This guide describes the organization of federal administrative law materials - and how to find them.

Administrative Agencies

Administrative agencies are government bodies "authorized to implement legislative directives by developing more precise and technical rules than possible in a legislative setting.  Many administrative agencies also have law enforcement responsibilities."   Administrative Agency , Wex .  These agencies draw authority from both Congress and the Executive. Agencies are typically created by Congress through the enactment of "enabling" statutes. Each agency is as unique in structure as its enabling statute. An agency may:

  • Promulgate regulations designed to implement law or policy
  • Issue orders to describe the final disposition of agency action
  • Issue licenses, permits, or other permissions
  • Issue advisory opinions with binding, non-precedential advice
  • Issue decisions arising from a quasi-adjudicative process

Administrative law research has three distinct but related content areas:

  • Substantive administrative law and the underlying powers and procedures of administrative agencies
  • Regulatory activities and actions of administrative agencies, including agency regulations, decisions and reports
  • Issuances of the President, namely Executive Orders

Intro to the APA

The  Administrative Procedure Act , Pub. L. 79-404 (1946) requires that agencies follow certain steps when putting rules into effect.  Under the APA, agencies must:

  • Publish a notice of proposed rulemaking in the Federal Register
  • Take comments from “interested persons” on the proposed rule
  • Publish a final rule in the Federal Register after considering those comments
  • Make the rule effective not less than 30 days after it is published.   

Around the time when the APA was passed, the Attorney General released a manual:

Federal Register

Final Rules, Proposed Rules, and Notices of federal agencies are first published in the Federal Register, a daily government publication.  Each modern issue of the modern Federal Register also contains these sections: CFR Parts Affected, Presidential Documents, and Corrections.  The first edition of the Federal Register was published March 14, 1936, and publication continues to this day.

The federal register is accessible through a number of sources including:

Citations to the Federal Register will contain "Fed. Reg."

  • The Bluebook: a Uniform System of Citation Federal Register Citations are governed by Bluebook Rule 14.

Code of Federal Regulations (CFR)

General and permanent rules and regulations are published in the Code of Federal Regulations (CFR) .  The CFR is organized into 50 topical titles (typically named for the issuing agency). Chapters are further subdivided into parts and subparts. Parts are organized in sections.  The first edition of the CFR was published in 1939 containing regulations in force on June 1, 1938.  An Index to the Code of Federal Regulations is available from the National Archive.

A Source Note at the beginning of each CFR part provides the Federal Register citation and date where the part was published. If a particular section was added or amended later, a separate source note will follow that section.  The CFR is updated by amendments and new rules and regulations in the Federal Register. 

The full CFR is printed once a year, with updates occurring one-quarter of the set at a time.

  • Titles 42-50: October 1

Citations to the Code of Federal Regulations will contain "C.F.R."  Citations to the CFR are most typically provided at either the part or section level.

Updating Your Research

The CFR is published once a year; thus, any language in the latest published CFR must be checked for currency.  To establish the current validity of an existing regulation, find and read case law (in your jurisdiction) that cites your regulation.  Look out for court constitutionality rulings and other holdings affecting the rule's "good law" status.  Often the fastest and easiest way to update regulations is to use a citator (like Shepard's or Key Cite).  However, you can also update your research using the following free online sources:

  • List of Sections Affected (LSA)

Updating with Federalregister.gov

Federalregister.gov offers a useful tool for checking updates, or proposed changes, to current CFR sections.  Under the Search Tab, select "Advanced Document Search."  Scroll down until you see the field "Affecting CFR Part," and enter the relevant section.

Updating with List of Sections Affected

  • Find the text of the regulation in the CFR; note the revision date on the cover of the volume.
  • Check the most recent LSA.  Compare the date on your CFR volume to the inclusive dates listed on the title page of the LSA. If there is a time gap between the date on your CFR volume and the coverage of the latest LSA, check the annual cumulation(s) of the LSA for your title.
  • Check the list of "CFR Parts Affected during [month]" in the Federal Register issue for the last day of each full month not covered by step 2.
  • Check the cumulative list of "CFR Parts Affected" in the last issue of the Federal Register for the current month.
  • Using the citations found in steps 2-4, if any, check the Federal Register issues cited to see the text of the changes.

