You have one opportunity to respond to the RFE with the correct information and get your application back on track. USCIS tends to use many scripted responses in their RFE letters. Immigration officials who adjudicate your case are human; they may have overlooked something. But it is likely you need to submit additional evidence to corroborate facts in your request. Regardless, identify each of the items of evidence that you need to submit to USCIS.

Identify the Deadline

The USCIS Request for Evidence will also provide a deadline. This tells you how long you have to respond. If you can, responding sooner is better. You will need to respond to the RFE before the deadline indicated so that the adjudicator will have enough evidence to make a favorable decision. If you fail to respond by the RFE deadline, USCIS will make a decision based on the existing evidence. Generally, that leads to a denial.

How to Respond to a USCIS Request for Evidence

Provide one complete response

It should go without saying, but you must respond on time. Missing the deadline will most likely result in a denial. Don’t be late. Remember to make a copy of the RFE and all evidence for your own records. You'll need to return the original Request for Evidence with your response.

Mail the response package to the address specified on the RFE. Mail the package via U.S. Postal Service Priority Mail or a courier (e.g. FedEx, UPS or DHL) that can track your package. You want to have delivery confirmation so you have proof that you responded in the allowed time frame.

23.1 Cover Letters for Affirmative Applications

23.1.1 cover letter for “barebones submission”.

If you are submitting an affirmative application, as discussed in Chapter 14, it is advisable to submit the I-589 almost completely by itself, with other documentation to follow later, so as to get your client, as soon as possible, a spot in the long line for an asylum interview. The cover letter for this “barebones” application may look as follows:

23.2 Cover Letters for Defensive Applications

23.2.1 cover letter for i-589 filing.

Usually, Form I-589 is submitted in open court at a Master Calendar Hearing (MCH). If, however, your first MCH is scheduled more than a year after your client’s most recent entry to the U.S., you will likely wish to file the I-589 within that first year (or as soon as possible thereafter), by mail or in person. This procedure is described in a 2016 memorandum from the Chief Immigration Judge, available at  http://www.justice.gov/sites/default/files/pages/attachments/2016/09/14/oppm_16-01.pdf . If you hand-deliver it, bring an extra copy with you to be date-stamped for your records. If you mail it, include an extra copy and a self-addressed, stamped envelope for return service of a date-stamped version, and a short cover letter (which does not and should not replace the immigration court’s own formatting and filing requirements, described in detail in the Immigration Court Practice Manual at  http://www.justice.gov/eoir/office-chief-immigration-judge-0 . You may download and print forms for free from the  All Forms  page. 

Please be sure to carefully read and follow the form filing instructions. Form fees, eligibility requirements, fee waiver eligibility, required documents, and mailing addresses vary depending on which form you are filing and why you are filing it. These tips will help ensure we accept your application, petition, or request package for processing.

