A collateral assignment is a process by which a person uses their life insurance policy as collateral for a secured loan.

In simple terms, collateral assignment is reassigning priorities for who gets paid the death benefit of your life insurance policy.

What Is a death benefit?

A death benefit or face value of a life insurance contract is the amount of money that your beneficiaries will receive from your policy when you die.

Once you apply for collateral assignment and it’s approved, your specified debtor (the loan provider) will be paid first and then your beneficiaries will receive what is left over in your life insurance policy.

This is different from using your cash value to loan money as you are taking out a loan from another financial institution and using your policy as a guarantee that you’ll cover any debt when you die. 

For example, let’s say you want to take out a secured loan from your local bank and want to use your life insurance policy as a collateral assignment.

In this situation, you’d still have to pay back any debt you have with interest during the loan period.

All you’ll be doing is indicating to your life insurance provider that your lender will be given priority for the amount of money you have borrowed through them.

Securing a loan with life insurance reduces the lender’s risk, which improves your chances of qualifying for the loan.

Collateral assignment is the practice of using a life insurance policy as collateral for a loan . Collateral is any asset that your lender can take if you default on the loan.

For example, you might apply for a $25,000 loan to start a business. But your lender is unwilling to approve the loan without sufficient collateral. If you have a permanent life insurance policy with a cash value of $40,000 and a death benefit of $300,000, you could use that life insurance policy to collateralize the loan. Via collateral assignment of your policy, you authorize the insurance company to give the lender the amount you owe if you’re unable to keep up with payments (or if you die before repaying the loan).

Lenders have two ways to collect under a collateral assignment arrangement:

Types of Life Insurance Collateral

Life insurance falls into two broad categories: permanent insurance and term insurance . You can use both types of insurance for a collateral assignment, but lenders may prefer that you use permanent insurance.

  • Permanent insurance : Permanent insurance, such as universal and whole life insurance, is lifelong insurance coverage that contains a cash value. If you default on the loan, lenders can surrender your policy and use that cash value to pay down the balance. If you die, the lender has a right to the death benefit, up to the amount you still owe.
  • Term insurance : Term insurance provides a death benefit, but coverage is limited to a certain number of years (20 or 30, for example). You may also be able to use an annuity as collateral for a bank loan. The process is similar to using a life insurance policy, but there is one key difference to be aware of. Any amount assigned as collateral in an annuity is treated as a distribution for tax purposes. In other words, the amount assigned will be taxed as income up to the amount of any gain in the contract, and may be subject to an additional 10% tax if you’re under 59 ½.

State laws typically require you to notify the insurer that you intend to pledge your insurance policy as collateral, and you must do so in writing. In practice, most insurers have specific forms that detail the terms of your assignment.

Some lenders might require you to get a new policy to secure a loan, but others allow you to add a collateral assignment to an existing policy. After submitting your form, it can take 24 to 48 hours for the assignment to go into effect.

The person who assigns the policy, i.e. transfers the rights, is called the Assignor and the one to whom the policy has been assigned, i.e. the person to whom the policy rights have been transferred is called the Assignee.

Assignment of a Life Insurance Policy simply means transfer of rights from one person to another. The policyholder can transfer the rights of his insurance policy to another for various reasons and this process is called Assignment.

The person who assigns the policy, i.e. transfers the rights, is called the Assignor and the one to whom the policy has been assigned, i.e. the person to whom the policy rights have been transferred is called the Assignee. Once the rights have been transferred to the Assignee, the rights of the Assignor stands cancelled and the Assignee becomes the owner of the policy.

here are 2 types of Assignment:

  • Absolute Assignment – This means complete Transfer of Rights from the Assignor to the Assignee, without any further conditions applicable.
  • Conditional Assignment – This means that the Transfer of Rights will happen from the Assignor to the Assignee subject to certain conditions. If the conditions are fulfilled then only the Policy will get transferred from the Assignor to the Assignee.

Let’s take an example:

Rahul owns 2 Life Insurance policies of value Rs 2 lakhs and Rs 5 lakhs respectively. He would like to gift one policy of Rs 2 lakhs to his best friend Ajay. In that case, he would like to absolutely assign the policy in his name such that the death or maturity proceeds are directly paid to him. Thus, after the assignment, Ajay becomes the absolute owner of the policy. If he wishes, he may again transfer it to someone else for any other reason. This type of Assignment is called Absolute Assignment.

Now, Rahul needed to take a loan for Rs 5 lakhs. So, he thought of doing so against the other policy that he owned for Rs 5 lakhs. To take a loan from ABC bank, he needed to conditionally assign the policy to that Bank and then the bank would be able to pay out the loan money to him. If Rahul failed to repay the loan, then the bank would surrender the policy and get their money back.