Administrative agencies act in a judicial-like capacity when issuing decisions that interpret and enforce regulations.  These decisions are rarely gathered in one place, and some agencies do not publish decisions in any format. Administrative agency websites are a great place to start. The University of Virginia Law Library publishes a guide which provides links to agency opinions and publications:

Some agencies publish official reports of their decisions in print reporters or binders called loose-leaf services. For older administrative decisions, print publications may be the only source. The Bluebook lists:

Executive materials are found in Title 3 of the CFR.  Presidential Documents are found in the back of each day’s Federal Register.  In addition, the White House website offers a great amount of information and access to Executive documents.

  • Office of Information and Regulatory Affairs (OIRA) Located within the Office of Management and Budget (of the White House), OIRA carries out several important Executive functions, including reviewing federal regulations, reducing paperwork burdens, and overseeing policies relating to privacy, information quality, and statistical programs. 367 Advanced Topics in Administrative Law

The objective of this course is to provide students the tools to delve deeper into policy questions that are currently arising in administrative law: What is the purpose of the administrative state?  How is it serving the public?  What are the costs and benefits of agency specialization and independence?  To what extent is public participation helpful in maintaining accountability?

Because administrative agencies are decision-making bodies that are not directly accountable to the electorate, accountability is often achieved by encouraging public participation, transparency, and notice.  This course will explore these themes in the context of selected administrative law topics.  Example topics include: agency capture, independence of administrative law judges, over-specialization of agency-specific precedent, preclusion of judicial review, public participation in rulemaking, the Freedom of Information Act, policy-making through adjudication, and informal agency action.  For certain topics, we will focus on one or two illustrative agencies (e.g., EPA, NLRB, PTO, IRS, VA, etc.).  Reading materials will include textbook excerpts, cases, and legal scholarship.  A previous administrative law course is preferred but not required.

Each class will consist of a background lecture followed by an interactive discussion of the policy issues raised in the reading.  The course will be taught as a two-hour weekly seminar, focused on class discussion of assigned readings. Students will complete one 25–30 page research paper that can be used to satisfy the upper-level writing requirement.  Students will also present their research papers to the class towards the end of the semester.

Special Topics in Administrative Law – 6651

Special Topics in Administrative Law will cover all of the foundational material that is typically included in Administrative Law and Advanced Administrative Law curricula. This course, however, uses traditional administrative law doctrine to explore many of the contemporary, ongoing, unresolved regulatory issues the nation now confronts. For instance, driverless cars, billionaire space travel, social media company rights and responsibilities, federal response to future pandemics, climate change models, and outdated flood maps, are just some of the many areas in which regulatory standards will have to be updated and amended moving forward. But how and by whom? We will dive deeply into these issues and many more.     

To keep the subject matter of the course fresh, to stay abreast of the latest developments in administrative law, and to address student interests, a portion of the subject matter covered in this course will vary from year to year. Topics covered previously have included: Oversight and Independent Investigations; Presidential Power, Executive Orders, National Emergencies & States of Exception; Government Benefits and the Termination of Benefits; Access to Justice; Structural Reform; and Executive Privilege.

Through deep analyses of these Special Topics, students will gain a greater understanding of the laws and doctrines governing the administrative practices of federal government agencies and judicial review. The final paper in this course satisfies the Upper Division Writing Requirement.

12 Finding and Using Administrative Law

Learning goals.

After reading this chapter, you will be able to

  • Find agency decisions and guidance on free websites and commercial platforms.

Most law students do not have much time or opportunity to research administrative law during first year legal research and writing courses. The first part of this chapter will explain how administrative law fits into the legal research landscape. The next part will discuss administrative law resources and where to find them.

What is Administrative Law?

Administrative law (both federal and state) is the law governing the creation and operation of administrative agencies. Most administrative agencies (including boards, commissions, and departments) are part of the executive branch of government. Legislatures establish agencies and give them their powers through enabling statutes. Some state agencies are established through the state constitution. Thorough and accurate legal research requires you to find, read, and analyze administrative rules and decisions because they are primary sources of law, just like statutes and cases.

