Dublin, Ireland, in the mid-1990s, said the efforts towards ensuring Hersh’s safe return have been an anchor for the community during the war. The community knew him as the family described him in its announcement of his funeral on Tuesday, as “a child of light, love and peace” who enjoyed exploring the world and coming home to his family, including his parents and younger sisters, Leebie and Orly.

“It gave us something to hope for, and pray for and to demonstrate for,” he said. “We had no choice but to be unreasonably optimistic. Tragically it transpired that he survived until the very end.”

Gordon, like many others in the crowd, wore a piece of duct tape marked with the number of days since Oct. 7 — a gesture initiated by Goldberg-Polin’s mother. Unlike on previous days, though, his tape also featured a broken red heart beside the number.

Nadia Levene, a family friend, also reflected on the improbability of Hersh’s survival.

“He did exactly what his parents begged him to do. He was strong. He did survive. And look what happened,” Levene said.

She hailed Rachel Goldberg-Polin’s “unwavering strength and belief in God,” adding, “There were times I lost faith. I suppose I was angry with God. But she just kept inspiring us all to pray, pray, pray.”

Jerusalem resident Leah Silver rejected politicizing the hostages’ deaths.

“Everything turns political so quickly. I came here because I felt that before all the protests, we need to just mourn for a moment and to pray. And show respect for each other,” she said. “We’ve become confused about who the enemy is. It’s very sad.”

But not everyone at the gathering joined in to sing Israel’s national anthem at the closing of the prayer gathering.

“I’m sorry, I can’t sing ‘Hatikvah,'” Reza Green, a Baka resident who did not know the Goldberg-Polins personally, said. “I’m too angry. We shouldn’t be here.”

This is my weekly newsletter (it's one day late), which includes 7 weeknight meals + 3 healthy salads (for the week of September 2-8, 2024), and a brief life update.

DAY 6: Chicken with Apricots and Honey-Lime Sauce (30-Minute, One-Pan Meal). You can use peaches, nectarines, plums, or apples instead of apricots. Or, soak dried apricots briefly in a pot of boiling water to plump them up, drain them well, and slice them up.

LIFE UPDATE

Julia is hiking in August 2024.

It's been a bit of a hectic week, and I've been in constant catch-up mode, having to solve many problems and handle numerous tedious tasks and minutiae. On top of that, I've had more doctor's appointments in the last 30 days than I'd like. I was unexpectedly diagnosed with severe anemia , so serious that it needs immediate attention, and it cannot be put on a back burner.

My July lab results were alarming, with nearly all of my red blood cell metrics flagged with High Alert notifications. For example, my Ferritin 5 ng/mL (normal range should be 15-150), Iron 12 ug/dL (normal range should be 17-159) , Iron Saturation 3% (normal range should be 15-55%), Hemoglobin 7.7 g/dL (normal range is 11.1 - 15.9). Anemia is typically categorized as mild, moderate, or severe. Unfortunately, all my numbers fall into the "severe" category, which explains why my doctor kept persistently trying to reach me on the phone in the last 3 weeks.

Living at 9,000 feet, my red blood cell count should be high (as it usually has been), but right now, I'm operating with the bare minimum. In fact, my red blood cell count is currently much lower than it should be, even for someone at sea level. My iron absorption is almost nonexistent at 3% (compared to the normal 50%), leading to dangerously low hemoglobin levels. This means there's hardly any oxygen being carried through my blood to my lungs, muscles, and other vital organs. It all makes sense now—I've been consistently 20 minutes slower on my usual hikes and couldn't push myself harder without nearly passing out. This has been happening for a year and a half now. My initial instinct was to ignore all of this for a while with the hope that the anemia resolves itself on its own since I have so much on my plate right now and so much to catch up on. But then I realized that would be foolish—it could actually be life-threatening. So, I’ve started taking it seriously by taking supplements, eating plenty of red meat, and regularly incorporating chicken liver, beets, Vitamin C into my diet to boost my iron levels.

Unfortunately, because of all that hecticness, I got thrown off my usual routines, which I always find frustrating.