Once Rahul’s loan is completely repaid, then the policy would again come back to him. In case, Rahul died before completely repaying the loan, then also the bank can surrender the policy to get their money back. This type of Assignment is called Conditional Assignment.

Conditional Assignment

It means that the transfer of rights will happen from the Assignor to the Assignee subject to certain terms and conditions. If the conditions are fulfilled, only then the policy will be transferred.

What is Assignment in an Insurance Policy?

Assignment means a complete transfer of the ownership of the policy to some other person. Usually assignment is done for the purpose of raising a loan from a bank or a financial institution .

Assignment in Insurance Policy - Meaning, Explanation, Types

Assignment is governed by Section 38 of the Insurance Act 1938 in India. Assignment can also be done in favour of a close relative when the policyholder wishes to give a gift to that relative. Such an assignment is done for “natural love and affection”. An example, a policyholder may assign his policy to his sister who is handicapped.

Who can make an assignment?

A policyholder who has policy on his own life can assign the policy to another person. However, a person to whom a policy has been assigned can reassign the policy to the policyholder or assign it to any other person. A nominee cannot make an assignment of the policy. Similarly, an assignee cannot make a nomination on the policy which is assigned to him.

What happens to the ownership of the policy upon Assignment?

When a policyholder assign a policy, he loses all control on the policy. It is no longer his property. It is now the assignee’s property whether the policyholder is alive or dead, the assignee alone will get the policy money from the insurance company.

If the assignee dies, then his (assignee’s) legal heirs will be entitled to the policy money.

Can assignment be changed or cancelled?

An assignment cannot be changed or cancelled. The assignee can of course, reassign the policy to the policyholder who assigned it to him. He can also assign the policy to any other person because it is now his property. We can think of a bank reassigning the policy to the policyholder when their loan is repaid.

What happens if the assignment dies?

If the assignee dies, the assignment does not get cancelled. The legal heirs of the assignee become entitled to the policy money. Assignment is a legal transfer of all the interests the policyholder has in the policy to the assignee.

What is the procedure to make an assignment?

Assignment can be made only after issue of the policy bond. The policyholder can either write out the wording on the policy bond (endorsement) or write it on a separate paper and get it stamped. (Stamp value is the same, as the stamp required for the policy — Twenty paise per one thousand sum assured). When assignment is made by an endorsement on the policy bond, there is no need for stamp because the policy is already stamped.

Is it necessary to Inform the insurer about assignment?

Yes, it is necessary to give information about assignment to the insurance company. The insurer will register the assignment in its records and from then on recognize the assignee as the owner of the policy. If someone has made more than one assignment, then the date of the notice will decide which assignment has priority. In the case of reassignment also, notice is necessary.

Can a policy be assigned to a minor person?

Assignment can be made in favour of a minor person. But it would be advisable to appoint a guardian to receive the policy money if it becomes due during the minority of the assignee.

Who pays premium when a policy is assigned?

When a policy is assigned normally, the assignee should pay the premium, because the policy is now his property. In practice, however, premium is paid by the assignor (policyholder) himself. When a bank gives a loan and takes the assignment of a policy a security, it will ask the assignor himself to pay the premium and keep it in force. In the case of an assignment as a gift, the assignor would like to pay the premium because he has gifted the policy.

Types of assignment

Assignment may take two forms:

  • Conditional Assignment.
  • Absolute Assignment.

1. Conditional Assignment

It would be useful where the policyholder desires the benefit of the policy to go to a near relative in the event of his earlier death. It is usually effected for consideration of natural love and affection. It generally provides for the right to revert the policyholder in the event of the assignee predeceasing the policyholder or the policyholder surviving to the date of maturity.

2. Absolute Assignment

This assignment is generally made for valuable consideration. It has the effect of passing the title in the policy absolutely to the assignee and the policyholder in no way retains any interest in the policy. The absolute assignee can deal with the policy in any manner he likes and may assign or transfer his interest to another person.

Nomination and Assignment under Insurance Contracts

The term assignment itself means you assign something to someone else. In term life insurance, the assignment of the policy describes the action of assigning legal rights as well as policy ownership to someone else. The person who assigns the policy is known as an Assignor and the person who has been assigned the policy is known as an Assignee.

Nomination under the insurance contract refers to nominate someone on your behalf in order to collect the benefit in your absence. A person who is trustworthy can be nominated upon the death of a person. The trustworthy person could be from the dead person’s family or close friends. Then that person is the nominee of the policy.