Sources of Administrative Law

Agencies promulgate rules (also called regulations) that administer, implement, apply, and interpret statutes in the agencies’ jurisdiction. Agencies also conduct investigations and inspections to determine if regulations are being followed, and issue licenses and permits. Also, agencies, via administrative law judges, hold hearings and decide cases involving the agencies’ rules. Therefore, when you are searching for relevant administrative law, you will be looking for enabling legislation, agency rules/regulations, agency guidance like interpretive opinions or procedural manuals, administrative decisions, and possibly federal court decisions reviewing agency actions or decisions.

You can find a list of all federal administrative agencies on the Federal Register website . As you can see from this sampling, administrative rules touch every part of our lives.

State (Oregon)

Below is a sampling of state agencies in Oregon. You can find a full list of Oregon administrative agencies on the State of Oregon’s website .

You can find agencies for any state, usually by looking at the state website. For example, in California, the state website lists their administrative agencies. Similarly, the Washington state website has an agency directory page .

Where do you find Administrative Law?

Administrative procedure act.

The Administrative Procedure Act (APA), Title 5 U.S.C. § 551 et seq., governs agencies’ rulemaking procedures, addresses agencies’ issuance of licenses and permits, and sets out standards for judicial review of agency actions. The APA may be an important part of your research if the issue involves a challenge to the scope of the agency’s authority to take a specific action.

Enabling Statutes

An enabling statute establishes the powers and responsibilities of a government agency. For example, Congress established the United States Patent and Trademark Office (USPTO) by passing Title 35 U.S.C. § 1.pdf . Title 35 U.S.C. § 2 outlines the powers and duties of the agency and § 3 designates officers and employees of the agency. You find enabling statutes by searching the sections of a Title that governs your legal issue, or by using a table of contents for the United States Code.

Agencies issue rules just like legislatures pass statutes. However, rules are subordinate to statutes in that they implement, interpret, and prescribe the statutory law. Administrative agencies have more expertise than the legislature in the subject matter, so they are able to provide more details and set particular standards for implementation of a more general statutory law. An agency rule is defined as

“the whole or part of an agency statement of general or particular applicability and future effect designed to implement, interpret, or prescribe law or policy or describing the organization, procedure, or practice requirements of an agency and includes the approval or prescription for the future of rates, wages, corporate or financial structures or reorganizations thereof, prices, facilities, appliances, services or allowances therefor or of valuations, costs, or accounting, or practices bearing on any of the foregoing.”

5 U.S.C. § 551(4).

A Proposed Rule (Notice of Proposed Rulemaking) is published in the Federal Register for public comment. Citations to proposed rules will have a Federal Register citation such as, 88 FR 33968. After the comment period, the agency will finalize the rule and then publish the final rule in the Federal Register, with an effective date and notice of the changes that the new rule makes to the Code of Federal Regulations. The new rule is then integrated into the e-CFR , which is an unofficial but authoritative compilation published by the Office of the Federal Register and the Government Printing Office. The official edition of the CFR is published annually; each of the 50 subject matter titles are re-published each year on a staggered, quarterly basis. Once a final rule is codified into the CFR, it will have a citation such as 10 CFR 431.

In addition to using government databases such as the Government Printing Office (govinfo.gov) , federalregister.gov , e-CFR , and agency websites, you can find federal regulations, both the Federal Register and the Code of Federal Regulations, on Westlaw, Lexis, and Bloomberg.

Agency Decisions

Pursuant to the APA, agencies have some quasi-judicial powers to adjudicate matters having to do with enforcement of their rules. For example, the United States Patent and Trademark Office uses its Trademark Trial and Appeal Board (TTAB) to handle appeals involving applications to register trademarks, appeals from expungement proceedings involving registrations of trademarks, and trials involving applications or registrations of trademarks. You can find TTAB decisions on the USPTO website.

You can find some agency decisions on Westlaw, Lexis, and Bloomberg as well.

On Westlaw, navigate to federal materials, then select the Federal Administrative Decisions & Guidance link. Westlaw provides access to some, but not all decisions from executive branch or independent agencies and offices.

On Lexis, choose the “federal” tab, then select federal administrative materials. Lexis provides access to various types of administrative information such as decisions, directives, memoranda, papers, and news releases for executive branch and independent agencies.