  • You can  download forms from our website , complete them electronically, and then print your forms to submit by mail. If you need help downloading and printing forms, read our  instructions . Do not mail a form if you have already filed it online. If you print out an online form and mailed to the lockbox, we will reject it. 
  • Only use the current form edition when downloading and completing a form.  
  • Ensure that the form edition date and page numbers are visible at the bottom of the printed pages and that you complete all pages with the same edition of the form. If any of the form’s pages are missing or are completed with a different edition of the form, we may reject your application.  
  • If you hand write your answers, use black ink. Make sure that everything you write on the form is clear, so we can easily read the information on the scanned image we produce when we process your form.  
  • Do not use highlighters, correction fluid, or correction tape. We use both black-and-white and grayscale scanners that will not properly read information that is greyed out, highlighted, or corrected using correction fluid or tape. If you make an error, start over with a clean form.  
  • Complete the entire form, unless the form directs you to skip 1 or more items. If you do not complete all parts of the form, we may reject your submission for missing information.  
  • Remember to sign your form in the space provided for your signature. We will reject and return any unsigned form. For more information on signatures, see the USCIS Policy Manual .
  • Pay the correct  fee . We will reject forms submitted with incorrect or incomplete fees. Use the  Fee Calculator  to help you determine the correct fee.
  • If you are filing multiple applications, petitions, or requests, we recommend sending separate payments for each application. If you submit 1 payment for multiple forms and we reject 1 of those forms, we will reject all the other forms included in that payments. 
  • Check or money order  or Form G-1450, Authorization for Credit Card Transactions . If you are paying by check or money order, write the form you are filing and your A-Number or other applicable identification on the check or money order. If you are paying with a credit card, see our Pay with a Credit Card webpage.
  • Form G-1145, Request for e-Notification (if applicable).
  • Form G-28, Notice of Entry of Appearance as Attorney or Accredited Representative (if applicable).
  • Form being filed.
  • Form supplements being filed, if applicable.
  • Submit the documents or evidence listed in the form instructions.
  • Supporting documents must be in English or accompanied by a complete English translation that the translator has certified as complete and accurate. The English translation must be accompanied by the translator's certification that they are competent to translate the foreign language into English.
  • Are not blurry or faded;
  • Do not have streaks or toner lines;
  • Are not upside down, lopsided, skewed, or distorted;
  • Do not have text or images that are obscured, partially cut off, or missing due to folded pages or improper copying; and
  • Do not have pages that are completely illegible.
  • Do not  send original documents unless they are specifically requested in the form instructions or applicable regulations. If you send original documents with your form when they are not required or requested, we may destroy them in accordance with the Federal Records Act and applicable U.S. National Archives and Records Administration-approved general retention schedules or agency-specific retention schedules. We will not automatically return your original documents if we did not specifically request them. 
  • In most cases, a copy of a USCIS notice, if available, is acceptable evidence of a prior, related filing. If you prefer to provide a copy of a complete prior application, petition, or request in support of a new filing, please be sure that the prior application, petition, or request is clearly marked as a “COPY” at the top of each page to ensure we process it as intended.
  • All forms and supporting documents submitted must be single-sided, standard 8½ x 11 letter-size pages.
  • Please do not submit evidence using digital media, photo albums, scrapbooks, or binders. We cannot process them and will return them to you.
  • When providing photos or other attachments, please provide your name at the top of the page or on the back of any photos. If you send original photos with your form, they may become part of the record or be destroyed.
  • You may number support pages and include the total number of pages being attached (for example, “page 1 of 11”).
  • If you forget to send in supporting documentation with your benefit request package, please do not submit it in a separate package to a USCIS lockbox. If you have an online account and are able to add your paper-filed case to the account, you can upload the supporting documentation in your online account. If you do not have an online account or cannot add your paper-filed case to your account, please keep the supporting documentation so you can submit it later to the appropriate location, upon request.
  • Mark the envelope and the cover letter with the type of submission. For example,  Original Submission, Application to Register Permanent Residence or Adjust Status (Form I-485) .
  • Mark the envelope and the cover letter with the form number. For example, Form I-129, Form I-360, Form I-485.
  • Do not use binders or folders that we cannot easily disassemble.
  • Do not use heavy-duty staples.
  • Do not mail responses to Requests for Evidence (RFEs) or similar notices to a USCIS lockbox location. Instead, follow the instructions in the RFE regarding where to send your response.
  • Do not mail evidence in support of a previously filed appeal or motion to a USCIS lockbox location. If you are submitting a brief or evidence in support of an appeal, please refer to the AAO Practice Manual or the Board of Immigration Appeals Practice Manual for instructions. For motions, you must submit any brief or additional evidence together with Form I-290B at the time of filing. If we issue an RFE related to your motion, we will provide specific instructions to submit the evidence using an online account or by mail.
  • If you are requesting premium processing service, submit only one Form I-907 for the associated, eligible form (such as Form I-140 or I-129).

We recommend only including multiple forms in the same envelope when the forms are related and eligible to be filed together (such as including a Form I-765 and Form I-131 with the Form I-485 that your eligibility is based on, or including multiple Forms I-485 or Forms N-400 for family members who are applying for adjustment or naturalization at the same time).

Do not include unrelated forms in the same envelope when filing. Forms are unrelated if the decision on one form does not affect the decision on another. For example, if you plan to file Form I-765 and Form I-485, and whether or not we approve your Form I-485 does not affect your Form I-765, then we recommend you file each form in a separate envelope. Doing so may avoid routing issues that could make it take longer to process your form.

If you are filing multiple forms in the same envelope, write your name, date of birth, and A-Number (if any) exactly the same way on each form (unless you have had a legal change of name or date of birth and provide proof of that).

If you are filing forms from multiple individuals in the same envelope, clearly separate the cases and follow the guidelines described above in Assemble Your Application, Petition, or Request.

If you are responding to multiple RFEs in the same envelope, clearly separate the responses by form and follow the guidelines described above in Assemble Your Application, Petition, or Request.

Do not mail responses to RFEs in the same envelope with unrelated applications, petitions, or requests.  