On a brighter note, even though I've been bogged down with many tedious tasks and dealing with my anemia that showed up out of nowhere, I'm happy to say I'm finally catching up. I've started filming new recipes and have already photographed four new amazing recipes with red meat, with plans to do many more this week. And, of course, I've made sure to get outside and hike three times a week—that always helps me stay grounded.

Dear Julia, I’m so sorry to hear you are experiencing medical problems. I hope there is an easy remedy for it. About 18 months ago I discovered your recipes which have been very helpful to me. I was diagnosed with a severe intestinal issue that required a strictly limited list of edible products. Any gluten, dairy, beef, pork, or products including any of those are not allowed. Mainly I can have poultry or fish, rice, plain potato, most fruits and vegetables—although there are significant limitations to that list also. Your recipes have helped me to recover completely, for which you have my sincere gratitude. The recipes have been easy to adapt to my needs as required. However, since this new food regimen has been so helpful I have to stick to it forever. Obviously my menus have changed considerably but my family has been supportive. If they want hamburgers and ice cream they go out for them rather then tempt me. Another plus is that I dropped 50 pounds in less than a year and am maintaining that loss. Of course that required a whole new wardrobe. Another plus! All this is to say your foods heal and I pray they will benefit you, too. Thank you, A Grateful Follower Austin, Texas.

George Clooney and Brad Pitt debuted their film Wolfs at the Venice International Film Festival while enjoying a sweet double date with their better halves.

George, 63, and wife Amal Clooney posed on the red carpet with Pitt, 60, and his girlfriend, Ines de Ramon , on Sunday, September 1. The outing also marked Pitt’s formal red carpet debut with de Ramon, 34.

One day earlier, the foursome were photographed taking a traditional water taxi ride with Pitt and de Ramon, in photos obtained by Vogue . The group rode the boat to Ristorante Da Ivo, per People , for a special dinner. The eatery is one of George and the attorney’s favorite restaurants in Venice.

George and Pitt have been friends — and Oceans franchise costars — for years. Wolfs is their next collaboration, in which they play rival “fixers” hired to cover up a high-profile crime.

“We’ve been friends for a long time. And it’s fun because we also check in on each other every once in a while, which is an important part of this,” George told GQ in a joint profile published earlier this month. “Things get complicated in life and you always have to make sure everybody’s OK.”

Supreme Court rejects bid to restrict access to abortion pill

In a blow for anti-abortion advocates, the  Supreme Court  on Thursday rejected a challenge to the abortion pill mifepristone , meaning the commonly used drug can remain widely available.

The court  found unanimously  that the group of anti-abortion doctors who questioned the Food and Drug Administration’s decisions making it easier to access the pill did not have legal standing to sue. 

President Joe Biden said in a statement that while the ruling means the pill can remain easily accessible, “the fight for reproductive freedom continues” in the aftermath of the Supreme Court’s ruling two years ago that overturned abortion rights landmark Roe v. Wade.

“It does not change the fact that the right for a woman to get the treatment she needs is imperiled if not impossible in many states,” he added.

Justice Brett Kavanaugh, writing for the court, wrote that while plaintiffs have “sincere legal, moral, ideological, and policy objections to elective abortion and to FDA’s relaxed regulation of mifepristone,” that does not mean they have a federal case.

The plaintiffs failed to show they had suffered any injury, meaning that “the federal courts are the wrong forum for addressing the plaintiffs’ concerns about FDA’s actions,” he added.

“The plaintiffs may present their concerns and objections to the president and FDA in the regulatory process or to Congress and the president in the legislative process,” Kavanaugh wrote. “And they may also express their views about abortion and mifepristone to fellow citizens, including in the political and electoral processes.”

The legal challenge was brought by doctors and other medical professionals represented by the conservative Christian legal group Alliance Defending Freedom.

“We are disappointed that the Supreme Court did not reach the merits of the FDA’s lawless removal of commonsense safety standards for abortion drugs,” said Erin Hawley, one of the group’s lawyers. She told reporters she is hopeful the underlying lawsuit can continue because three states — Idaho, Missouri and Kansas — have brought their own claims and have different arguments for standing.

By throwing out the case on such grounds, the court avoided reaching a decision on the legal merits of whether the FDA acted lawfully in lifting various restrictions, including one making the drug obtainable via mail, meaning the same issues could yet return to the court in another case.