Bloomberg has multiple access points for U.S. government agency information. For example, you can look at All Legal Content or search in topical practice centers.

Agency Guidance

In addition to rules and formal adjudications, agencies also produce guidance documents in the form of procedural manuals, advisory opinions and notices, handbooks, etc. These types of guidance documents are most likely found on agency websites. For example, the USPTO website provides a link to guidance documents under the “Learning and Resources” tab.

As discussed above, the commercial platforms provide variable access to agency guidance documents for several agencies.

Court Decisions Reviewing Agency Actions

To find court decisions reviewing agency decisions or other actions, you will use the case finding strategies and tools discussed in Chapter 11 .

Practice Example:

In this example, you will search the Alcohol and Tobacco Tax and Trade Bureau website for administrative information on beer brewing.

The following video will demonstrate searching the Alcohol and Tobacco Tax and Trade Bureau website for relevant primary and secondary sources.

State (Oregon example)

Researching state administrative law is similar to researching federal administrative law. You may want to look for the state’s Administrative Procedure Act, as well as the enabling legislation for the agency involved in your legal problem if the agency’s authority is in question. The main sources of state administrative law are rules, agency decisions, and agency guidance. Each state maintains a government website providing access to administrative rules and other information. For example, California’s Office of Administrative Law website provides access to the California administrative rules, information on the rulemaking process, publications and forms, as well as an agency index. In Washington, the state legislature’s website links to the Washington Administrative Code and the State Register . In Oregon, the Secretary of State website links to the Oregon Administrative Rules and some historical administrative orders and rule compilations. In addition, state agencies host websites with useful information such as relevant rules, decisions, practical guidance, current awareness tools, and other resources. The following sections will highlight sources of administrative law from Oregon as an example.

Oregon Administrative Procedure Act

Oregon’s Administrative Procedure Act, ORS 183.310, defines powers, responsibilities, and procedures for state administrative agencies.

When you are doing statutory research (see Chapter 10 ), you should look at surrounding sections to find laws giving powers and responsibilities to a particular agency. You should also use statutory annotations to find cases interpreting and applying those statutory sections. For example, if you were looking at the Oregon Revised Statutes for laws on alcohol, you would look in Chapter 471. In Chapter 471, you will find 471.705 et seq. which establishes the Oregon Liquor and Cannabis Commission and defines its regulatory powers and procedures.

Free Government Websites

The best method for accessing Oregon Administrative Rules is to use the Oregon Administrative Rules Database (OARD) on the Secretary of State’s website. The OARD is continuously updated as rules are approved and received. The database allows you to browse through current rules using chapter numbers, chapter names, rule numbers, or rule text. You can also use the OARD to access the Oregon Bulletin , a monthly online publication containing Notices of Proposed Rulemaking, Permanent and Temporary Administrative Rule filings, rule text, and Minor Correction filings, as well as Annual Compilations of rules .

For example, you may be looking for rules from the Oregon Liquor and Cannabis Commission (OLCC). First, go to the Secretary of State website and link to the OARD. If you do not have a rule number citation, you can browse by Chapter name to find the Oregon Liquor and Cannabis Commission, Chapter 845. If you are looking for a rule addressing a specific issue, you might choose to search by text of the rule. If you are wondering whether a brewer can brew beer using cannabis, for example, you might conduct a search using the terms cannabis and beer.

Depending on when the rule was last updated, you would look at the Oregon Bulletin to see if there are any proposed new rules or corrections. For example, if the rule you found was last updated in February 2023, you would look at the Bulletins for March, April, and May 2023 for any changes or corrections to make sure you are looking at the most recent rule language.

Commercial Databases

Westlaw, Lexis, and Bloomberg provide access to state administrative information.

Westlaw has databases containing Oregon Regulations as well as Administrative Decisions and Guidance. The decisions and guidance database covers a limited number of agencies: Attorney General Opinions, Bureau of Labor & Industries Decisions, Division of Financial Regulation Decisions, Employment Relations Board Decisions, Environmental Administrative Decisions, Insurance Bulletins, Land Use Board of Appeals Decisions, Legal Ethics Opinions, Public Utility Commission Decisions, and Workers Compensation Administrative Decisions.

