Michigan has adopted the Uniform Bar Exam. The exam is administered over two days.

The written portion of the exam is administered on the first day of the Michigan bar exam. The written portion of the bar exam consists of the Multistate Essay Exam. You will have 3 hours to answer 6 essay questions. You will also have 3 hours to answer 2 Multistate Performance Test questions.

The Multistate Bar Exam (“MBE”) is administered on the second day of the Michigan bar exam. The MBE is a multiple-choice test containing 200 questions. The MBE is split into a morning and afternoon session. Each session consists of 100 questions. You have three hours to complete each session.

Michigan Bar Admissions

Michigan mpre score requirement.

Michigan requires bar exam applicants to pass the Multistate Professional Responsibility Exam (“MPRE”). You must score 85 or higher on the MPRE in order to pass in Michigan.

Scoring/Grading and Results

In order to pass the Michigan bar exam, you must score at least 135. The Michigan bar exam score calculation provides that the MBE portion is worth 200 possible points, and each essay is worth 10 points for a total of 150 possible points. A combined score of at least 135 must be earned to pass the bar exam. Michigan bar exam results are usually released in mid-November for the July bar exam and mid-May for the February bar exam.

Reciprocity

Michigan permits admission on motion without examination when an attorney licensed to practice law in the United States satisfies educational and character and fitness eligibility requirements, and the following additional requirements are satisfied:

  • Attorney is a member in good standing of the Bar where admitted to practice.
  • Attorney intends to practice in Michigan, or to be a full-time instructor at a reputable and qualified Michigan law school.
  • Attorney has been, for three of the five preceding years, actively practicing law as a principal business or occupation; or been employed as a full-time instructor at a reputable and qualified law school; or been on active duty in the United States armed forces as a judge advocate, legal specialist, or legal officer.

Bar Exam Format

Michigan administers the Uniform Bar Exam (UBE) that consists of three parts: the Multistate Performance Test (MPT), the Multistate Essay Exam (MEE), and the Multistate Bar Examination (MBE). The exam is scheduled biannually on the last Tuesday and Wednesday of February and July. The MPT and MEE occur on Tuesday; the MBE occurs on Wednesday.

Multistate Performance Test (MPT)

(weighted 20% of bar exam score).

The MPT consists of two 90-minute items that are designed to assess the examinee’s ability to use fundamental lawyering skills in a realistic situation. Each examinee receives a “File” of source documents and a “Library” of cases, statutes, and rules. The MPT is a “closed universe” component in that it provides all necessary materials to answer the question and does not require the applicant to use any state-specific law.

Multistate Essay Exam (MEE)

(weighted 30% of bar exam score).

The MEE consists of six 30-minute essays testing the following subjects: all MBE subjects (Civil Procedure, Constitutional Law, Contracts and Sales, Criminal Law and Procedure, Evidence, Real Property, and Torts), plus Business Associations (Agency, Corporations, and Partnerships), Conflict of Laws, Family Law, Secured Transactions, Trusts and Future Interests, and Wills and Decedents’ Estates.

Multistate Bar Exam (MBE)

(weighted 50% of bar exam score).

The MBE consists of 200 multiple-choice questions that test the following areas: Civil Procedure, Constitutional Law, Contracts & Sales, Criminal Law & Procedure, Evidence, Real Property, and Torts. Of the 200 questions, 175 are scored questions and 25 are unscored pre-test questions. The pre-test questions are indistinguishable from the scored questions so applicants are advised to answer all questions.

How is the exam scored?

MBE and essay scores are each weighted at 50% (placed on a common scale) combined, and averaged to determine if a passing score of 135 was achieved.

When are the results released?

Results are released in mid-May for the February exam and in mid-November for the July exam.

Can I transfer my MBE scores from another jurisdiction?

Michigan allows applicants to transfer scaled MBE scores from reciprocal jurisdictions if taken within 3 years and the applicant passed the entire bar exam of which the MBE was part.

What about reciprocity across states?

In order to be eligible for admission without taking the Michigan Bar Exam, the applicant must have engaged in the active practice of law for 3 of the 5 years immediately preceding the application and be a graduate of an ABA accredited law school.

A member in good standing of another U.S. state or territory may be admitted on motion in Michigan if the applicant has engaged in the active practice of law for three of the five years preceding application. Additional requirements apply.