Another regulatory decision left in place means women can still obtain the pill within 10 weeks of gestation instead of seven. 

Likewise a decision to allow health care providers other than physicians to dispense the pill will remain in effect.

The court’s decision to roll back abortion rights two years ago led to a wave of new abortion restrictions in conservative states.

Then, the court suggested it was removing itself from the political debate over abortion, but with litigation continuing to rage over abortion access, the justices are continuing to play a pivotal role. 

Abortion rights supporters welcomed the ruling, with Nancy Northup, president of the Center for Reproductive Rights, saying she was relieved at the outcome but angered about the case lingering in the court system so long.

“Thank goodness the Supreme Court rejected this unwarranted attempt to curtail access to medication abortion, but the fact remains that this meritless case should never have gotten this far,” she said in a statement.

Danco Laboratories, manufacturer of Mifeprex, the brand version of mifepristone, praised the ruling too, saying it was good for the drug approval process writ large.

In rejecting the challenge, the court “maintained the stability of the FDA drug approval process, which is based on the agency’s expertise and on which patients, health care providers and the U.S. pharmaceutical industry rely,” company spokeswoman Abigail Long said.

Anti-abortion groups expressed disappointment, saying that the ruling highlighted the importance of this year’s election in which Democrat Biden, who has pledged to defend abortion rights, faces off against Republican Donald Trump, who has the strong backing of conservatives who oppose abortion.

“Joe Biden and the Democrats are hell-bent on forcing abortion on demand any time for any reason, including DIY mail-order abortions, on every state in the country,” Marjorie Dannenfeiser, president of SBA Pro-Life America, said.

If Trump were to win the election, his appointees to the FDA would be a position to impose new restrictions on mifepristone. Biden’s campaign manager, Julie Chavez-Rodriguez, alluded to the possibility in a call with reporters after the ruling. Calling the case “one tactic in a broader, relentless strategy” by anti-abortion activists, Chavez-Rodriguez said if Trump is elected, his advisers and allies would try to ban abortion nationwide “without the help of Congress or the court,” and also restrict access to contraception — a threat, she said, to blue as well as red states.

The mifepristone dispute is not the only abortion case currently before the court. It is also due to decide whether  Idaho’s strict abortion ban  prevents doctors in emergency rooms from performing abortions when a pregnant woman is facing dangerous complications.

Mifepristone is used as part of a two-drug FDA-approved regimen that is now the most common form of abortion in the United States.

Abortion is effectively banned altogether in 14 states, according to the Guttmacher Institute, a research group that backs abortion rights.

The FDA had the backing of the pharmaceutical industry, which has warned that any second-guessing of the approval process by untrained federal judges could  cause chaos and deter innovation.

Last year, Texas-based U.S. District Judge Matthew Kacsmaryk issued a sweeping ruling that completely invalidated the FDA’s approval of the pill, leading to panic among abortion-rights activists that it would be banned nationwide.

The Supreme Court last April put that ruling on hold, meaning the pill remained widely available while litigation continued.

The New Orleans-based 5th U.S. Circuit Court of Appeals in August then narrowed Kacsmaryk’s decision but left in place his conclusion that the FDA’s move to lift restrictions starting in 2016 was unlawful.

Both sides appealed to the Supreme Court. The court in December took up the Biden administration’s appeal in defense of the later FDA decisions, but it opted against hearing the challenge to the original approval of mifepristone in 2000. 

The Supreme Court focused solely on the later FDA action, including the initial 2021 decision that made the drug available by mail, which was finalized last year.

Abrams environmental law clinic—significant achievements for 2023-24, protecting our great lakes, rivers, and shorelines.