On Lexis, you can access Oregon Administrative Codes and Regulations, the Oregon Bulletin, as well as select Oregon administrative materials such as decisions and guidance: Oregon Insurance Bulletin & Notices, Attorney General Opinions, Department of Commerce, Corporate Division Materials, Department of Environmental Quality, Government Ethics Commission Final Dispositions, Public Utility Commission Decisions, Workers’ Compensation Decisions, Bureau of Labor and Industries, Employment Relations Board Decisions, Market Conduct Examinations, and Land Use Board of Appeals.

Bloomberg has databases of state codified regulations as well as proposed rules.

Agency Decisions and Guidance

As explained above, Westlaw and Lexis allow you to access select agency decisions and guidance. However, you can find an abundance of helpful information including decisions and guidance, reports, forms, publications, news, licensing and permitting information, etc. on agency websites. For example, the OLCC website provides extensive information on Alcohol Licensing and Permits with links to applications, forms, educational resources, rules, and compliance materials.

In this example, you will practice searching the Oregon Liquor and Cannabis Commission (OLCC) website for primary law and other information on beer brewing.

suggested activity

Students can select an area of interest and find federal and/or state administrative agencies that regulate that area of interest. Student should explore the website to find secondary and primary sources. Suggested topics of interest: offshore wind energy, state literacy initiatives, indigenous tribal claims to Colorado River water, electric vehicle tax incentives. This activity can be done as a short in-class exercise so students learn ways to navigate agency websites.

Federal administrative law comes from the President, agencies of the Executive Branch, and independent regulatory agencies. The President issues executive orders, proclamations, and reorganization plans. Executive and independent agencies issue rules and regulations that have the force of statutory law. In addition, the agencies make administrative decisions that range in procedural format from informal and private to complex on a full judicial scale. Consequently, administrative law covers a wide variety of materials ranging from in-house memoranda to lengthy opinions written by administrative law judges. This guide describes the most important administrative materials and indicates where they are available in the library, through subscription databases, and on the web.

Locating materials

Some databases, like  GovInfo.gov ,  e-CFR ,  Wisconsin Legislative Documents , and  Cornell's Legal Information Institute (LII) , are free and available to any user. Other databases are restricted by personal password or MU login credentials.  Databases for researching primary law are included throughout the narrative of the guide.  Look at the Databases & Websites tab, too. 

Navigating administrative law sources can be complex for a newer researcher. Consider using secondary sources for background and context. Check the Books in the Collection tab for examples of these resources.

Federal Administrative Law

Administrative law, also called regulatory law, is legal authority created by the executive branch of government.  In the federal system, the agencies of the executive branch have authority granted by Congress to promulgate regulations ("rulemaking"); conduct hearings and issue decisions in administrative agency adjudications; investigate and enforce regulations; and issue guidance for regulatory compliance. The President has administrative authority to issue proclamations and executive orders that have the force of law. 

Executive branch authority derives from the federal Constitution and federal statutes, and agency power is limited to what is given by Congress. An agency's ability to regulate activities comes from statutes that establish the agency's authority generally, and also from specific legislation that empowers the agency to enforce a statute via regulation. When courts review an agency's rules or other actions, deference is given to the agency unless it acted beyond the authority properly delegated by Congress. 

Administrative Law in the States

Administrative law exists in all 50 separate state systems and operates similarly to the federal paradigm. States differ in their use of terminology, agencies and agency structures, and rulemaking requirements. Once you know the state jurisdiction that controls, learn the state law that applies to regulations. For example, most states have administrative procedure statutes that must be considered when researching a regulatory issue.  In Wisconsin, the statute is Wis. Stat. Ch. 227, Administrative Procedure and Review.

Wisconsin regulations are called rules. States usually choose one word, but "regulation" and "rule" sometimes are used interchangeably. State legislatures give state agencies the power to create administrative law just like Congress empowers federal agencies. Agency authority may originate directly from a state's constitution.  For example, the Wisconsin Constitution specifically grants citizens the right to vote in state elections. Wisconsin statutes also provide authority for the state to regulate elections.