However in most of the cases, people choose their family member as the nominee of the policy but as per the insurance act of 1938, under section 39, the nomination of a particular person is not restricted to a family only. Any person who is considered as trustworthy and any person who will not misuse the policy are considered to be an ideal nominee of that particular policy.

Types of Assignment

There are two types of assignment of policies:

  • Absolute assignment: under this particular type of assignment, the assignor is bound to transfer the ownership, title, legal interests and all the rights of the policy to the assignee. This type of transfer of the policy does not include the terms and conditions on the part of the assignee. The exact purpose of the absolute assignment is to repay the debts or to show affection to loved ones.
  • Collateral assignment: collateral assignment refers to that particular assignment in which the policyholder assigns the policy on terms and conditions, and the assignee is restricted to avail the benefits of all the terms and conditions. The main purpose of the collateral assignment is to repay loans and liabilities.

Types of Nomination

There are three types of nominations, such as:

  • Beneficiary nominee: in this particular nomination a particular person can be made beneficiary to the immediate family members like parents, children, and spouse. The beneficiary will be entitled to receive all the benefits of the policy legally only in case of unfavourable conditions.
  • Minor nominee: since it is considered that a minor cannot deal with financial conditions, the guardian of that particular minor has to give the details of their selves only when the policyholder chooses his/her child as the nominee.
  • Non-family nominee: a non-family member is that person who does not have blood relation with the policyholder such as close friends, a distant relative, a neighbour, etc. under section 39 of the insurance act of 1938; any trustworthy person can be a policy nominee.

Nomination and Assignment in Life Insurance Plans

As it is already known that insurance is a legal contract between the insurance company who is also called the insurer and the policyholder. An assignee is a person to whom the rights have been transverse to. An example of an absolute assignment is as follows: Mr Bharath owns a life insurance policy of 1 crore and he wants to gift this particular policy to his wife as ‘absolute assignment’ to her name. Once this absolute assignment is made to his wife’s name, she will be the owner of the policy. She also has the right to transfer this policy to someone else.

An example of a conditional assignment is as follows: Ms Supriya owns a term insurance policy of 900,000. She wants a home loan of the same amount. Hence her banker asked her to assign the term policy in their name in order to get the loan.  If Supriya meets an untimely death the banker is entitled to enjoy their money. An assignment deed or deed of assignment [DOA] is that deed through which rights can be transferred from one person to another.

Sections and Policies

SECTION 38- ASSIGNMENT AND TRANSFER OF INSURANCE POLICIES

The provisions under section 38 of the Insurance Law Act, 2015. The provisions of this particular section are as follows:

  • This policy allows itself to be transferred with or without consideration.
  • An assignment has a high chance of being affected by an endorsement upon the policy or by a separate instrument to the insurer.
  • The instruments should reflect the assignment and the reasons for the transfer.
  • An authorized agent or the transferor should sign the assignment.
  • The transferor of the assignment should not be operative against an insurer until prior notice is issued
  • The authority has the right to specify the fees that is paid for the transfer
  • The insurer is also expected to give a written acknowledgement of receipt of the notice. Such notice acts as evidence for the future.
  •  The notices shall be delivered only at one place where the policy is being served in order to avoid confusions. This arrangement is made as the insurer is involved in managing more than one business place.
  • The insurer has the right to accept or deny acting upon any transfer or endorsement only if it is not bonafide or not in the public interest.
  • Before denying the endorsement, the insurer should make a note of the reasons for the same.

SECTION 39- NOMINATION BY POLICYHOLDER

The provisions of this particular section are as follows:

  • The policyholder can nominate a person to whom money secured by the policy shall be paid during the death.
  • When in case of a minor, the policyholder can appoint any person to receive the money in the event of policyholder’s death during the minority of the nominee.
  • Nomination can be made at any time before the maturity of the policy.
  • The nomination can be incorporated or endorsed to the insurer.
  • The provisions of section 39 are not applicable to any life insurance policy to which section 6 of the Married Women’s Property Act, 1874 applies.
  • If the nominee dies before the policyholder, the money is payable to the legal representatives or the holder of succession certificate.

SECTION 45- Policy shall not be called in question on the ground of misstatement after three years

Provisions of this section are as follow:

  • Any policy of life insurance shall not be called in question after the expiry of three years from the date of issuance of the policy, the date of commencement of risk, the date of revival, the date rider coming to the policy.
  • Silence is not considered to be fraud unless it depends on the circumstances of the case.
  • The insurer can call for age proof at any time only if he is entitled.
  • No insurer can reject a life insurance policy on the grounds of fraud if the beneficiary can prove that the fraud was true to the best of his knowledge.