Bar examinees and UBE score transfer applicants are required to complete the Michigan Law Basics online training as a condition for admission. The Michigan Law Basics training will consist of engaging video-based guidance, demonstrations and expert overview for six practice areas: Civil Litigation; Criminal Law; Family Law; Probate and Estate Planning; Real Property; and Torts and No-Fault.

Applicants are not graded on the training but are required to correctly answer the questions in each lesson. After successful completion of all modules, applicants will receive a certificate of completion for transmittal to the BLE.

If you are taking the Michigan Bar Exam, you may wonder what subjects will appear on the exam.

There are two parts to the Michigan Bar Exam—the Multistate Bar Exam (MBE) and the essay portion of the bar exam. The MBE tests seven subjects. The essay portion tests a potential of 24 Michigan Bar Exam subjects. Here, we tell you the subjects tested on each portion of the exam and we also give you a brief overview of each portion of the Michigan Bar Exam.

Seven subjects are tested on the MBE:

  • Civil Procedure

A brief overview of the MBE:

  • The MBE is a national test so majority law is applied.
  • The MBE consists of six hours of multiple-choice (three hours in the morning, three hours in the afternoon).
  • There are 200 questions in total. Each question is worth one point.
  • 175 questions are scored. 25 questions are test questions.
  • There are 25 scored questions on each subject.
  • The MBE is scaled according to an undisclosed formula. However, if you score about 65%, your score is likely considered passing.

A few tips when examining the list of Michigan Bar Exam subjects:

  • Some subjects (like Creditors Rights/garnishments) are  not  covered by some commercial courses. They  are  fair game for the essay portion and have been tested recently!
  • Some subjects (like Professional Responsibility) the Board has indicated that it was not going to test anymore. They have told this to law schools. It is still worth it to be familiar with this area of law as the Michigan rule has not changed.
  • Please note some subjects are virtually always tested (e.g., Criminal Law, Criminal Procedure). Others are virtually never tested (e.g., Commercial Paper/Negotiable Instruments). While you should be familiar with all subjects, you should not  treat all equally when you study for the bar exam!

A brief overview of the essay portion:

  • The essay portion of the exam tests Michigan law. You will be expected to apply Michigan law unless told otherwise.
  • There are 15 essay questions to answer (nine in the morning portion, six in the afternoon portion).
  • You will have three hours to answer the essay questions in the morning and two hours to answer the essay questions in the afternoon.
  • You should allocate about 20 minutes per question in order to finish the exam on time.
  • 10 points are allocated for each question. A score of a 7 is considered passing.
  • The Michigan essay portion is scaled according to an undisclosed formula. However, traditionally, if you received an average score of a 7 on each essay, you will receive a score of 140 to 150 on the essay portion. (A 135 is considered a passing score).

To become a lawyer in Michigan, one must hold a degree from an accredited four-year university, make a passing score on the LSAT exam and complete an accredited law school program, and finally, complete the bar exam with a UBE total of 268 or greater.

Multistate Essay Exam (MEE)

The Multistate Essay Examination (MEE) is developed by NCBE and consists of six 30-minute questions. It is administered by user jurisdictions as part of the bar examination on the Tuesday before the last Wednesday in February and July of each year.

The purpose of the MEE is to test the examinee's ability to (1) identify legal issues raised by a hypothetical factual situation; (2) separate material which is relevant from that which is not; (3) present a reasoned analysis of the relevant issues in a clear, concise, and well-organized composition; and (4) demonstrate an understanding of the fundamental legal principles relevant to the probable solution of the issues raised by the factual situation. The primary distinction between the MEE and the Multistate Bar Examination (MBE) is that the MEE requires the examinee to demonstrate an ability to communicate effectively in writing.

Areas of law that may be covered on the MEE include the following: business associations (agency and partnership; corporations and limited liability companies), civil procedure, conflict of laws, constitutional law, contracts, criminal law and procedure, evidence, family law, real property, torts, trusts and estates (decedents' estates; trusts and future interests), and the Uniform Commercial Code (secured transactions).

Some questions may include issues in more than one area of law, and the particular areas covered vary from exam to exam.

Multistate Performance Test (MPT)

The Multistate Performance Test (MPT) is developed by the National Conference of Bar Examiners (NCBE) and consists of two 90-minute items. It is administered by user jurisdictions as part of the bar examination on the Tuesday before the last Wednesday in February and July of each year.