  • When addressing the package, be sure to enter the complete address provided on the USCIS website, including the Attn: line, which helps to ensure that we process and route the application, petition, or request. 
  • Mail your forms to the address listed on that form’s webpage. You may send your forms through USPS, FedEx, DHL, or UPS.
  • We encourage you to save a copy of your payment, along with any tracking number provided by the courier, for your records and so you can verify the status of its delivery.
  • If you mail your application, petition, or request to the wrong filing location, we may reject it as improperly filed and return it to you to re-file.

Every employment-based petition must be accompanied by a cover letter that describes the terms and conditions of employment, the nature of the job to be done by the employee, and the employee’s education and experience that make her/him qualified for the job.

The purpose of the cover letter is to demonstrate to USCIS that

  • the position requires theoretical and practical application of a body of highly specialized knowledge
  • the beneficiary has a bachelor’s or higher degree in the specific specialty or its equivalent as a minimum for the job.

The following information should be used as a guide to writing this letter:

  • Language within brackets [  ] is for guidance, not to be used verbatim.
  • Paragraphs two and six are intended for use verbatim.
  • Don't number the paragraphs in the final letter.
  • Please print the letter on the Department, Lab or PI’s letterhead, and include it with the documentation.
  • The letter should be no longer than 2 pages.
  • The highest degree earned by the beneficiary, as well as the field in which it was earned, must always be noted in the letter.

Sample Cover Letter for Removal of Conditions (Joint I-751 Petition)

Conditional Permanent Residents who obtained status through marriage must apply to remove the conditions on their permanent resident status before the 2 years anniversary of the issuance of their legal Permanent Resident Card (“green card”).  Specifically, the Conditional Permanent Resident must file a Form I-751, Petition to Remove Conditions on Residence within 90 days of the expiration of their two-year Permanent Resident Card. A late filing can have dire consequences: USCIS can terminate the Conditional Resident’s legal permanent residence and put them in proceedings before an Immigration Judge that conducts removal proceedings in the Department of Justice’s administrative immigration courts. 

For I-751 petitions filed jointly, meaning the Conditional Permanent Resident and Spouse are still married and are filing the form together, frequently couples choose to file without an attorney.  This is because a jointly filed petition is not complicated compared to other immigration filings. 

However, in the past few years there has been an increase in Requests for Evidence (RFE) for further evidence regarding the legitimacy of the relationship.  For this reason, we are providing this sample cover letter as a guide for I-751 filers.  The letter contains a list of sample evidence that can be included with the petition to reduce the risk of receiving an RFE. 

For Conditional Permanent Residents that are facing additional complications as they approach the two year anniversary of the issuance of their permanent resident card (such as the Conditional Permanent Resident and Spouse no longer living together, no longer being together as a married couple, or abuse within the relationship) we strongly recommend speaking to an immigration attorney to discuss specific options for each circumstance.

If you’ve already been granted Deferred Action for Childhood Arrivals (DACA) status by U.S. Citizenship and Immigration Services (USCIS), you are eligible to renew your status every two years. You’ll need to fill out Form I-821D and submit it along with other required forms and fees to renew. What Is a DACA Renewal Cover Letter?

DACA status allows eligible undocumented immigrants to receive work permits, or employment authorization documents (EADs), and 2-year renewable protection from deportation. To maintain your DACA status , you must submit a renewal application and continue to meet the following eligibility criteria:

You have previously been a DACA recipient.

It has not been more than a year since your previous DACA status expired. If your status has expired, you’ll need to submit a new DACA application instead of a renewal.

Your current DACA expiration date is not more than a year from now.

Since your first-time DACA application, you have not left the United States without receiving advance parole first.

Since your most recently approved DACA application, you have continuously resided in the United States.

You do not have a disqualifying criminal record .

You may wish to include a cover letter with your DACA renewal request. Cover letters serve as an organizational tool. These letters tell USCIS officers more about you, the status you’re applying for, and the contents of your application. A cover letter makes it easier for a USCIS officer to review your application without overlooking anything important. You can also use a cover letter as a checklist to help ensure you’ve included all the necessary application materials.

Is a Cover Letter Required for My DACA Renewal Application?

USCIS recommends, but does not require, a cover letter for your DACA renewal application. However, there are several benefits to submitting a cover letter. What Should My DACA Renewal Cover Letter Include?