Difference between Nomination and Assignment

Assignment of policies- impact on existing nomination.

  • According to section 39(4) of the insurance act, 938, the assignment of an insurance policy automatically cancels the nomination.
  • Here are the few circumstances under which the assignment does not automatically cancel nomination :

When the policy loan is taken from the life insurer who issues the policy, the policy has to be assigned in favour of the life insurer. Under such circumstances, assignments in favour of the life insurer do not automatically cancel the nomination.

On the other hand, where the policy is assigned by a debtor to creditor acts as collateral security for the loan taken by the policyholder from the assignee.

The nomination and assignments have their own uses and benefits as a separate topic under the insurance contracts. I have gained in-depth knowledge of what exactly is nomination and assignment along with minute differences between them. The differences between them have helped me gain much more understanding of the topic. Nomination protects the interests of the insured and the insurer. Whereas the assignment strives to protect the interests of the assignee in availing all the benefits.

  • Successive Nominee:  Having consecutive nominations is a wise option considering unpredictable incidents that may take place in the future. In this type, you can choose more than one and up to 3 nominees, but successively. For instance, if you choose three nominees in X, Y and Z succession, your insurance company will offer the benefit to X when the time comes. In case X does not survive either, the amount will go to Y and so on.

What is assignment in life insurance?

A life insurance policy can be assigned when rights of one person are transferred to another. The rights to your insurance policy can be transferred to someone else for various reasons. The process is known as assignment.

An “assignor” (policyholder) is the person who assigns the insurance policy. An “assignee” is the person to whom the policy rights have been transferred, i.e. the person to whom the policy has been assigned.

In the event rights are transferred from an Assignor to an Assignee, the rights of the policyholder are canceled, and the Assignee becomes the owner of the insurance policy.

People often assign their life insurance policies to banks. A bank becomes the policy owner in this case, while the original policyholder continues to be the life assured whose death may be claimed by either the bank or the policy owner.

Types of Assignment

There are two ways to assign an insurance policy. They are as follows:

1. Absolute Assignment

During this process, the rights of the assignor (policyholder) will be completely transferred to the assignee (person to whom the policy rights have been transferred). It is not subject to any conditions.

As an example, Mr. Rajiv Tripathi owns a Rs 1 Crore life insurance policy. Mr. Tripathi wants to gift his wife this policy. Specifically, he wants to make “absolute assignment” of the policy in his wife's name, so that the death benefit (or maturity proceeds) can be paid directly to her. After the absolute assignment has been made, Mrs. Tripathi will own this policy, and she will be able to transfer it to someone else again.

2. Conditional Assignment

As part of this type of assignment, certain conditions must be met before the transfer of rights occurs from the Assignor to the Assignee. The Policy will only be transferred to the Assignee if all conditions are met.

For instance, a term insurance policy of Rs 50 Lakh is owned by Mr. Dinesh Pujari. Mr. Pujari is applying for a home loan of Rs 50 Lakh. For the loan, the banker asked him to assign the term policy in their name. To acquire a home loan, Mr. Pujari can assign the insurance policy to the home loan company. In the event of Mr. Pujari’s death (during the loan tenure), the bank can collect the death benefit and get their money back from the insurance company.

Mr. Pujari can get back his term insurance policy if he repays the entire amount of his home loan. As soon as the loan is repaid, the policy will be transferred to Mr. Pujari.

In the event that the insurer receives a death benefit that exceeds the outstanding loan balance, the bank will be paid from the difference between the death benefit and the loan and the balance will be paid directly to the nominee. In the above example, the remaining amount (if any) will be paid to Mr. Pujari’s beneficiaries (legal heirs/nominee).

Key Points to know Note About Assignment

In regards to the assignment, the following points should be noted:

  • A policy assignment transfers/changes only the ownership, not the risk associated with it. The person assured thus becomes the insured.
  • The assignment may lead to cancellation of the nomination in the policy only when it is done in favour of the insurance company due to a policy loan.
  • Assignment for all insurance plans except for the pension plan and the Married Women's Property Act (MWP), can be done.
  • A policy contract endorsement is required to effect the assignment.

What is nomination in life insurance?

Upon the death of the life assured, the nominee/ beneficiary (generally a close relative) receives the benefits. Policyholders appoint nominees to receive benefits. Under the Insurance Act, 1938, Section 39 governs the nomination process.