Local Administrative Law

County, city, town, and village ordinances are authorized by state statutes and constitutions and can be considered a form of administrative law.  Like the 50 states, counties and municipalities operate with agency-like departments and commissions.  Some local government agencies have policy rules and the authority to adjudicate – for example, Milwaukee has a municipal civil service commission for employment disputes. Check municipal websites for departments and commissions, which often have links to enabling statutes and ordinances.

Research state statutes and local ordinances to find law that governs an issue. "Home rule" powers differ across states, and also within states, depending on the political subdivision (city, county, town, village) and the specific statutory enabling authority conferred.  Commercial legal databases have some county and city primary materials.  Research state enabling laws in an annotated statutory code (Westlaw, Lexis) to find decisions about localities' home rule powers that have been tested in the courts.   

Free websites offer ordinances for selected localities (see box at right).  Often, a county, city, or town will post its current ordinances on the local government website.

  • American Legal Publishing Code Library An extensive, but not comprehensive, database for municipal codes in the United States. Very few Wisconsin cities are included, but many Illinois cities and towns are available here, including the Chicago Municipal Code.

Growing up, Kaitlyn Jauregui and her friends loved kayaking on the Oleta River in North Miami Beach near her home. They were appalled by the trash washed up on the shores and bobbing on the river that connects the Everglades with Biscayne Bay. They started bringing bags on their trips to collect water bottles, plastic caps and bags, and other detritus and properly dispose of them. 

Fast forward a decade, and Jauregui is in Dubai, United Arab Emirates, this past December attending the United Nations climate summit—the 28th annual Conference of the Parties, known as COP28, with professor  Jessica Owley , director of the  Environmental Law Program , and her peers from the University of Miami School of Law . 

There, the 24-year-old presented her  research  on single-use plastics in the food and beverage industry and worked with the Ecuadorian delegation, focusing on a long-range goal of forming a treaty to end the practice. Jauregui recently prepared a brief for the Ecuadorian government. 

From rivers to beaches to an educational concentration  

By the time Jauregui attended the Alonzo and Tracy Mourning Senior High Biscayne Bay Campus in North Miami, her interests had grown, and she enrolled in AP environmental science. 

"The course made me very interested in environmental studies, and I considered pursuing environmental law for a while,” she said. 

Jauregui was also a part of her high school's law academy, which replaced all participating students' electives with legal-based studies. "I loved the in-class debates and legal theory projects, so from then I knew I would study law," she said. Jauregui gained practical experience through the program by volunteering at the North Dade Justice Center for Justice Jason Dimitris. 

However, she had been surrounded by a business mindset her entire life, being around her family's successful luxury bus company, and had always known business would figure somehow into her future career. 

After that, she found a great way to combine her business, law, and environmental studies interests. At Emory University in Atlanta, Georgia, Jauregui earned a B.B.A. in marketing and sustainability from the Goizueta Business School, leading her to her first U.N. COP attendance in 2019. She studied "how we in business and law can incorporate greener practices," an interest that continued into law school.

Distilling her many interests, at the School of Law she is an editor of the Business Law Review and has garnered Legal Academy Fellow Honors: CALI Award in Corporate Compliance and Risk Management, Dean's Award in Administrative Law, Congressional Hispanic Leadership Institute Fellowship, and Cuban American Bar Association Scholarship. 

Following her graduation in May and admission to The Florida Bar, Jauregui will be junior legal counsel in the general counsel's office of Celsius Holdings Inc., the global energy drink company, where she will enhance company policies regarding international trade, sustainability goals, and intellectual property. 

Jauregui hopes to inspire lawyers and businesspersons to be mindful of their influence on stakeholder decision-making about consumption and waste. "I would like to promote the idea of a circular economy in my role at Celsius," she said.

'This Is Insanity, Someone's Got To Act,' Marijuana Researcher Files Fed Lawsuit Against DEA Over 'Unconstitutional Process'

A Rhode Island-based cannabis company, MMJ BioPharma Cultivation Inc.,  filed a complain t against the Drug Enforcement Administration alleging "an unconstitutional administrative proceeding before a DEA Administrative Law Judge (ALJ). " 

Upon discovering that DEA director Anne Milgram "illegally appointed the administrative law Judge Teresa Wallbaum" to hear the case, Megan Sheehan and Associates, lawyers representing MMJ, filed for relief seeking an order to halt these what they called "unconstitutional actions."