The Abrams Clinic represents Friends of the Chicago River and the Sierra Club in their efforts to hold Trump Tower in downtown Chicago accountable for withdrawing water illegally from the Chicago River. To cool the building, Trump Tower draws water at high volumes, similar to industrial factories or power plants, but Trump Tower operated for more than a decade without ever conducting the legally required studies to determine the impact of those operations on aquatic life or without installing sufficient equipment to protect aquatic life consistent with federal regulations. After the Clinic sent a notice of intent to sue Trump Tower, the State of Illinois filed its own case in the summer of 2018, and the Clinic moved successfully to intervene in that case. In 2023-24, motions practice and discovery continued. Working with co-counsel at Northwestern University’s Pritzker Law School’s Environmental Advocacy Center, the Clinic moved to amend its complaint to include Trump Tower’s systematic underreporting each month of the volume of water that it intakes from and discharges to the Chicago River. The Clinic and co-counsel addressed Trump Tower’s motion to dismiss some of our clients’ claims, and we filed a motion for summary judgment on our claim that Trump Tower has committed a public nuisance. We also worked closely with our expert, Dr. Peter Henderson, on a supplemental disclosure and on defending an additional deposition of him. In summer 2024, the Clinic is defending its motion for summary judgment and challenging Trump Tower’s own motion for summary judgment. The Clinic is also preparing for trial, which could take place as early as fall 2024.

Since 2016, the Abrams Clinic has worked with the Chicago chapter of the Surfrider Foundation to protect water quality along the Lake Michigan shoreline in northwest Indiana, where its members surf. In April 2017, the U. S. Steel plant in Portage, Indiana, spilled approximately 300 pounds of hexavalent chromium into Lake Michigan. In January 2018, the Abrams Clinic filed a suit on behalf of Surfrider against U. S. Steel, alleging multiple violations of U. S. Steel’s discharge permits; the City of Chicago filed suit shortly after. When the US government and the State of Indiana filed their own, separate case, the Clinic filed extensive comments on the proposed consent decree. In August 2021, the court entered a revised consent decree which included provisions advocated for by Surfrider and the City of Chicago, namely a water sampling project that alerts beachgoers as to Lake Michigan’s water quality conditions, better notifications in case of future spills, and improvements to U. S. Steel’s operations and maintenance plans. In the 2023-24 academic year, the Clinic successfully litigated its claims for attorneys’ fees as a substantially prevailing party. Significantly, the court’s order adopted the “Fitzpatrick matrix,” used by the US Attorney’s Office for the District of Columbia to determine appropriate hourly rates for civil litigants, endorsed Chicago legal market rates as the appropriate rates for complex environmental litigation in Northwest Indiana, and allowed for partially reconstructed time records. The Clinic’s work, which has received significant media attention, helped to spawn other litigation to address pollution by other industrial facilities in Northwest Indiana and other enforcement against U. S. Steel by the State of Indiana.

In Winter Quarter 2024, Clinic students worked closely with Dr. John Ikerd, an agricultural economist and emeritus professor at the University of Missouri, to file an amicus brief in Food & Water Watch v. U.S. Environmental Protection Agency . In that case pending before the Ninth Circuit, Food & Water Watch argues that US EPA is illegally allowing Concentrated Animal Feeding Operations, more commonly known as factory farms, to pollute waterways significantly more than is allowable under the Clean Water Act. In the brief for Dr. Ikerd and co-amici Austin Frerick, Crawford Stewardship Project, Family Farm Defenders, Farm Aid, Missouri Rural Crisis Center, National Family Farm Coalition, National Sustainable Agriculture Coalition, and Western Organization of Resource Councils, we argued that EPA’s refusal to regulate CAFOs effectively is an unwarranted application of “agricultural exceptionalism” to industrial agriculture and that EPA effectively distorts the animal production market by allowing CAFOs to externalize their pollution costs and diminishing the ability of family farms to compete. Attorneys for the litigants will argue the case in September 2024.

Energy and Climate

Energy justice.

The Abrams Clinic supported grassroots organizations advocating for energy justice in low-income communities and Black, Indigenous, and People of Color (BIPOC) communities in Michigan. With the Clinic’s representation, these organizations intervened in cases before the Michigan Public Service Commission (MPSC), which regulates investor-owned utilities. Students conducted discovery, drafted written testimony, cross-examined utility executives, participated in settlement discussions, and filed briefs for these projects. The Clinic’s representation has elevated the concerns of these community organizations and forced both the utilities and regulators to consider issues of equity to an unprecedented degree. This year, on behalf of Soulardarity (Highland Park, MI), We Want Green, Too (Detroit, MI), and Urban Core Collective (Grand Rapids, MI), Clinic students engaged in eight contested cases before the MPSC against DTE Electric, DTE Gas, and Consumers Energy, as well as provided support for our clients’ advocacy in other non-contested MPSC proceedings.