Types of Nominees

In a life insurance policy, the policyholder names someone who will receive the benefits in the event of the life assured's death. Here are a few types of nominees:

1. Beneficial Nominees

In accordance with the law, the beneficiary of the claimed benefits will be any immediate family member nominated by the policyholder (like a spouse, children, or parents). Beneficiary nominees are limited to immediate family members of the beneficiary.

2. Minor Nominees

It is common for individuals to name their children as beneficiaries of their life insurance policies. Minor nominees (under the age of 18) are not allowed to handle claim amounts. Hence, the policyholder needs to designate a custodian or appointee. Payments are made to the appointee until the minor reaches the age of 18.

3. Non-family Nominees

Nominees can include distant relatives or even friends as beneficiaries of a life insurance policy.

4. Changing Nominees

It is okay for policyholders to change their nominees as often as they wish, but the latest nominee should take priority over all previous ones.

In regards to the nomination, the following points should be noted:

  • In order to nominate, the policyholder and life assured must be the same.
  • In the case of a different policyholder and life assured, the claim benefits will be paid to the policyholder.
  • Nominations cannot be changed or modified.
  • The policy can have more than one nominee.
  • As part of successive nominations, if the life assured appoints person “A” as the first person to receive benefits. Now, in the event of the life assured’s death after person “A” dies, the claim benefits will be given to person “B”. The benefits will be available to Nominee “C” if Nominee “A” and Nominee “B” have passed away.

Here's what you need to know about your tax liability if you receive proceeds from a life insurance policy.

If you cancel a whole life or universal life insurance policy , you typically receive the cash surrender value, which is your policy's cash value minus any fees. You don't have to pay taxes on the principal when it's returned, but any cash value your policy has accrued will be taxed as income.

Short-term health insurance is meant to cover your medical bills for a short time, often during a gap in other insurance coverage. However, short-term health insurance does not provide as much coverage as a traditional health insurance plan. Insurers can also charge more and even deny applicants who have pre-existing medical conditions. The duration of these plans has been limited by federal rule-making.

How Short-Term Health Insurance Works 

Short-term health insurance may also be known as limited-duration health insurance or short-term, limited-duration insurance (STLDI). If your state allows these policies, for now, you can enroll in short-term insurance for a duration of up to 12 months, which can be extended to a maximum of 36 months through renewals.

All policies that begin on Sept. 1, 2024 or later may only last for three months, with a possible one-month extension. 

Short-term health insurance plans aren’t defined as “individual health insurance coverage” under the Public Health Service Act. As a result, short-term plans work differently than traditional health insurance coverage. Insurers have more flexibility in how they design the plans. You also don’t benefit from ACA’s federal consumer protections .

Many short-term insurance plan providers offer significant consumer choices regarding coverage and costs. For example, you may be able to choose your own: 

  • Deductible : This is per person per term, such as $2,500 or $12,000
  • Term coinsurance maximum : The most you pay for covered services after you meet the deductible  
  • Maximum coverage : The most the plan pays for covered services during the term per person
  • Copay or coinsurance : Your share of the cost for each service
  • Prescription drug cost : Your share of prescription drug coverage, if available

Changing these variables will change your monthly premium. You may be able to add supplemental benefits, including virtual health care services, vision, dental, and other benefits. 

Federal regulations for short-term health insurance primarily only cover how long the plan can last and whether you can renew the plan. Some states have additional rules for short-term insurance benefits, while others don’t. 

In contrast, traditional health insurance is highly regulated by federal and state law. Here are some significant ways short-term health insurance differs from traditional insurance. 

You can buy an Affordable Care Act (ACA) plan on the ACA Health Insurance Marketplace or your state exchange. Buying on one of these websites may allow you to qualify for cost-sharing reductions that lower the cost of your healthcare. Plans can only use your age, area, and smoking status to determine your monthly cost.

In contrast, you must buy a short-term health insurance plan directly from the insurer or a licensed insurance agent. It isn’t available on the ACA Marketplace, and you won’t qualify for federal aid or reductions. Short-term plan premiums aren’t limited to being based only on age, area, and smoking status—the insurer can base your premiums on any number of aspects, including your health. 

ACA plans typically last one calendar year and are renewable even if you develop health issues. 

As previously mentioned, a short-term plan’s term can last only up to four months in total, for plans beginning on or after Sept. 1, 2024.  Before the new rule takes effect, some plans can be renewed for up to three years in some states. 

Deductibles and coinsurance out-of-pocket maximums typically apply to a single policy term, not for the whole year or multiple years. If you renew, you’ll pay the deductible and coinsurance again. 