Last August, MMJ filed a petition for a writ of mandamus in the U.S. Court of Appeals for the District of Columbia Circuit over a bulk manufacturing application submitted almost six years ago and never processed. MMJ's president and founder Duane Boise previously told Benzinga that the inaction goes directly against the Control Substance Act, negatively impacts MMJ and ignores its effort to help those suffering individuals from Huntington's Disease and Multiple Sclerosis through clinical research.

The DEA’s stance on cannabis and possible rescheduling on the federal level will be one of many important topics discussed by industry experts at the upcoming   Benzinga Cannabis Capital Conference next week.

‘This Is Insanity' 

In the complaint filed on Thursday in the U.S. District Court for the District of Rhode Island, MMJ argues it would be subject to "irreparable harm" under "such an unconstitutional proceeding," claiming DEA ALJ was appointed in "violation of the Appointments Clause of Article II, Section 2, of the Constitution and is not accountable to President, in violation of the Take Care Clause of Article II, Section 3 of the Constitution." 

Boise stated, “Everyone agrees that there is a need for drugs to treat these neurological diseases- Congress, the FDA, the DEA, the doctors, parents’ association – everyone’s saying the same thing. And here we have an administrative agency that just completely arbitrarily attacks a company that’s following the law to manufacture a marijuana soft gelatin capsule to help suffering patients.”

“This is insanity,” he added. “Someone’s got to act.”

The complaint further reads that the U.S. Supreme Court found that an ALJ appointment process nearly identical to that used by the DEA is unconstitutional. 

"On information and belief, the DEA ALJ presiding over MMJ's administrative hearing was selected from a group of candidates provided by the White House Office of Personnel Management ("OPM") and appointed by the DEA Administrator upon recommendation from DEA's Chief ALJ," reads the document. 

‘Heartless Individuals' Hurting Patients 

Commenting on the development, Boise  stated , “We are dealing with heartless individuals at the DEA who continue to hinder marijuana research and development. MMJ has meticulously followed the law, yet the DEA fails to do the same. Ultimately, it is the patients in need who suffer due to government inaction.”

Tim Moynahan  an attorney and the company’s chair added “I’m hoping that by both challenging the constitutionality of the DEA system while at the same time giving the DEA a roadmap to correct all of their errors. Someone within the DEA should settle this case particularly since MMJ is vital to completing drugs that we need to help patients suffering from Multiple Sclerosis and Huntington’s Disease.”

9 facts about americans and marijuana.

The use and possession of marijuana is illegal under U.S. federal law, but about three-quarters of states have legalized the drug for medical or recreational purposes. The changing legal landscape has coincided with a decades-long rise in public support for legalization, which a majority of Americans now favor.

Here are nine facts about Americans’ views of and experiences with marijuana, based on Pew Research Center surveys and other sources.

As more states legalize marijuana, Pew Research Center looked at Americans’ opinions on legalization and how these views have changed over time.

Data comes from surveys by the Center,  Gallup , and the  2022 National Survey on Drug Use and Health  from the U.S. Substance Abuse and Mental Health Services Administration. Information about the jurisdictions where marijuana is legal at the state level comes from the  National Organization for the Reform of Marijuana Laws .

Around nine-in-ten Americans say marijuana should be legal for medical or recreational use,  according to a January 2024 Pew Research Center survey . An overwhelming majority of U.S. adults (88%) say either that marijuana should be legal for medical use only (32%) or that it should be legal for medical  and  recreational use (57%). Just 11% say the drug should not be legal in any form. These views have held relatively steady over the past five years.

Views on marijuana legalization differ widely by age, political party, and race and ethnicity, the January survey shows.