The Clinic started this past fall with wins in three cases. First, the Clinic’s clients settled with DTE Electric in its Integrated Resource Plan case. The settlement included an agreement to close the second dirtiest coal power plant in Michigan three years early, $30 million from DTE’s shareholders to assist low-income customers in paying their bills, and $8 million from DTE’s shareholders toward a community fund that assists low-income customers with installing energy efficiency improvements, renewable energy, and battery technology. Second, in DTE Electric’s 2023 request for a rate hike (a “rate case”), the Commission required DTE Electric to develop a more robust environmental justice analysis and rejected the Company’s second attempt to waive consumer protections through a proposed electric utility prepayment program with a questionable history of success during its pilot run. The final Commission order and the administrative law judge’s proposal for final decision cited the Clinic’s testimony and briefs. Third, in Consumers Electric’s 2023 rate case, the Commission rejected the Company’s request for a higher ratepayer-funded return on its investments and required the Company to create a process that will enable intervenors to obtain accurate GIS data. The Clinic intends to use this data to map the disparate impact of infrastructure investment in low-income and BIPOC communities.

In the winter, the Clinic filed public comments regarding DTE Electric and Consumers Energy’s “distribution grid plans” (DGP) as well as supported interventions in two additional cases: Consumers Energy’s voluntary green pricing (VGP) case and the Clinic’s first case against the gas utility DTE Gas. Beginning with the DGP comments, the Clinic first addressed Consumers’s 2023 Electric Distribution Infrastructure Investment Plan (EDIIP), which detailed current distribution system health and the utility’s approximately $7 billion capital project planning ($2 billion of which went unaccounted for in the EDIIP) over 2023–2028. The Clinic then commented on DTE Electric’s 2023 DGP, which outlined the utility’s opaque project prioritization and planned more than $9 billion in capital investments and associated maintenance over 2024–2028. The comments targeted four areas of deficiencies in both the EDIIP and DGP: (1) inadequate consideration of distributed energy resources (DERs) as providing grid reliability, resiliency, and energy transition benefits; (2) flawed environmental justice analysis, particularly with respect to the collection of performance metrics and the narrow implementation of the Michigan Environmental Justice Screen Tool; (3) inequitable investment patterns across census tracts, with emphasis on DTE Electric’s skewed prioritization for retaining its old circuits rather than upgrading those circuits; and (4) failing to engage with community feedback.

For the VGP case against Consumers, the Clinic supported the filing of both an initial brief and reply brief requesting that the Commission reject the Company’s flawed proposal for a “community solar” program. In a prior case, the Clinic advocated for the development of a community solar program that would provide low-income, BIPOC communities with access to clean energy. As a result of our efforts, the Commission approved a settlement agreement requiring the Company “to evaluate and provide a strawman recommendation on community solar in its Voluntary Green Pricing Program.” However, the Company’s subsequent proposal in its VGP case violated the Commission’s order because it (1) was not consistent with the applicable law, MCL 460.1061; (2) was not a true community solar program; (3) lacked essential details; (4) failed to compensate subscribers sufficiently; (5) included overpriced and inflexible subscriptions; (6) excessively limited capacity; and (7) failed to provide a clear pathway for certain participants to transition into other VGP programs. For these reasons, the Clinic argued that the Commission should reject the Company’s proposal.

In DTE Gas’s current rate case, the Clinic worked with four witnesses to develop testimony that would rebut DTE Gas’s request for a rate hike on its customers. The testimony advocated for a pathway to a just energy transition that avoids dumping the costs of stranded gas assets on the low-income and BIPOC communities that are likely to be the last to electrify. Instead, the testimony proposed that the gas and electric utilities undertake integrated planning that would prioritize electric infrastructure over gas infrastructure investment to ensure that DTE Gas does not over-invest in gas infrastructure that will be rendered obsolete in the coming decades. The Clinic also worked with one expert witness to develop an analysis of DTE Gas’s unaffordable bills and inequitable shutoff, deposit, and collections practices. Lastly, the Clinic offered testimony on behalf of and from community members who would be directly impacted by the Company’s rate hike and lack of affordable and quality service. Clinic students have spent the summer drafting an approximately one-hundred-page brief making these arguments formally. We expect the Commission’s decision this fall.