Maximum Out-of-Pocket Expenses

Traditional health plans typically feature an out-of-pocket maximum or cap on the most you would pay out-of-pocket for health services. For example, the most you’d pay out of pocket on a Marketplace plan is $9,450 for an individual and $18,900 for a family in 2024. Once you hit the maximum, the plan continues to pay for covered care. There’s no limit on how much the traditional health plan will pay for your treatment. 

In contrast, short-term health plans have a lifetime maximum the insurer will pay, often between $250,000 and $2 million. This is the total your plan will pay for covered costs. So, if you have a $1 million plan maximum, once your medical bills total $1 million, the plan won’t pay anything else toward your care. 

Pre-existing Conditions

Short-term health insurance providers can deny you coverage if you have a pre-existing condition , charge you more because you’ve had a condition, or refuse to pay for specific procedures if the insurer determines you have a pre-existing condition. 

In contrast, according to federal law, health insurance cannot deny you coverage or charge you more based on your health history or current health. 

Standard Procedure Coverage

Many types of care coverage required in an ACA or group health insurance plan may not be included or available in your short-term health insurance plan. 

These include the ACA 10 Essential Health Benefits and other standard benefits such as: 

  • Outpatient care
  • Maternity and newborn care
  • Preventive services and wellness
  • Prescription drug coverage
  • Lab services
  • Immunizations

Limits on Treatment of Common Conditions

Whether or not you have a pre-existing condition, an insurer may deny coverage for specific conditions for a period of time, such as the first six months, or for the entire contract. According to a 2020 staff report from the U.S. House of Representatives, these common conditions include: 

  • Kidney disease
  • Skin disease
  • Allergy treatment or diagnosis
  • HIV and AIDS
  • Organ transplants
  • Eye surgery
  • Sleep disorders  

The Congressional report found that many short-term plans have waiting periods for covered treatment, even for serious conditions such as cancer or a medical emergency. 

Coverage Limits

Even if treatment is covered, plans may impose maximum coverage limits for treatment. For example, some plans limit:

  • Doctor visits: How often you can visit the doctor or a dollar maximum, such as $500 per policy period. 
  • Daily hospital stays: Dollar limits may range from $500 to $10,000. 
  • Emergency room coverage: Caps on treatment reimbursements could be as low as $250 
  • Surgery: Limits may be placed on the number of surgical procedures that are covered or on the dollar amount covered 

Due to these limits, you could be billed by the facility or provider for the remaining amount, which could quickly spiral into medical debt.

  • Limited coverage for services, and treatments: As noted earlier, many short-term plans place dollar, frequency, or other limits such as exclusions on expected health services and treatments.
  • Coverage denial or higher rates based on pre-existing conditions : If you have a pre-existing condition, the short-term plan provider may deny you coverage, charge you a higher premium, or exclude your condition from any future treatment.  
  • Confusing documentation: Shopping for a short-term health insurance plan can be very confusing, with plenty of exclusions and fine print. Short-term health insurance plans do not follow set standards like ACA plans. 

New Biden-Harris administration rules require insurers to describe service types and cost limits in “easy to understand” language.

History of Short-Term Health Insurance

Regulations and controversy around short-term health insurance have bounced around over the past 20 years or so. 

In June 1997, federal regulations restricted short-term health insurance contracts to a maximum of 12 months of coverage. Then, in January 2017, the Obama administration shortened that maximum duration to up to three months of coverage. 

But in October 2018, the Trump administration’s Department of Health and Human Services increased the short-term maximum duration to up to 12 months. In addition, a short-term plan can be renewed for up to 36 months.

Since the Trump administration’s changes, many states have set limits on plans based on plan design, plan contract length, and options to renew. 

The result has been a state-by-state difference in how short-term plans work. In Alabama, a short-term plan can’t last more than 12 months and is renewable for up to 36 months. But in Colorado, a short-term plan can’t last more than six months and cannot be renewed.

In March 2023, the Biden-Harris administration , calling short-term insurance “junk insurance,” instituted the new nationwide rule limiting plan duration to four months max and requiring clearer disclosure of limits.

Choosing a Short-Term Health Insurance Plan

When comparing short-term plans, make sure you understand the following: 

  • Definition and coverage of pre-existing conditions
  • Does the short-term plan use a provider network, and if so, how much of a doctor’s visit is covered?
  • What deductible do you have to meet before the plan pays, and do you have enough savings to pay that in full if necessary? 
  • What’s the maximum amount the plan pays per term or lifetime?
  • Does the plan cover expensive emergency room visits, hospital stays, surgery, or prescription drugs? If so, what are the limitations?
  • Does the plan cover preventive care, and if so, what type?
  • Are there exclusions in the policy and is it possible you might need those services?