While small shares across demographic groups say marijuana should not be legal at all, those least likely to favor it for both medical and recreational use include:

  • Older adults: 31% of adults ages 75 and older support marijuana legalization for medical and recreational purposes, compared with half of those ages 65 to 74, the next youngest age category. By contrast, 71% of adults under 30 support legalization for both uses.
  • Republicans and GOP-leaning independents: 42% of Republicans favor legalizing marijuana for both uses, compared with 72% of Democrats and Democratic leaners. Ideological differences exist as well: Within both parties, those who are more conservative are less likely to support legalization.
  • Hispanic and Asian Americans: 45% in each group support legalizing the drug for medical and recreational use. Larger shares of Black (65%) and White (59%) adults hold this view.

Support for marijuana legalization has increased dramatically over the last two decades. In addition to asking specifically about medical and recreational use of the drug, both the Center and Gallup have asked Americans about legalizing marijuana use in a general way. Gallup asked this question most recently, in 2023. That year, 70% of adults expressed support for legalization, more than double the share who said they favored it in 2000.

Half of U.S. adults (50.3%) say they have ever used marijuana, according to the 2022 National Survey on Drug Use and Health . That is a smaller share than the 84.1% who say they have ever consumed alcohol and the 64.8% who have ever used tobacco products or vaped nicotine.

While many Americans say they have used marijuana in their lifetime, far fewer are current users, according to the same survey. In 2022, 23.0% of adults said they had used the drug in the past year, while 15.9% said they had used it in the past month.

While many Americans say legalizing recreational marijuana has economic and criminal justice benefits, views on these and other impacts vary, the Center’s January survey shows.

  • Economic benefits: About half of adults (52%) say that legalizing recreational marijuana is good for local economies, while 17% say it is bad. Another 29% say it has no impact.

  • Criminal justice system fairness: 42% of Americans say legalizing marijuana for recreational use makes the criminal justice system fairer, compared with 18% who say it makes the system less fair. About four-in-ten (38%) say it has no impact.
  • Use of other drugs: 27% say this policy decreases the use of other drugs like heroin, fentanyl and cocaine, and 29% say it increases it. But the largest share (42%) say it has no effect on other drug use.
  • Community safety: 21% say recreational legalization makes communities safer and 34% say it makes them less safe. Another 44% say it doesn’t impact safety.

Democrats and adults under 50 are more likely than Republicans and those in older age groups to say legalizing marijuana has positive impacts in each of these areas.

Most Americans support easing penalties for people with marijuana convictions, an October 2021 Center survey found . Two-thirds of adults say they favor releasing people from prison who are being held for marijuana-related offenses only, including 41% who strongly favor this. And 61% support removing or expunging marijuana-related offenses from people’s criminal records.

Younger adults, Democrats and Black Americans are especially likely to support these changes. For instance, 74% of Black adults  favor releasing people from prison  who are being held only for marijuana-related offenses, and just as many favor removing or expunging marijuana-related offenses from criminal records.

Twenty-four states and the District of Columbia have legalized small amounts of marijuana for both medical and recreational use as of March 2024,  according to the  National Organization for the Reform of Marijuana Laws  (NORML), an advocacy group that tracks state-level legislation on the issue. Another 14 states have legalized the drug for medical use only.

Of the remaining 12 states, all allow limited access to products such as CBD oil that contain little to no THC – the main psychoactive substance in cannabis. And 26 states overall have at least partially  decriminalized recreational marijuana use , as has the District of Columbia.

In addition to 24 states and D.C.,  the U.S. Virgin Islands ,  Guam  and  the Northern Mariana Islands  have legalized marijuana for medical and recreational use.

More than half of Americans (54%) live in a state where both recreational and medical marijuana are legal, and 74% live in a state where it’s legal either for both purposes or medical use only, according to a February Center analysis of data from the Census Bureau and other outside sources. This analysis looked at state-level legislation in all 50 states and the District of Columbia.

In 2012, Colorado and Washington became the first states to pass legislation legalizing recreational marijuana.

About eight-in-ten Americans (79%) live in a county with at least one cannabis dispensary, according to the February analysis. There are nearly 15,000 marijuana dispensaries nationwide, and 76% are in states (including D.C.) where recreational use is legal. Another 23% are in medical marijuana-only states, and 1% are in states that have made legal allowances for low-percentage THC or CBD-only products.

The states with the largest number of dispensaries include California, Oklahoma, Florida, Colorado and Michigan.