Finally, both DTE Electric and Consumers Energy have filed additional requests for rate increases after the conclusion of their respective rate cases filed in 2023. On behalf of our Clients, the Clinic has intervened in these cases, and clinic students have already reviewed thousands of pages of documents and started to develop arguments and strategies to protect low-income and BIPOC communities from the utility’s ceaseless efforts to increase the cost of energy.

Corporate Climate Greenwashing

The Abrams Environmental Law Clinic worked with a leading international nonprofit dedicated to using the law to protect the environment to research corporate climate greenwashing, focusing on consumer protection, green financing, and securities liability. Clinic students spent the year examining an innovative state law, drafted a fifty-page guide to the statute and relevant cases, and examined how the law would apply to a variety of potential cases. Students then presented their findings in a case study and oral presentation to members of ClientEarth, including the organization’s North American head and members of its European team. The project helped identify the strengths and weaknesses of potential new strategies for increasing corporate accountability in the fight against climate change.

Land Contamination, Lead, and Hazardous Waste

The Abrams Clinic continues to represent East Chicago, Indiana, residents who live or lived on or adjacent to the USS Lead Superfund site. This year, the Clinic worked closely with the East Chicago/Calumet Coalition Community Advisory Group (CAG) to advance the CAG’s advocacy beyond the Superfund site and the adjacent Dupont RCRA site. Through multiple forms of advocacy, the clinics challenged the poor performance and permit modification and renewal attempts of Tradebe Treatment and Recycling, LLC (Tradebe), a hazardous waste storage and recycling facility in the community. Clinic students sent letters to US EPA and Indiana Department of Environmental Management officials about how IDEM has failed to assess meaningful penalties against Tradebe for repeated violations of the law and how IDEM has allowed Tradebe to continue to threaten public and worker health and safety by not improving its operations. Students also drafted substantial comments for the CAG on the US EPA’s Lead and Copper Rule improvements, the Suppliers’ Park proposed cleanup, and Sims Metal’s proposed air permit revisions. The Clinic has also continued working with the CAG, environmental experts, and regulators since US EPA awarded $200,000 to the CAG for community air monitoring. The Clinic and its clients also joined comments drafted by other environmental organizations about poor operations and loose regulatory oversight of several industrial facilities in the area.

Endangered Species

The Abrams Clinic represented the Center for Biological Diversity (CBD) and the Hoosier Environmental Council (HEC) in litigation regarding the US Fish and Wildlife Service’s (Service) failure to list the Kirtland’s snake as threatened or endangered under the Endangered Species Act. The Kirtland’s snake is a small, secretive, non-venomous snake historically located across the Midwest and the Ohio River Valley. Development and climate change have undermined large portions of the snake’s habitat, and populations are declining. Accordingly, the Clinic sued the Service in the US District Court for the District of Columbia last summer over the Service’s denial of CBD’s request to have the Kirtland’s snake protected. This spring, the Clinic was able to reach a settlement with the Service that requires the Service to reconsider its listing decision for the Kirtland’s snake and to pay attorney fees.

The Clinic also represented CBD in preparation for litigation regarding the Service’s failure to list another species as threatened or endangered. Threats from land development and climate change have devastated this species as well, and the species has already been extirpated from two of the sixteen US states in its range. As such, the Clinic worked this winter and spring to prepare a notice of intent (NOI) to sue the Service. The Team poured over hundreds of FOIA documents and dug into the Service’s supporting documentation to create strong arguments against the Service in the imminent litigation. The Clinic will send the NOI and file a complaint in the next few months.

Students and Faculty

Twenty-four law school students from the classes of 2024 and 2025 participated in the Clinic, performing complex legal research, reviewing documents obtained through discovery, drafting legal research memos and briefs, conferring with clients, conducting cross-examination, participating in settlement conferences, and arguing motions. Students secured nine clerkships, five were heading to private practice after graduation, and two are pursuing public interest work. Sam Heppell joined the Clinic from civil rights private practice, bringing the Clinic to its full complement of three attorneys.