In most cases, you’ll want to closely read the policy documentation—which may be many pages long. Get help from a consumer advocate or licensed insurance agent to ask more challenging questions.

When comparing pricing, ensure you compare apples-to-apples by looking at plans with the same deductible and maximum benefit amount (such as a $2,500 deductible and $1 million benefit) and overall coverage (such as similar preventive services coverage). 

What is Short-Term Health Insurance Used For?

Short-term health insurance can be used for various health reasons, which depend on what kind of coverage the plan offers. For example, many plans cover emergency care and hospitalization, but only some cover prescriptions or routine preventive care visits. Few plans offer pregnancy coverage. If you’re pregnant and need coverage, consider Medicaid or an ACA plan. 

Is Short-Term Coverage a Good Idea?

Short-term coverage may be helpful in limited situations. For example, if you’re between plans, don’t qualify for a special enrollment period, and know you’ll have traditional health insurance coverage soon, it may be worthwhile. However, read the policy closely to understand what may not be covered. If you’re financially stressed, a Bronze or Catastrophic ACA health plan may offer better coverage at a comparative price—if you qualify for an enrollment period . 

How Do I Qualify for Short-Term Health Insurance?

Almost anyone can qualify for short-term health insurance, regardless of income, immigration status, or employment status. However, you may have a more challenging time finding coverage if you have a pre-existing condition or are over age 65 and eligible for Medicare .  In addition, you need to live in a state where short-term health insurance is available. In some states, short-term plans don’t meet the state’s requirements for health insurance plans. These states include California, Minnesota, New Jersey, New York, Vermont, and Washington State. 

Sometimes, a short-term health insurance plan may make sense as a temporary solution. However, you’ll need to seriously investigate any plan’s benefits and drawbacks before enrolling—you may not be buying the coverage you think you’re getting. Research your options; don’t just go with the cheapest plan out of haste or confusion. Get help, if necessary, from a licensed health insurance agent referred by friends or family.

DPHS Research Highlights Long-Term Care Insurance's Impact on Caregivers and the Economy in Presidential Report

According to research highlighted in the recent  2024 Economic Report of the President , long-term care insurance (LTCI) and other policies can indirectly affect the livelihoods and mobility of adult-children caregivers, resulting in impacts to the U.S. labor market.

These insights are found in Box 3-6 Long-Term Care of Chapter 3: Population, Aging, and the Economy, which examines how trends in fertility and mortality are shaping the U.S. population and labor force. The highlight combines the expertise of researchers to emphasize the increasing demand for long-term care due to an aging U.S. population, the need for better access to affordable care, the role of Medicaid, and the impact of caregiving on labor market participation. The highlight also advocates for continued federal investment in caregiving.

That impact was the subject of  Family spillovers and long-term care insurance , published in July 2023 in the Journal of Health Economics by Van Houtven, Norma B. Coe of the University of Pennsylvania, and Gopi Shah Goda at Stanford University. Their research is one of the first to examine insurance design and policy levers affecting unpaid caregivers. It found that LTCI does not significantly reduce the use of informal care among insured individuals over approximately eight years. However, it does influence family dynamics, leading to a decrease in parents' expectations of their children's willingness to provide future care and a lower likelihood of adult children co-residing with their parents, coupled with a stronger attachment to the labor market.

LTCI is an additional form of insurance coverage individuals may opt to purchase to help cover the costs of nursing home, home health, or other personal care often encountered by older adults or those with chronic or disabling conditions. For LTCI to take effect, policyholders must maintain the insurance over decades. This additional, long-term expense is financially prohibitive for many Americans. Lack of coverage often leads adult children, particularly women, to make the difficult choice of reducing their working hours, or leaving the labor market, potentially risking their own long-term economic security.

"Women are the default caregivers and tend to be the most intensive caregivers," said Van Houtven. "This is really a gender equity issue, considering our long-term care system relies on unpaid and informal caregivers. Similarly, people with marginalized identities are also bearing the brunt of this due to lack of generational wealth. Addressing universal long-term care insurance at the federal level would be more equitable."

Van Houtven continues to research how other policies, like the Affordable Care Act Medicaid expansion and Earned Income Tax Credit Program, impact unpaid caregivers. Future work will analyze these spillover effects.

Biden reverses a Trump-era policy on cheap but limited short-term health insurance

The Biden administration plans to roll back a cornerstone of former President Donald Trump's health policy agenda − short-term health insurance.