The MPT is designed to test an examinee's ability to use fundamental lawyering skills in a realistic situation and complete a task that a beginning lawyer should be able to accomplish. The MPT is not a test of substantive knowledge.

Rather, it is designed to evaluate certain fundamental skills lawyers are expected to demonstrate regardless of the area of law in which the skills arise.

Multistate Bar Exam (MBE)

The MBE is developed and graded by the NCBE.

This portion of the examination is an objective 6-hour examination containing 200 multiple-choice questions, which is divided into two 3-hour sessions during which 100 questions are administered.

The MBE tests 7 subjects: civil procedure, constitutional law, contracts, criminal law & procedure, evidence, real property, and torts.

Examinees and transfer applicants must successfully complete the Michigan Law Basics online training requirement prior to licensure.

When is the Michigan Bar Exam in 2023?

The NCBE (National Council of Bar Examiners) scores the MBE component of the exam.

Michigan total scores are reported on a 200-point scale and a passing score of 135 is required. The MBE and the MEE each make up 50% of the score.

Michigan Bar takers are required to take the MPRE (the Multistate Professional Responsibility Examination and pass with a score of at least 85. It's one of the most rigorous ethics exam requirements in the nation.

Results for the February exam are typically released in mid-May, while results for the July exam are typically released in mid-November.

Reciprocity

Michigan does allow for the transfer of UBE Scores 268 and higher and with a maximum age of 3 years.

Admission on Motion

Michigan does allow for admission on motion for those who've passed the UBE in other states for a fee of $800.

What is the uniform bar exam.

The Uniform Bar Exam (UBE) is effectively a national bar exam coordinated by the National Conference of Bar Examiners (NCBE) and is composed of three parts: (1) the Multistate Bar Examination (MBE) , the Multistate Essay Examination (MEE), and the Multistate Performance Test (MPT).

The UBE is uniformly administered, graded, and scored by adopting jurisdictions and results in a portable score that can be transferred to other UBE jurisdictions.

What does the Uniform Bar Exam application look like?

There is no Uniform Bar Exam application.

Applicants must register for the UBE by applying to a user jurisdiction. For example, a student taking the UBE in New York would apply to sit for the New York bar exam .

Applicants who have taken the UBE may transfer their UBE scores to seek admission in other UBE jurisdictions.

Are there states that are considering the UBE?

Every year more and more states are adopting the UBE.

In February 2021, the Texas bar exam will administer its first Uniform Bar Exam.

California and Florida are the largest legal markets still administering state-specific tests. While Florida has formally considered adopting the UBE, California seems to have no interest in doing so. The California bar exam , however, recently shorten from three days to two days, a step in the right direction.

Conflicts of Law : These issues are embedded in other topic areas and do not appear as standalone questions. Issues include domicile, the jurisdiction of courts, choice of law, and recognition and enforcement of other states'judgments and foreign judgments.

Constitutional Law (Con Law) : Nature of judicial review, separation of powers, relation of nation and states in a federal system, and individual rights.

Contracts : Formation of contracts, defenses to enforceability, contract content and meaning, performance, breach and discharge, remedies, and third-party rights.

Criminal Law and Procedure (Crimes) : Homicide, other crimes, inchoate crimes; parties, general principles, and constitutional protection of accused persons.

Evidence : Presentation of evidence, relevancy and reasons for excluding relevant evidence, privileges and other policy exclusions, writings, recordings, and photographs, and hearsay and circumstances of its admissibility.

Family Law : Getting married, being married, separation, divorce, dissolution, and annulment, child custody, rights of unmarried cohabitants, parent, child, and state, adoption, and alternatives to adoption.

Real Property : Ownership of real property, rights in real property, real estate contracts, mortgages/security devices, and titles.

Secured Transactions : Assume articles 1 and 9 of Uniform Commercial Code are adopted and in effect. General UCC principles, applicability, and definitions, validity of security agreements and rights of parties, rights of third parties, default.

Torts : Intentional torts, negligence, strict liability and products liability, and other torts.

Trusts and Decendents’ Estates : Intestate succession, wills, family protection, living wills and durable healthcare powers, and trusts and future interests.

Search online for state bar exam questions and answers, or use the list provided at the bottom of this page. Access is free.

  • Try writing a response to a practice question, then comparing your response to the model answer.
  • Some bar exam questions require the application of state law (e.g., California civil procedure), and may not be helpful if you are studying federal law. Read the question carefully. 
  • Subject coverage will vary by exam and by state.