If you submit a cover letter with your application, be sure to include the following:

The USCIS lockbox address to which you’re sending your application

An appropriate subject (re:) line

An ordered list of the content in your application package

A closing paragraph, your signature, and your printed name

You’ll need to submit several supporting documents with your application, including:

An acceptable photo identification (ID). This may include the following:

U.S. military ID

U.S. government immigration documents with your name and photo on it

Your learner’s permit or non-driver ID

Two passport photos

Form I-765 , the Application for Employment Authorization

A copy of the front and back of your current work permit

You’ll be including the cover letter with your Form I-821D, the Consideration of Deferred Action for Childhood Arrivals. You can find the correct mailing address for Form I-821D, your supporting documents, and your cover letter from USCIS.

You’ll need to pay a $495 filing fee to renew your status. You can pay the fee with a money order or a credit card. You should make any money orders payable to the DHS by writing out “U.S. Department of Homeland Security.” To pay by credit card, you must file Form G-1450 with your application.

In some cases, you may want to use a cover letter to explain any special circumstances you want the USCIS officer to be aware of before they start reviewing your application. What Should My USCIS Cover Letter Include?

You should select Form N-400 on the Fee Calculator and enter your age. USCIS may ask for additional information, such as your specific application category.

While your resume lists your qualifications and experiences, a cover letter gives you the chance to showcase your personality, enthusiasm, and communication skills.

Not all job applications ask for a cover letter, so you don’t have to write one for every job you apply for. However, a cover letter can still help as it can offer additional insights into your qualifications and enthusiasm for the position, potentially influencing the employer's decision to consider you for an interview. But be sure to read the job description carefully, as some employers may explicitly state they do not require or accept cover letters.

When the job listing does specifically ask for a cover letter, it's important to include one.

A well-structured cover letter should include the following:

1. Contact information: At the top of your cover letter, include your name, phone number, and email address. Make sure your email address and voicemail are professional and appropriate. You might consider creating a new email address specifically for job applications. Also include the date you wrote the cover letter and the employer’s contact information.

2. Greeting: Address the hiring manager by name if known. There is usually a contact name on the job description, but if you can’t find someone to address, you can simply write “Dear Hiring Manager”.

Understanding the company’s values, culture and needs will help you tailor your cover letter to show that you’ve done your research and that you’re a good fit. Some companies might even have instructions on their careers page outlining what they’d like applicants to include in a cover letter, so be sure to check their website just in case.

Step 2: Create a template Start with a basic template that includes your contact information, a greeting and a structure for the body and conclusion. This will make it easier to customise your letter for each application. You could utilise AI generators such as ChatGPT for this, but make sure you always make edits to personalise it and make it sound like you before sending it to anyone.

Step 3: Write a strong opening paragraph Capture the reader’s attention with a compelling introduction. Mention the position you’re applying for and how you found out about it. It can also be good to explain why you’re excited about the position and why you believe it's a great fit for you, even if the role is slightly outside your demonstrated skills, experience or current location. This shows your genuine interest and enthusiasm.

Here is an example: "I am excited to apply for the Retail Assistant position at XYZ Store, as advertised on your website. With a strong background in customer service and a passion for the retail industry, I am confident in my ability to contribute to your team.”

Step 4: Highlight your relevant skills and experiences In the body of your cover letter, focus on your most relevant skills and experiences. Use specific examples to demonstrate how you’ve successfully used these skills in the past. This is where you demonstrate why you're the ideal candidate for the position and address the selection criteria from the job ad. You could also try using the STAR method to explain these skills and accomplishments.

You could start this section off by saying something like: 'In my previous role as a sales associate at ABC Store, I developed a variety of skills that I believe will make me a valuable addition to your team,' then follow on with your most relevant skills that relate to the selection criteria.

Step 5: Show enthusiasm for the role and company Employers want to hire people who are excited about the job and the company. Explain why you’re passionate about this specific opportunity and how you can contribute to the company’s success. Showing the hiring manager that you understand the company's values, culture and goals, and how they align with your own, can set you apart from other candidates who may not have taken the time to learn about the organisation.

Here is an example of what you could say: ‘I am particularly impressed by XYZ Store’s commitment to customer satisfaction and would love the opportunity to bring my skills and enthusiasm to your team. I am confident that my experience and dedication to providing excellent customer service will contribute positively to XYZ Store’s success.’

Step 6: Conclude with a “call to action” Wrap up your letter with a polite and confident closing. Express your eagerness to discuss your application in more detail and thank the employer for considering you.

A two-page cover letter may be acceptable in some circumstances, particularly when a role requires you to demonstrate extensive experience or a variety of skills.