Short-term health insurance plans offer limited benefits and less expensive monthly premiums but deny coverage for previously existing medical conditions.

Under the new rule finalized last week, the Biden administration will cut the duration of short-term health insurance plans to three months with a one-month renewal option. Companies that sell short-term plans must also provide consumers with a disclaimer detailing the limits of services and amounts the plans cover. The rule reverses a 2018 Trump administration policy that allowed consumers to remain on short-term plans for up to three years.

These plans were designed to offer a short-term option for consumers who do not have coverage from an employer or other source, however, experts warn they offer skimpy coverage and can leave consumers with unpaid medical bills. The White House referred to these plans as "junk insurance," noting in a fact sheet that the new rule would ensure Americans aren’t "scammed into low-quality coverage that leaves consumers on the hook for thousands of dollars in medical bills" and put in situations where they are denied care.

Short-term plans don't offer the same protections as Affordable Care Act plans, which require insurers to cover a range of standard benefits such as emergency, maternity and mental health care. And unlike short-term plans, Obamacare plans cannot deny coverage based on a person's previously existing medical conditions.

Biden's new rule , which takes effect June 17, is a return to the Obama administration's policy, which limited the sale of short-term plans to 90-day periods as a stop-gap between more robust plans.

U.S. Department of Health and Human Services Secretary Xavier Becerra, said the rule "is cracking down on junk insurance plans to help consumers make informed choices and avoid mistakenly paying for a plan that does not provide them the coverage or protection they expect."

Sabrina Corlette, founder and co-director of the Center on Health Insurance Reforms at Georgetown University's McCourt School of Public Policy, said the policy aims to inform consumers about differences between short-term plans and more robust coverage offered through the Affordable Care Act.

"It's a clear repudiation of the Trump administration's policy with respect to short-term plans," said Corlette.

Biden touts health agenda

The restriction on short-term insurance plans comes as the Biden administration works to shore up the Affordable Care Act federal and state marketplaces, which showed record enrollment – with more than 21 million people signing up this year. Most working-age people get health insurance through their employers while older, low-income and disabled Americans often get covered through the government health insurance programs Medicare and Medicaid.

Also this week, Biden and his 2020 rival Sen. Bernie Sanders teamed up to tout lower prescription drug costs for older Americans, whether through legislation or the bully pulpit. Biden's Inflation Reduction Act empowers Medicare to negotiate prices for some prescription drugs, caps insulin costs at $35 per month for Medicare enrollees and limits out-of-pocket spending for some doctor-administered drugs.

Sanders, an Independent, has summoned pharmaceutical company executives to appear before a Senate committee he chairs to defend their drug prices. The president lauded the Vermont senator's dogged effort on behalf of patients.

"With Bernie’s help, we’re showing how healthcare ought to be a right and not a privilege in America," Biden said during an appearance Wednesday, discussing efforts to rein in prescription drug spending.

Short-term plans popular with contractors, gig workers

Advocates of short-term plans say they provide options for healthier adults who want more affordable choices for health insurance.

Ronnell Nolan, CEO of Health Agents for America, a trade association representing independent health insurance agents, said limiting short-term plans to three months, plus an optional fourth, means consumers would have fewer choices when shopping for health insurance.

"Every American deserves to make a choice for themselves on what type of product works for them," said Nolan, an insurance agent in Louisiana.

Brian Blase, a White House adviser during the Trump administration, said shortening the duration of short-term plans will create headaches for middle-class Americans who rely on this type of insurance. He said the plans are popular with cost-conscious consumers such as independent contractors or gig workers who earn too much to qualify for ACA subsidies and don't get coverage through an employer.

"People spend their own money on these plans," said Blase, who now serves as president of Paragon Health Institute, a health policy think tank. "There's no subsidy on short-term plans, so people have incentive to make sure the plans offer them value."

Blase predicted the new rule would effectively increase the number of uninsured Americans. The Biden administration has touted efforts to lower the nation's uninsured rate, in part, through pandemic-era policies that offered more generous subsidies for people enrolled in ACA plans.

In 2020, the House Energy and Commerce Committee estimated that about 3 million people were enrolled in a short-term plan in 2019. The committee report, which examined eight short-term health plans, found these insurers limited coverage for patients' existing medical conditions and spent 48% of premium dollars on medical claims. By comparison, ACA individual plans must spend at least 80% of premium dollars on medical claims.

Corlette, of Georgetown, noted that short-term plans will still be available for purchase under the Biden rule. But she said the protections mean they will no longer be "deceptively marketed as a comprehensive, ACA-compliant insurance plan."
